Before any person, co-partnership, firm or corporation shall
undertake to construct, grade or alter any sidewalk, pavement, curb,
gutter or driveway apron in the Borough of East Lansdowne, he, she,
it or they shall make application for and secure from the Building
Inspector a permit for such work, who shall furnish the necessary
lines and grades; and when the work has been completed, said Building
Inspector shall endorse on said permit that the materials used and
the character of the work performed conform to the specifications
of this Part. Should the work so performed not comply with the provisions
or standards of this Part, the Building Inspector shall so stipulate
upon the permit. All permits shall be returned by the Building Inspector
to the Borough Secretary.

All permits shall be issued for a period of 90 days and shall
lapse automatically upon the passage of such period of time. Should
the proposed construction or work be incomplete at the lapse of the
ninety-day period, the person, co-partnership, firm or corporation
shall make application for and secure a second permit before continuing
with the construction.

The cost of each permit for a sidewalk, pavement, curb, gutter
or driveway shall be as established from time to time by resolution
of Borough Council. Such fee shall be remitted to the Treasurer of
the Borough by the Building Inspector. Upon receipt of the properly
executed vouchers, the Treasurer shall pay the sum established by
resolution of Council, to the Building Inspector as his remuneration
for the services performed.

The grade for sidewalks, curbs and gutters in the Borough of
East Lansdowne, is hereby established in accordance with the instructions
given to the Borough Engineer.

1. On Penn Boulevard between Baltimore Avenue and Pembroke Avenue, the
paved portion of the sidewalk shall be four feet in width. On Penn
Boulevard between Pembroke Avenue and Glenwood Avenue, and upon all
other streets of the Borough, the paved portion of the sidewalk shall
be three feet and six inches in width. The width of the sidewalk may
be extended to the curb by special permission of Borough Council at
a regular stated meeting, provided (1) that such extension shall conform
to the requirements of the Standard of Construction of Sidewalks as
provided in § 210 of this Part; and (2) that the curb to
which the sidewalk is extended must be in good condition at the time
such sidewalk is extended; and (3) should the curb need replacing,
such replacement must be completed at the time the sidewalk extension
is made.
2. All sidewalks, including sidewalk extensions, curbs, gutters and
driveway aprons installed, repaired or replaced, shall conform to
the Standards of Construction as set forth in § 210 of this
Part.

Each and every owner of land, fronting or abutting on any street,
avenue or highway in said Borough shall, within 30 days after receiving
notice so to do, grade the sidewalk fronting or abutting said land,
in accordance with the established lines and grades to be furnished
by the Borough Engineer, at the applicant's expense, and shall construct
thereon a pavement and set curbs and construct gutters fronting or
abutting said land in accordance with the provisions of this Part
and under the supervision on the Borough Building Inspector. No person,
co-partnership, firm or corporation shall hereafter lay out, construct
or build any sidewalk, curb or gutter except in compliance with the
terms of this Part, and at the grades prescribed by the Borough Engineer,
and in accordance with the specifications herein provided.

It shall be the duty of all owners of property fronting or abutting
on any street, avenue or highway within the Borough to at all times
keep the sidewalks, curbs and gutters in front of and along or upon
the premises of lots owned by them in good order and repair and free
and clear from obstructions to safe and convenient passage. In the
event such owner shall fail to repair his or her sidewalk, curb, gutter
or driveway between the curb and the property line, in front of or
abutting said land, within 10 days after receiving notice so to do,
the Borough may cause the necessary repairs to be made, and the cost
and expense thereof shall be charged against the property owner, together
with a service charge of 10%, and shall be collected in the manner
provided by § 208 of this Part.

Upon the neglect of any owner of lands to comply with the requirements
of any notice to perform the work of grading, paving or repairing
sidewalks, or the construction or repairing of curbs and gutters,
as required by this Part, the Borough may cause the necessary work
to be performed and shall collect the cost thereof, and 10% additional,
together with all charges and expenses, from the owner or owners of
the property, and shall file a municipal claim therefor or collect
the same by an action of assumpsit.

The Borough may make any emergency repairs between the curb
and the property line where, in the opinion of the officer or head
of the department or committee having charge of such work, a dangerous
condition exists, and provided that such repairs can be made for an
expenditure of not more than $25. Before the said repairs are made,
a notice shall be served upon the property owner in the manner provided
for by § 206 of this Part, requiring said owner to make
the necessary repairs within 48 hours. Upon the completion of the
work by the Borough, the cost and expense thereof, shall be a charge
against the owner of the property and shall be collected in the manner
provided for by § 208 of this Part.

1. Description. Cement concrete sidewalks shall be one-course construction,
four inches in thickness, except sidewalks constructed for the width
of driveways and alleys shall be six inches in thickness and four
feet in width, unless otherwise directed by the Highway Committee.
All sidewalks shall be graded at right angles to the curb at a rise
of 1/4 inch to the foot. The area between the curb and the sidewalk
at driveways (apron) shall be constructed of cement concrete six inches
in width at the top, eight inches in width at the bottom and 18 inches
in depth. The street face shall have a batter of two inches from the
top to the bottom of the curb and the sidewalk face shall be vertical.
The curb shall be depressed at all driveways.
2. Portland Cement. Portland Cement shall meet the requirements of the
latest specifications of the American Society for Testing and Materials
(ASTM), air-entrained cement.
3. Aggregate. Fine aggregate shall consist of natural sand, clean and
well graded, with 100% passing a 1/4 inch screen, 10% to 30% passing
a 50 mesh screen and 95% minimum retained on a 100 mesh screen. Coarse
aggregate shall be crushed stone or gravel, clean, hard durable and
uncoated, with 100% passing a one-inch creen and 95% minimum retained
on a 1/4 inch screen.
4. Water. Water shall be clean and free of all deleterious materials.
5. Proportions. Cement concrete shall have a minimum twenty-eight-day
strength of 3,500 pounds per square inch (psi) in compression. The
minimum cement factor shall be not less than six sacks per cubic yard,
and the maximum water cement ratio shall be 5.5 gallons of water per
sack of cement. The fresh concrete shall contain from 3% to 6% by
volume of entrained air.
6. Forms. Forms shall be of wood or metal, straight and free of warp,
with a depth equal to the depth of the concrete section. Wooden forms
shall be at least two inches nominal thickness, and steel forms shall
be equal in strength to the wood. Flexible strips may be used on curves.
All forms shall be rigidly held to line and grade by stakes and braces
sufficiently strong to resist the pressure of the concrete without
springing. All forms shall be cleaned thoroughly and oiled each time
they are used prior to placing concrete against them.
7. Excavation and Subgrade. Excavation shall be made to the required
depth. The subgrade shall be free draining and compacted to a firm
even surface of uniform bearing capacity.
8. Placing and Finishing. Concrete shall be placed immediately after
mixing. It shall be accurately struck-off, tamped and screened by
an approved hand method. The surface shall be given a granular finish
by use of a wooden float without the addition of cement to the surface.
All edges of the sidewalk shall be rounded to a radius of 1/4 inch.
The street face of the curb shall be rounded to a radius of not more
than 3/4 inch and the sidewalk face of the curb shall be rounded to
a radius of 1/4 inch. Curbs and sidewalks shall not be poured monolithically.
9. Joints. Sidewalks shall be constructed in separate slabs approximately
20 feet in length except for closures. These slabs shall be separated
by a premolded joint filler (1/4 inch minimum thickness, 3/4 inch
maximum thickness) for the full depth of the concrete section. Between
expansion joints the slab shall be divided into blocks, four feet
in length, by scoring transversely for a depth of at least 1/3 the
thickness of the slab. When sidewalk is constructed next to the curb,
building, or any fixed object, a premolded expansion joint shall be
placed between them for the full depth of the concrete section. Premolded
expansion joints shall also be placed across the sidewalk at the beginning
and ending of radius curbing. The curbing shall be placed in uniform
lengths or sections of 10 feet, except where shorter sections are
necessary for closures or curbs, but no section shall be less than
four feet in length. The joints between the ten-foot sections shall
be formed of two thicknesses of one-ply bituminous paper, cut neatly
to the cross section of the curb, one paper being placed on either
side of an approved steel template. Premolded expansion joints, cut
to conform with the cross section of the curb, shall be placed at
the end sections of radius curb and at intervals not exceeding 30
feet along the curb.
10. Removal of Forms. Forms shall not be removed before 24 hours after
the concrete has been placed, and any irregular surface shall be corrected
by rubbing with carborundum stone after at least 72 hours have elapsed
(curing period). After removal of the forms, minor honeycombed areas
shall be filled with mortar composed of one part cement and two parts
fine aggregate. All joints in the curb shall be opened from top to
bottom immediately after forms are removed, and the edge adjacent
to the joint shall be sharp and clean cut.
11. Curing. All concrete shall be kept moist for at least 72 hours after
finishing. Moisture retaining covers, such as burlap, cotton mats,
straw, etc., may be used. Other methods of curing shall be subject
to the approval of the Engineer.
12. Backfilling. No backfilling shall be started until after the concrete
has cured for a period of 72 hours.
13. Gutter. Concrete gutters are no longer required in the Borough. When
constructing new curbing, it will be permissible to construct the
curb in one of the following manners, depending on field conditions:
A. When existing curbing (curbing to be removed) can be cut away from
the gutter in a neat, clean line, it will be permissible to reconstruct
the curb within the face of the gutter (edge of roadway surface).
B. When existing curbing (curbing to be removed) cannot be cut away
from the gutter in a neat, clean line, it shall be necessary to remove
the gutter for a minimum distance of one foot out from the face of
the curb for the length of the curb to be reconstructed or at least
to an existing joint (at right angles to the curb) in the gutter.
After the new curbing has been constructed and cured (72 hours), the
roadway surface shall be cut in a neat, clean straight line, parallel
to the curb face, and excavated to a depth of at least eight inches.
The subbase shall then be compacted and a minimum of six inches of
3,500 psi concrete shall be placed in the excavated area. A two-inch
ID-2 bituminous wearing surface shall then be placed over the concrete
no sooner than 72 hours after the placement of the concrete. The joint
at the curb and at the street shall be sealed with a bituminous sealant.

Any person, firm or corporation who shall violate any provision
of this Part shall, upon conviction thereof, be sentenced to pay a
fine of not less than $50 and not more than $1,000 plus costs, and
in default of said fine and costs, to a term of imprisonment not to
exceed 30 days. Every day that a violation of this Part continues
shall constitute a separate offense.
