It is hereby declared that the parking of motor vehicles in
the streets of the City is causing, at the present time, such congestion
in said streets as to constitute a public nuisance; that the addition
of more off-street parking facilities which shall include, but not
be limited to, parking lots, structures and garages, the improvement
of existing off-street parking facilities and the building of structures
on public off-street facilities, which will increase the number of
motor vehicles they can accommodate, is necessary to further abate
said nuisance; it is in the public interest to expend public funds
for the acquisition of land, the improvement of existing parking facilities
and the building of structures on public off-street parking facilities;
and the enactment of this article is hereby declared to be a public
necessity.

The term "facilities" as used in this article shall be construed
to mean facilities within the meaning of Section 22C of Chapter 40
of the General Laws, and any receipts from parking meters or other
means of revenue collection, installed in areas, facilities or garages
authorized by this article and operated and managed by the Commission,
shall be construed to be receipts within the meaning of such section.

The Off-Street Parking Commission is hereby abolished, and all
duties and authority heretofore delegated to the Off-Street Parking
Commission under this article are henceforth delegated to the Traffic
Commission.

The Mayor shall appoint one of the members of the Traffic Commission
or the Traffic Engineer as the Off-Street Parking Commissioner, and
that person shall be duly bonded.

It shall be the duty and responsibility of the Traffic Commission:
(1) To review periodically the need for additional off-street parking
facilities, and initiate requests and recommendations to the Mayor
and City Council for the acquisition of new off-street parking facilities;
(2) To initiate requests and recommendations to the Mayor and City Council
for maintenance and improvements to existing off-street parking facilities,
including new meters and maintenance and repairs to existing meters;
(3) To include the power to purchase public liability insurance in connection
therewith;
(4) To administer any funds allocated to the Commission by the Mayor
and City Council for the above-mentioned purposes;
(5) To promulgate rules and regulations regarding the use and operation
of off-street parking facilities;
(6) To perform such other duties as may be prescribed under law, or assigned
by the Mayor and City Council.

If the City determines to construct and operate off-street parking
facilities, the City, through its Traffic Commission, shall fix such
rate or charges for services furnished for parking as are best adapted
to insure sufficient income to meet the cost of the service or off-street
parking provided as herein. The cost of the service shall include
all operating expenses, interest on all indebtedness, all other costs
or charges incurred in the development, operation and management of
said garages or facilities, and maturing debt.
