The Shade Tree Commission of the Borough of Folsom is hereby
established. The Commission shall consist of five members, appointed
by the Mayor, who shall be residents of the Borough and who shall
serve without compensation.
The first Commissioners shall be appointed by the Mayor within
60 days after the effective date of this chapter, and their terms
of office shall commence upon the day of their appointment and be
for the respective periods of one, two, three, four and five years,
beginning on January 1 of the year following such appointment. All
subsequent appointments, except to fill vacancies, shall be for the
full term of five years, to take effect on January 1. In addition,
two alternate members may also be appointed and shall be designated
at the time of appointment as "Alternate No. 1" and "Alternate No.
2" and shall serve during the absence or disqualification of any regular
member or members. The term of each alternate member shall also be
five years. The terms of the first alternate members appointed shall
commence on the date of their appointment and shall expire on the
fourth or fifth December 31 next ensuing after the date of their appointment,
as the case may be. An alternate member may participate in discussions,
but may not vote except in the absence or disqualification of a regular
member. The vote shall not be delayed in order that a regular member
may vote instead of an alternate member.
The Commission shall organize within 30 days after the appointment
of its membership and thereafter annually by the election of one of
its members as Chairman, and the appointment of a Secretary, who need
not be a member. The salary of the Secretary shall be fixed by the
Mayor and Council.
Any vacancy occurring by reason of the death, resignation or
removal of any Commissioner shall be filled for the unexpired term
by the Mayor.
The Commission shall have the following powers:
A. To prepare programs and plans for consideration by the Mayor and
Council with respect to the purchase, planting, care, rearing, trimming,
preserving, and control of the shade and ornamental trees in the Borough.
B. To meet with the Mayor and Council upon its request for discussion
of programs and recommendations.
C. To consult regularly with the Mayor and Council concerning the Shade
Tree Program of the Borough.
D. To encourage arboriculture.
E. To prepare acceptance by the Mayor and Council a community forestry
program.
F. Such duties and responsibilities in accordance with N.J.S.A. 40:64-1
et seq. which are delegated to it by the Mayor and Council.
