All of the conditions, provisions, limitations, and terms of the building code of the State of New Mexico are hereby adopted as the conditions provisions, limitations and terms of the building rules and regulations of the Town of Tatum, by reference as if they were herein specifically set out in full.
A.
Permit requirements.

(1)
No person shall erect, construct, enlarge, alter, repair, improve, move or demolish any building or structure without first obtaining a separate permit for each building or structure from the designated person.
(2)
No person shall move, deliver, install or set up a mobile home without first obtaining a permit from the designated person.
(3)
No man-made change to improved or unimproved real estate, including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations, shall be commenced until a separate permit has been obtained from the designated responsible person for each change.
B.
Application. To obtain a permit, the applicant shall first file a permit application on a form furnished for that purpose. The form must be completed and submitted to the designated person before the issuance of a permit will be considered.
C.
Review of application. The Director of Public Works, hereinafter referred to as the "responsible person," is appointed as the person responsible for receiving applications and examining the plans and specifications for the proposed construction or development.
D.
The responsible person shall review proposed development to assure that all necessary permits have been received from those governmental agencies from which approval is required by federal or state law, including Section 404 of the Federal Water Pollution Control Act Amendments of 1972, 33 U.S.C. § 1334.
A.
It shall be unlawful for any person to build or cause to be built, constructed, or erected any building or other permanent structure or part thereof within 50 feet of the center line of U.S. Highway 380 or State Highway 18 where such highways lie within the corporate limits of the Town of Tatum, New Mexico.
B.
No building permit shall be issued by the Town until the applicant shall first file with the Town Clerk-Treasurer a plat indicating the location of the proposed structure or building with reference to the center line of the adjacent highway. This provision shall be applicable only to those buildings or structures where some part or portion lies within 50 feet of the center of one or both of the highways named above.
