When an opening is made in a street for which a permit is required by section 13-51 of this Code, the portion of the street so opened shall be restored to a condition satisfactory to the director of public works and forestry and shall be kept in such condition thereafter, and if not so restored and maintained by the person performing the work, the director of public works and forestry shall cause the same to be done at the expense of such person.

(a) 
No person shall disturb the surface of a street for the purpose of Inying or removing wires or conduits or of erecting, removing or distributing of other poles, without a permit from the Council indicating the time, manner and place of the opening of such streets, and the time within which such work shall be completed.
(b) 
No person shall disturb the street for the purpose of repairing any wires, conduits or poles without a permit issued by the director of public works and forestry.
(c) 
Nothing in this section shall be construed as requiring any permit for the opening of manholes in order to draw in, remove or repair wires or cables.

No permit shall be granted pursuant to section 13-51 or if granted shall be valid, until the person desiring the permit has executed an agreement in a form satisfactory to and approved by the Mayor which provides:
(1) 
That in every underground conduit constructed by such person one duct, not less than three (3) inches in diameter, shall be reserved and maintained free of expense for the use of the wires belonging to the City and to be used exclusively for municipal purposes; but only low potential wires, that is, wires other than electric light and power wire shall be placed in the conduit of any telephone company; that the Superintendent of Electric Wires or any person duly authorized by the Mayor, shall be allowed access to such conduits at all times, and that the City shall be allowed facilities and privileges in putting in or taking out wires equal in all respects to those of such person.
(2) 
That such person will indemnify and save harmless the City against all damages, costs and expense whatsoever to which the City may be subjected in consequence of the acts or neglect of such person, its agents or servants, or in any manner arising from the rights and privileges granted it by the City.
a. 
Such person shall repair any damage, including replacement if necessary, to any traffic control detectors or signal installations that is caused by the breaking, digging up or excavating of a public way. The repairs, or replacement, shall be made forthwith, by the person causing the damage, upon the order of the director of public works, in accordance with City standards, and at no cost to the City whatsoever.
(3) 
That, in addition, such person shall, before a street is disturbed for the laying of its wires or conduits, execute a bond with surety to be approved in writing by the City Solicitor, in a penal sum of not less than ten thousand dollars ($10,000.00), conditioned to fulfill all its agreements with the City and its duties under this chapter; and a new bond of like import may at any time be required by the Council, which new bond shall be a strengthening bond, unless the surety on former bonds are expressly released from further liability by vote of the Council.
(4) 
That such person will at once comply with any change in their conduits, manholes or poles that the Council may, after a hearing duly appoint, order.
