A.ย 
Any owner of a limousine(s) who has a principal place of business in the Township shall be required to file an application and obtain a limousine owner's license from the Township Clerk. Upon receipt of the application, insurance policy, power of attorney and payment of required fees, the Clerk shall issue a license showing that the owner of the limousine has complied with the terms and provisions of this chapter. The original license shall be retained within the limousine and be available for inspection upon request by any law enforcement officer.
B.ย 
Any owner of a limousine who desires to provide service on a point-to-point basis within the Township shall be required to file an application and obtain a limousine owner's license from the Township Clerk. Upon receipt of the application, insurance policy, power of attorney and payment of required fees, the Clerk shall issue a license showing that the owner of the limousine has complied with the terms and provisions of this chapter. The original license shall be retained within the limousine and be available for inspection upon request by any law enforcement officer.
C.ย 
The number of licenses authorized by the Township shall be 35; however, the Township shall not be required to issue all authorized licenses. Each license issued hereunder shall expire on the following March 31. Fees shall not be prorated.
D.ย 
The Township Clerk shall issue, in duplicate, a license to operate to the owner who has fulfilled the terms and provisions of this chapter. The license shall recite the name of the insurance company, the number and date of expiration of the policy, a description of every limousine insured thereunder, and the registration number of same.
E.ย 
Nothing in this chapter shall be deemed to exempt any person from full compliance with the laws of the State of New Jersey, including N.J.S.A. 48:16-13 et seq.
F.ย 
Each applicant for a license to operate shall also be responsible for registering each vehicle with the Director of the Division of Motor Vehicles as set forth in N.J.S.A. 39:3-19.
Each applicant for a new or renewal limousine owner's license shall submit the following information to the Township Clerk on the approved form:
A.ย 
Name of applicant, principal place of business, telephone number, e-mail address, fax number.
B.ย 
The location of the dispatcher.
C.ย 
Whether previously licensed to operate a limousine and where; whether such license to operate has ever been revoked and, if so, for what cause.
D.ย 
If an individual, the applicant must be at least 21 years of age and provide present primary residential address.
E.ย 
If a corporation or partnership, the company name, main office and branch office locations:
(1)ย 
If a corporation, the state of the corporation; the names and primary residential addresses of all officers and directors; their citizenship status; and a list of all stockholders who hold more than 10% of the corporate stock.
(2)ย 
If a partnership, the names and primary residential addresses of each partner.
F.ย 
Every application shall contain the following information about each vehicle to be used as part of the business being licensed:
(1)ย 
Year, make, model and color.
(2)ย 
Vehicle identification number.
(3)ย 
New Jersey state license plate number.
(4)ย 
Passenger capacity.
(5)ย 
Insurance company, policy number and expiration date.
(6)ย 
Location at which the vehicles will be stored.
G.ย 
A copy of the bill of sale for each limousine to be operated on the streets of the Township of Franklin shall be filed with the application for a license to operate.
H.ย 
A copy of the vehicle registration shall be provided to the Township Clerk within 48 hours of the vehicle's registration with the Motor Vehicle Commission.
I.ย 
Any application for a new or renewal license which is not completed within 60 days of receipt of the application shall be denied and no license shall be issued.
No limousine service whose principal place of business is in the Township of Franklin shall be operated wholly or partly along any street in the Township of Franklin until the owner of the limousine or limousine service shall have filed with the Township Clerk an insurance policy of a company duly licensed to transact business under the insurance laws of this state in the sum of $1,500,000 insuring against loss by reason of the liability imposed by law upon every limousine owner for damages on account of bodily injury or death suffered by any person as the result of an accident occurring by reason of the ownership, maintenance or use of the limousine upon any public street.
The owner of the limousine shall, concurrently with the filing of the insurance policy described above, submit to the Township Clerk proof of the execution and delivery to the Division of Motor Vehicles (or Motor Vehicle Commissioner, as appropriate) of a power of attorney, wherein and whereby the owner shall appoint the Director of the Division of Motor Vehicles (or the Chief Administrator of the Motor Vehicle Commission, as appropriate) his true and lawful attorney for the purpose of acknowledging service of any process out of a court of competent jurisdiction to be served against the insured by virtue of the indemnity granted under the insurance policy filed.
