It is intent of the Town Board of the Town of Lumberland to adopt reasonable regulations regarding the use of watercraft on Mohican Lake, situate within the Town of Lumberland.
As hereinafter used within this chapter, the following terms shall have the meanings indicated:
WATERCRAFT
Any type of motorized boat or craft which can be operated on Mohican Lake, including, but not limited to, a motorized boat and/or jet ski.
A watercraft may be operated on Mohican Lake from 11:00 a.m. until 7:00 p.m. at any reasonable rate of speed. From 7:00 p.m. until 11:00 a.m., no watercraft shall be operated on Mohican Lake at a speed greater than five miles per hour, except in emergency circumstances.
A. 
No watercraft shall be driven or operated within 150 feet of any shore of said lake in a manner or at a speed that causes a wake that unreasonably interferes with or endangers a dock, pier, raft, float, vessel or other property or endangers the health, safety and welfare of any person, but in no event at a speed exceeding three miles per hour.
B. 
All watercraft shall be operated in a careful and prudent manner not to interfere with or endanger others lawfully using said lake.
C. 
No watercraft shall be operated or driven at a speed greater than three miles per hour south of a line established by signs on the easterly and westerly shores of said lake, said signs to be 1,150 feet northerly of the north side of the dam of Mohican Lake. Signs for the designation of said points shall be erected and maintained by the Town of Lumberland.
D. 
No watercraft shall be operated or driven one-half hour after sunset without marker lights as required by Navigation Law.
E. 
Every watercraft carrying passengers or freight for hire, or towing for hire, or for use of which compensation is paid shall be navigated or operated only by a person duly licensed by the Inspectors as provided in Article 2 of the Navigation Law.
F. 
No person or persons in charge of a watercraft shall knowingly permit the use or operation of said watercraft in violation of any of the provisions of this chapter.
G. 
The traffic pattern on said lake shall be in a generally counterclockwise direction.
Any violation of the aforesaid chapter shall be punishable by a penalty not exceeding a fine of $50, and the person violating the same shall be duly punishable by law.
