There is created a Police Department, an executive department of this Village under the supervision of the Trustee of Public Health and Safety. The Police Department shall consist of the Superintendent of Police, who is the Chief of the Police Department, and the Department shall also consist of captains, lieutenants, sergeants, and patrol officers as may be provided from time to time by the Village Board.

There is created the office of Chief of Police. The Chief shall be appointed by the President with the consent of the Village Board. He or she shall be ex officio Village Marshal and Superintendent of Police. The term of appointment for the Chief of Police shall be determined by the Board but shall not, in any case, exceed the term of the President then holding office.
Before entering upon his or her duties, the Marshal shall file with the Village Clerk a bond in the sum of $1,000, with sureties approved by the Village Board, conditioned to indemnify the Village for any loss or liability due to or occasioned by any act or failure to act on the part of the Chief of Police.

The duties of the Chief of Police shall be as follows:
A. 
The Chief of Police shall supervise responsibility for police officers and dispatchers.
B. 
The Chief of Police shall oversee scheduling of officers and dispatchers, distribute overtime in a fair and equitable manner, and schedule officers and dispatchers in a fair manner, giving some weekends off to all employees.
C. 
The Chief of Police shall hire part-time police officers with the advice and consent of the President and Village Board and in accordance with all applicable state statutes and administrative requirements.
D. 
The Chief of Police shall hire dispatchers, both full-time and part-time, with the advice and consent of the President and Village Board and in accordance with all applicable state statutes and administrative requirements.
E. 
The Chief of Police shall prepare annual written evaluations of all Police Department employees, whether full-time or part-time. The evaluations shall be completed in writing and reviewed with the employee. The Chief of Police shall be responsible to see that the receipt of the evaluation is acknowledged by the employee. These evaluations shall be done for both police officers and dispatchers on an annual basis, based upon the hire date of each employee. Personnel records of each employee of the Police Department shall be maintained at the Village Hall by the Village Clerk, and not by the Chief of Police.
F. 
The Chief of Police shall be on call 24 hours a day, seven days a week.
G. 
The Chief of Police shall supervise training of all police officers and dispatchers and shall be responsible to see that all required training is completed.
H. 
The Chief of Police shall not maintain any part-time employment without the prior consent of the Village Board.
It shall be the duty of the members of the Police Department to see to the enforcement of all of the ordinances of the Village and all statutes applicable herein and to preserve order, prevent infractions of the law, and arrest violators thereof.
No member of the Police Department, except the Chief, shall serve any process except on command of the Chief of the Police Department.
It shall be the duty of every member of the Police Department to conduct himself or herself in a proper and law-abiding manner at all times and to avoid the use of unnecessary force. Each member of the Department shall obey the orders and directions of his or her superior.
Every member of the Police Department shall appear as witness whenever this is necessary in a prosecution for a violation of an ordinance or of any state or federal law. No member shall retain any witness fee for service as witness in any action or suit to which the Village is a party. Any fees for such services shall be turned over to the Chief, who shall deposit the same with the Village Treasurer.
The Chief of the Police Department may make or prescribe such rules and regulations for the conduct and guidance of the members of the Department as he or she shall deem advisable. These rules, when approved by the Village Board, shall be binding on the members. The respective rank and grade of the members as to superiority within the Department may be prescribed by regulation.

Any person of good character having duties which require it may be appointed an auxiliary police officer by the President; provided that except upon authorization of the Village Board, no auxiliary police officer shall be entitled to any compensation from the Village nor shall an auxiliary police officer be considered an official of the Village by reason of the appointment. Auxiliary police officers shall obey all rules of the Police Department applicable to them and may be deprived of their appointment by the Chief at any time.

A. 
Any police officer employed by the Village, either at the time of his or her appointment or while serving as such police officer, may reside outside the corporate limits of the Village.
B. 
Any full-time police officer employed by the Village shall be given one year from the date of his or her hire to establish residence within 20 miles of the Coal City Village Hall. A full-time police officer may live within any portion of a municipality which falls within the aforementioned guideline, regardless of the actual distance between one's residence and Village Hall. This residency requirement shall not apply to part-time police officers.
C. 
The Village Board may, in its discretion, include in any contract of employment with the Chief of Police a provision waiving or limiting the residency requirement of the Police Chief. This provision shall not apply to any other member of the Police Department.

The Village shall withhold social security taxes from wages paid to all employees of the Police Department.

A. 
Established. There is hereby created and established a Police Pension Fund in and for the Village in accordance with ILCS Ch. 40, Act 5, § 3-101 et seq. (Article 3 of the Illinois Pension Code).
B. 
Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
BOARD
The Board of Trustees of the Police Pension Fund.
POLICE
All full-time police officers or full-time police officers entitled to participate in the benefits of the Police Pension Fund as provided by Article 3 of the Illinois Pension Code.
C. 
Board duties. The rights, powers, duties, and functions of the Board and the members thereof, as such, and the rights and benefits of the various beneficiaries of the Police Pension Fund shall be and are hereby declared to be in accordance with the law and particularly of Article 3 of the Illinois Pension Code and all amendments thereof.
D. 
The Board shall be appointed and elected as therein provided and shall exercise such powers and perform such duties that shall be required of them by law. All monies and securities belonging to said fund shall be held by the Village Treasurer, subject to the order of the Board of Trustees of the Police Pension Fund. An annual list of beneficiaries and report of funds shall be made as required by law. Members of the Board of Trustees of the Pension Fund shall serve without compensation.

A. 
Employment. The Village of Coal City may employ part-time police officers from time to time as it deems necessary.
B. 
Duties. A part-time police officer shall have all the responsibilities of a full-time police officer and such specific duties as delineated in the General Order of the Coal City Police Department, but the number of hours a part-time officer may work within a calendar year is restricted. Part-time police officers shall not be assigned to supervise or direct full-time police officers. Part-time police officers shall be trained in accordance with the Illinois Police Training Act (50 ILCS 705/1 et seq.) and the rules and requirements of the Illinois Law Enforcement Training Standards Board (ILETSB).
C. 
Hiring standards. Any person employed as a part-time police officer must meet the following standards:
(1) 
Be of good moral character, of temperate habits, of sound health, and physically and mentally able to perform assigned duties.
(2) 
Be at least 21 years of age.
(3) 
Pass a medical examination.
(4) 
Possess a high school diploma or GED certificate.
(5) 
Possess a valid State of Illinois driver's license.
(6) 
Possess no prior felony convictions.
(7) 
Any individual who has served in the U.S. military must have been honorably discharged.
D. 
Discipline. Part-time officers shall be under the disciplinary jurisdiction of the Chief of Police. Part-time police officers serve at the discretion of the Village authorities, shall not have any property rights in said employment, and may be removed by the Village at any time. Part-time police officers shall comply with all applicable rules and General Orders issued by the Police Department.

A. 
The Village hereby prohibits any law enforcement agency operating within its jurisdiction from using excessive force against any individuals engaged in nonviolent civil rights demonstrations. In addition, the Village agrees to enforce any applicable state or local laws against physically barring entrances to or exits from a facility or location that is the subject of a nonviolent protest demonstration. The Village further pledges enforcement of this policy within its jurisdiction and encourages any individual or group who or which feels that the Village has not complied with this policy to file a complaint.
