The Town Board has found there are instances in the Town of
owners of properties exploiting their buildings by
maintaining or creating illegal occupancies of their premises. These
illegal occupancies expose the residents therein to substandard rooms
or apartments. Such practices are in derogation of
the health, safety and welfare of members of the public who are entitled
to such suitable and safe housing as is assured by the Code of the
Town. Such illegal occupancies have a detrimental effect on Town services
to the community. Accordingly, enforcement of applicable Code provisions
is a legitimate governmental obligation which requires appropriate
consideration.
Notwithstanding any provision of this Code inconsistent herewith,
the owner and/or any person in control of the subject
property at the time of the violation shall be subject to a fine not
exceeding $1,000 or imprisonment for a period not to exceed six months,
or both. Each week's continued violation shall constitute a separate
additional violation.
