[The General Assembly of Maryland enacted in 1990 ch. 492, effective
June 1, 1990, which repealed Article 9 of the Code of Public Local
Laws and enacted the Code of Public Local Laws as set forth in Division
1 of this volume of the Code of Charles County, Maryland. Chapter
492 also provided that nothing in it may be construed to revive any
provisions of law that have previously been repealed expressly or
by implication by public general law or public local law. The General
Assembly of Maryland enacted in 1995 ch. 417, effective May 18, 1995,
for the purpose of legalizing the 1994 edition of the Charles County
Code of Public Local Laws, being Article 9 of the Code of Public Local
Laws of Maryland.]

WHEREAS, Charles County has codified its public local laws,
ordinances and certain resolutions in a volume entitled "Code of Charles
County, Maryland"; and
WHEREAS, the County Commissioners of Charles County, Maryland,
have determined that adoption of this codification is indicated in
order to effectuate certain substantive changes to Division 2 and
to ratify the volume as the Code of Charles County;
NOW, THEREFORE, BE IT ENACTED, by the County Commissioners of
Charles County, Maryland, this 26th day of June 1995, as follows:
The ordinances and resolutions adopted by the County Commissioners of Charles County, Maryland, a body corporate, as revised, codified and consolidated into chapters and sections by General Code Publishers Corp., and consisting of the ordinances and resolutions, which ordinances and resolutions are designated as Chapters
147 through
298, together with an Appendix, are hereby approved, adopted, ordained and enacted as Division 2 of the "Code of Charles County, Maryland," hereinafter known and referred to as the "Code."
This ordinance and the Code shall supersede all other permanent
ordinances and resolutions enacted prior to the enactment of this
Code.
A copy of the Code in loose-leaf form has been filed in the
County offices and shall remain there for use and examination by the
public until final action is taken on this ordinance, and, if this
ordinance shall be adopted, such copy shall be certified to by the
Clerk of the County Commissioners of Charles County, Maryland, by
impressing thereon the Seal of the County, and such certified copy
shall remain on file in the County offices, to be made available to
persons desiring to examine the same during all times while the Code
is in effect.
Any and all additions, amendments or supplements to the Code,
when passed and adopted in such form as to indicate the intent of
the governing body to make them a part thereof, shall be deemed to
be incorporated into such Code so that reference to the "Code of Charles
County, Maryland," shall be understood and intended to include such
additions and amendments or supplements. Whenever such additions,
amendments or supplements to the Code shall be adopted, they shall
thereafter be printed and, as provided hereunder, inserted in the
loose-leaf book containing the Code as amendments and supplements
thereto.
The Clerk to the County Commissioners of Charles County, Maryland,
pursuant to law, shall cause to be published, in the manner required,
a summary of this adopting legislation in a newspaper of general publication
in the County. Sufficient copies of the Code shall be maintained in
the County offices for inspection by the public at all times during
regular office hours. The enactment and publication of this adopting
legislation, coupled with availability of copies of the Code for inspection
by the public, shall be deemed, held and considered to be due and
legal publication of all provisions of the Code for all purposes.
It shall be the duty of the Clerk to the County Commissioners
or someone authorized and directed by her to keep up-to-date the certified
copy of the book containing the Code required to be filed in her office
for the use of the public. All changes in said Code and all legislation
adopted subsequent to the effective date of the legislation set forth
in this codification, which shall be adopted specifically as part
of the Code, shall, when finally adopted, be included therein by reference
until such changes or new legislation is printed as supplements to
said Code book, at which time such supplements shall be inserted therein.
Copies of the Code book containing the Code may be purchased
from the Clerk to the County Commissioners upon the payment of a fee
to be set by resolution of the County Commissioners, who may also
arrange, by resolution, for procedures for the periodic supplementation
thereof.
It shall be unlawful for anyone to improperly change or amend,
by additions or deletions, any part or portion of the Code or to alter
or tamper with such Code in any manner whatsoever which will cause
the law of Charles County to be misrepresented thereby.
Each section of the Code and every part of each section is an
independent section or part of a section, and the holding of any section
or a part thereof to be unconstitutional, void or ineffective for
any cause shall not be deemed to affect the validity or constitutionality
of any other section or parts thereof.
Each section of this ordinance is an independent section, and

A. In compiling and preparing the ordinances and resolutions for adoption
and revision as part of the Code, certain grammatical changes and
other minor changes were made in one or more of said ordinances and
resolutions. It is the intention of the County Commissioners of Charles
County, Maryland, that all such changes be adopted as part of the
Code as if the legislation so changed had been previously formally
amended to read as such.
B. In compiling and preparing the ordinances and resolutions for adoption
and revision as part of the Code, terms such as "subtitle," "subheading,"
"ordinance," "act," "resolution," etc., were changed to "section,"
"article" or "chapter" throughout the Code so as to accurately reflect
the new breakdown in the Code. It is the intention of the County Commissioners
of Charles County, Maryland, that all such changes be adopted as part
of the Code as if the legislation had been previously formally amended
to read as such.
C. In compiling and preparing the ordinances and resolutions for adoption
and revision as part of the Code, a new numbering system was used.
This new numbering system required that the references to the original
numbering of the legislation be changed to reflect the new numbering
system. It is the intention of the County Commissioners of Charles
County, Maryland, that all such changes be adopted as part of the
Code as if the legislation had been previously formally amended to
read as such.
This ordinance shall take effect on the first day of July 1995.
