When the Village determines that a person or persons is violating any provision of this chapter, the Village shall provide said person or persons with a written notice stating the nature of the violation and providing a reasonable time for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.
Any person found to be responsible for accidentally allowing a deleterious discharge into the sewage system that causes damage to the wastewater treatment facility and/or receiving body of water shall, in addition to a fine, pay the amount to cover damage, both values to be established by the Village.
Any person, partnership, or corporation, or any officer, agent or employee thereof, who shall continue any violation beyond the aforesaid notice time limit provided shall be subject to prosecution and any other legal remedy available to the Village. Each day in which any violation is continued beyond the aforesaid notice time limit shall be deemed a separate offense.
In addition to any and all other penalties that may be imposed, any person violating any provision of this chapter shall be liable to the Village for any expense, loss, or damages, including reasonable attorney fees, incurred by the Village as a result of said violation.
Any person who violates any of the provision of this chapter or rules or regulations of the Village, connects a service pipe or discharge without first having obtained permission therefor, or violates any provisions of the Wisconsin Statutes, Wisconsin Administrative Code, or any other relevant laws, regulations, or standards that are incorporated by reference, shall upon conviction thereof be subject to the penalty in § 1-3, General penalty, of the Code of the Village of Blue Mounds.
