The term "swimming pool" as used in this Chapter shall mean and include any body of water or receptacle of water having a depth at any point greater than 2 1/2 feet and constructed, installed or maintained in or above the ground. This definition shall not include natural bodies of water or pools with a surface area of less than 250 square feet.

Every person in possession of land within the city, either as owner, purchaser under contract, lessee, tenant or licenses, upon which there is situated a swimming pool, shall at all times maintain on the lot or premises upon which said pool is located, and completely surrounding such pool lot or premises, a fence or other solid structure designed to prevent small children from wandering to such pool.

The fence or other structure required as provided in Section 17-2 shall be not less than four feet in height with no openings, other than doors or gates, except as follows:
(a) 
For a fence or other solid structure whose chief covering members are constructed in a vertical direction, there shall be no opening in a horizontal direction of more than six inches.
(b) 
For a fence or other structure whose chief members are constructed in a horizontal direction, there shall be no opening in a vertical direction of more than six inches.
(c) 
A wire fence shall be of the "armored or ornamental" type with openings in the mesh not exceeding six inches.
(d) 
There shall be not more than six inches from the bottom of the fence to the ground line.

Each fence or barrier around a swimming pool shall be equipped with gates or doors opening through such enclosure which shall contain a latching device which can only be operated from the interior side of the said fence; provided, however, that the door of any dwelling occupied by human beings and forming any part of the enclosure hereinabove mentioned need not be so equipped.

The provisions of Sections 17-2 through 17-4 shall not apply to public swimming pools for which a charge or admission fee is required to be paid for the use thereof, nor to swimming pools which are a part of and located upon the same premises as a hotel or motel during the time that the owner, operator or adult employee of such owner or operator is present at and in active charge of the premises upon which such pool is located.
