This Part 4 shall be known and may be cited as the "Jackson Township Animal Waste Ordinance."

Unless otherwise expressly stated, the following words and phrases shall be construed throughout this Part 4 to have the meanings herein indicated:
ANIMAL WASTE STORAGE FACILITY
A structure built to store manure for whatever use. Types of animal waste facilities are as follows: underground storage, in-ground storage, trench silo, earthen bank, stacking area and above-ground storage.
MANURE
The fecal and urinary defecations of livestock and poultry, often containing some spilled feed, bedding or litter.

No person shall erect or construct an animal waste storage facility without obtaining a permit from the Board of Supervisors of Jackson Township.

The permit fee shall be $5, payable at the time of the permit application.

A permit shall be issued by the Board of Supervisors of Jackson Township after a determination that the health, safety and welfare of the residents of Jackson Township will not be adversely affected by the proposed construction and operation and after receipt by the Board of Supervisors of the following:
A. 
Completed application for permit upon a form provided by Jackson Township;
B. 
The permit fee; and
C. 
Letter from the Lebanon County Conservation District stating that the applicant's animal waste storage facility design has been reviewed and approved by the Lebanon County Conservation District and that all regulations and requirements of this Part 4 have been satisfied.
2. 
Failure to meet the criteria set forth in this Part 4 shall result in disapproval of the application for a permit. In the event of such disapproval the Board of Supervisors shall give notice thereof to the applicant in writing, which shall include the specific reasons for the disapproval.

Every person installing, erecting or constructing an animal waste storage facility and the owner of the land where the animal waste storage facility is placed shall be responsible for satisfying the requirements of the following regulations:

Animal waste storage facilities shall be designed in compliance with the guidelines outlined in the publication, "Manure Management for Environmental Protection," Bureau of Water Quality Management Publication No. 43, revisions, supplements and successors thereto, of the Pennsylvania Department of Environmental Resources, copies of which are available at the Lebanon County Conservation District Office.
2. 
Animal waste storage facility designs shall be reviewed by the Lebanon County Conservation District. The applicant and the Board of Supervisors of Jackson Township shall receive, by letter, design approval from the Lebanon County Conservation District prior to permit issuance.
3. 
Construction and subsequent operation of the animal waste storage facility shall be in accordance with permit and the approved design. The Lebanon County Conservation District must be notified the day construction begins for proper supervision of construction. Any design changes during construction or subsequent operation must be approved in writing by the Lebanon County Conservation District.

The Board of Supervisors of Jackson Township shall adopt by resolution the application form to be used by applicants for permits hereunder.

Any person who violates the provisions of this Part 4 shall be informed of such violation by a written Cease and Desist Order from the Board of Supervisors of Jackson Township, ordering the violator thereof to cease and desist such violations within 24 hours.

Any person, firm or corporation who shall continue to violate the provisions of this Part beyond the 24 hours after receipt of a cease and desist order pursuant to § 13-408, above, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

In addition to or in lieu of the penalties provided in § 13-309, continued violations of this Part 3 may be abated by Jackson Township proceeding against the violator in a court of equity to obtain injunctive relief.
