The grading, construction and repair of all sidewalks, curbs and driveway entrances in the Township of Jackson shall be done in conformity with the following specifications, regulations and provisions.

ENGINEER
The Engineer of the Township of Jackson.
SECRETARY
The Secretary of the Board of Supervisors of the Township of Jackson.
STREETS
Includes street, avenue, boulevard, road, highway, freeway, parkway, lane, alley, viaduct, and any other ways used or intended to be used by vehicular traffic or pedestrians, whether public or private. Included is the land between the street right-of-way lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, sidewalks, division strips, or other areas within the street lines. Streets shall be classified as follows:
CUL-DE-SAC — A street intersecting another street at one end and terminating at the other in a vehicular turnaround.
LIMITED-ACCESS HIGHWAY (FREEWAY) — A strip of public land devoted to movement of traffic, not providing access to the abutting properties.
LOCAL STREET — A street used primarily to provide access to abutting properties.
MAJOR STREET, ARTERIAL or THOROUGHFARE — A street serving large volumes (4,000 vehicles per day and up) of comparatively high-speed traffic, including those facilities classified as Class 1 and Class 2 highways by the Pennsylvania Department of Highways.
PARKWAY — A roadway running through a strip of public parkland, to which right of access may or may not be permitted.
SECONDARY OR COLLECTOR STREET — A street which, in addition to providing access to abutting properties, intercepts minor streets to provide routes and give access to commercial facilities. "Collector" or "local" streets in industrial and commercial subdivisions would generally be considered collector streets.

The grade to which every curb, sidewalk or driveway entrance shall be hereafter graded, constructed or repaired shall be that fixed and designated by the Engineer. The width of the paved portion of the sidewalk shall be four feet in all new developments or street construction. In already built up sections of the Township, existing conditions shall be taken into account by the Engineer in applying these regulations and in allowing any variance therefrom.

Finished sidewalks and curbs shall have a grade from the inner edge of the sidewalk to the outer edge of the curbs of 1/4 inch to the foot.

All work done hereunder shall be inspected by the Township Engineer or, if the Township Engineer is not available, by any of the Supervisors or someone designated by them.

It shall be the duty of the owners of the land abutting upon any curbs, gutters, sidewalks or driveway entrances to keep them in such repair and condition that they may not be or become dangerous to the welfare and safety of the traveling public. Any curbs, gutters, sidewalks or driveway entrances deemed by the Supervisors to be dangerous as aforesaid, and any curbs, gutters, sidewalks, or driveway entrances not graded, constructed or repaired in accordance with the provisions of this Part 2 or not conforming with the established Township grades and lines, are hereby declared to be nuisances and must be graded, reconstructed and/or repaired according to the provisions of this Part 2. The Township Supervisors are hereby empowered to notify property owners when curbs, gutters, sidewalks or driveway entrances constitute a nuisance as aforesaid, and grading, reconstruction and/or repairs shall be made by the abutting property owners within 60 days after the receipt of said notice; and upon failure so to do, the Township Supervisors are hereby empowered to undertake such grading, construction and/or repair, the cost of such improvement to be paid for as provided hereinafter in § 21-215.

No open gutters for conducting rainwater or drainage of any kind will be permitted in the sidewalks or curbs.

1. 
No person or persons, firm or corporation shall construct or repair any sidewalk, curb or driveway entrance without first applying for and obtaining from the Township Office a permit for the same. The application for such permit shall set forth:
A. 
The full name and address of the owners of the land affected;
B. 
The name and address of the contractor or the person to perform the work;
C. 
The precise location of the property upon which the work is to be done;
D. 
The nature and length of the proposed project; and
E. 
Such other and pertinent information as may be considered necessary by The Township Engineer.
2. 
A permit shall be effective for a period of 90 days from the date of issuance and may, prior to expiration, be renewed by the Township Engineer for a period of 90 days without additional charge.

The cost of obtaining a permit to repair curbs, sidewalks or driveway entrances or a combination thereof shall be the sum of $2 or 1% of the cost of the project, whichever is greatest, provided that, in all cases of new construction of any curb, sidewalk or driveway entrance, or combination thereof, or of reconstruction of any curb or sidewalk in excess of 10 feet in length, and in case of any other type of improvement when requested by the applicant or when deemed necessary by the Supervisors, the Engineer shall furnish the applicant with necessary lines and/or grades, the cost of which shall be paid for by the applicant by depositing $20; and any difference in cost above or below the amount of deposit shall be paid by or returned to the applicant at the time of issuance of the permit.

1. 
All curbs, sidewalks and driveway entrances within street, road or alley areas shall be constructed of ready-mixed concrete with a minimum ultimate compressive strength of 3,000 p.s.i. at 28 days; or if mixed on the site, the proportions by dry volume shall be one part approved Portland cement, 2 1/4 parts clean, sharp sand, 3 1/4 parts clean limestone or trap rock with not more than 6 1/2 gallons of water to one bag of cement. All concrete shall be thoroughly compacted by suitable means during the operation of placing and shall be thoroughly worked in the corners of the forms. Exposed concrete surfaces shall be true and even, free from open or rough areas, depressions or projections. The finish shall be of steel or wood float type. No patching will be permitted. Forms shall be of wood or metal and constructed of materials sufficient in strength to hold the concrete without deforming. Forms shall be used at grade points in all cases.
2. 
Curbs constructed separately shall be made to the following specifications. The curb shall have a depth of not less than 24 inches and shall be constructed on a well-tamped four-inch broken stone base (slag may be substituted for the broken stone), and said curb shall be eight inches thick at the top, nine inches thick at the gutter line and nine inches thick at the bottom. The height of the curb above the gutter line shall be seven inches.
3. 
In place of straight curb construction, the Township Supervisors shall have the authority, upon recommendation of the Township Engineer, to issue a special permit for the construction of roll curb. The roll curb shall be constructed as specified by the Township Engineer by the use of twenty-four-inch-wide curb or twelve-inch-wide roll curb with No. 4 reinforcing as shown on file in the Township Office.
4. 
Sidewalks shall be not less than five inches in thickness and shall rest on a compact bed of broken stone or slag or cinders of a depth of at least four inches.
5. 
In cold weather, adequate equipment shall be provided for heating the concrete materials and protecting the concrete during freezing or near freezing weather. All concrete materials and all forms, fillers and ground with which the concrete is to come in contact shall be free from frost. No frozen materials or materials containing ice shall be used.
6. 
Sidewalks and curbs shall have clean-cut joints every five linear feet or less of work.
7. 
The radii of corners at street intersections shall not be less than the distance between the outside face of the curbing and the right-of-way line. The radii of corners at intersecting alleys of a width of more than 15 feet shall be six feet, unless the Engineer authorized conformance to existing conditions.
8. 
Driveway entrances over sidewalk areas shall be at least eight inches thick and 12 feet wide for a single driveway and 16 feet wide for a double driveway. The curbing shall be eight inches thick and 24 inches in depth. Driveway and curbing are to be constructed on a well-tamped four-inch-thick base of broken stone or slag.
9. 
In place of the curb radii at driveway entrances as described in Subsection 8, depressed curbing may be used and constructed as shown on the plan on file in the Township Office.

The cost and expense of any type of improvement mentioned hereinbefore shall be paid for by the developer or the owners of the real estate abutting the street or highway or part thereof whereon such improvement is made; and in the event that the Township makes the improvement, the cost and expense thereof may be collected from the developer or the owners of the real estate abutting on such street or highway or part thereof in proportion to the frontage or by an equal assessment on the front feet. Such proportionate cost and expense or assessment shall be estimated by the Engineer or, if there be no engineer, by other competent authority designated by the Supervisors. The Supervisors may collect said cost and expense or assessment in the manner provided by law.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a District Justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.
