The Town Board of the Town of Lenox, County of Madison, does
hereby create a Conservation Advisory Council pursuant to § 239-x
of the General Municipal Law.
The Conservation Advisory Council, as hereby created, shall
consist of nine members, each to serve a two-year term, except during
the initial appointment, at which time five shall serve for two years,
and four for one year; thereafter, all shall be appointed to this
Council for a term of two years.

A. Applicability. This section shall apply to the appointment, terms,
functions and powers of alternate members appointed to serve on the
Conservation Advisory Council.
B. Conservation Advisory Council alternate members.
C. In the event that a Conservation Advisory Council member is absent
for any reason, an alternate member is hereby authorized to take the
place of an absent CAC member. In any instance where a voting member
of the CAC is absent, the use of an alternate member is hereby authorized
pursuant to the provisions of this chapter.
D. Definitions. As used in this section, the following terms shall have
the meanings indicated:
ALTERNATE MEMBER
An individual appointed by the Town Board who is utilized
when a regular member is unable to participate on an application or
matter before the respective board, as provided herein.
CONSERVATION ADVISORY COUNCIL
The Conservation Advisory Council of the Town of Lenox as
established by the Town Board, pursuant to the provisions of §§ 239-x
and 239-y of the General Municipal Law.

responsibilities.

E. The Town Board of the Town of Lenox hereby enacts this section to
provide a process for appointing alternate members of the Conservation
Advisory Council. These individuals would serve when members are absent
or unable to participate on an application or matter before the respective
board.
F. Alternate members of the Conservation Advisory Council shall be appointed
by the Town Board for terms of one year, with the terms to expire
on December 31 of each year.
G. The Chairperson of the Conservation Advisory Council may designate
an alternate to substitute for a member when such member is unable
to participate on an application or matter before the Board. When
so designated, the alternate member shall possess all the powers and
responsibilities of such member of the Board. Such designation shall
be entered into the minutes of the initial meeting at which the substitution
is made.
H. All provisions of state law relating to Conservation Advisory Council
member eligibility, vacancy in office, removal, compatibility of office
and service on other boards, as well as any provisions of a local
law/local ordinance relating to training, continuing education, compensation
and attendance, shall also apply to alternate members.
Supersession of Town Law.

I. This section is hereby adopted pursuant to the provisions of § 10
of the New York State Municipal Home Rule Law and § 10 of
the New York State Statute of Local Governments. It is the intent
of the Town Board, pursuant to § 10 of the New York State
Municipal Home Rule Law, to supersede the provisions of §§ 239-x
and 239-y of the General Municipal Law relating to the appointment
of members to the Town Conservation Advisory Council.
The Council as is hereby created is hereby authorized to accept
money or personal property, and real property in fee or lesser interest,
in the name of the Town of Lenox as defined and outlined in § 239-x
of the General Municipal Law.
The duties of the Council hereby created shall include the following,
which can be found more specifically outlined in § 239-x(1)
of the General Municipal Law:
A. Conduct
research into the land.
B. Coordinate
conservation activities in Lenox.
C. Print
and distribute information.
D. Keep
open space inventory and map.
E. Keep
an inventory of wetlands in Lenox and recommend uses for preserving
and using the same.
G. Perform
other duties given by the Town Board of Lenox.
