A. Snow emergency
parking.
(1) General
restrictions. No owner, person, firm, partnership or corporation nor
any officer, member, agent, servant, employee of any firm, partnership
or corporation or operator of any vehicle or any device in, upon or
by which any person or property is or may be transported or drawn
upon a public highway to park, stop, leave standing, or suffer any
such vehicle or device at the curb, shoulder, or edge of any highway
area, roadway or fire lane or part thereof in the Village of Richfield
designated as an emergency thoroughfare, during a driving snowstorm
or immediately thereafter until the entire thoroughfare has been cleared
of snow.
(2) Definitions.
As used in this section, the following terms shall have the meanings
indicated:
EMERGENCY THOROUGHFARE
Any street, roadway, highway area, alley or fire lane or
part thereof which may be used by an emergency vehicle.
EMERGENCY VEHICLES
Include police squad cars, fire-fighting apparatus, ambulances,
rescue squad cars, snow equipment and machinery, and any other emergency
vehicles.
SNOWSTORM
A driving snowstorm accompanied by moderate to heavy snow
falling at a minimum rate of one inch per hour and accumulating to
at least four inches or more, which is accompanied by a strong wind
in excess of 25 miles per hour, or driving snow in such a manner as
to produce a congestion of traffic or impede the operation of emergency
vehicles.
(3) Declaration
of emergency. It shall be the duty of the Village Administrator or
Public Works Supervisor to declare a state of public emergency and
the duration thereof and designate emergency thoroughfares by public
proclamation after first giving notice thereof to the Washington County
Police Department or Village law enforcement officer and Fire Department.
The proclamation may be made through the medium of radio, television,
placards, or other public means of communication.
(4) Removal
of vehicles. The Public Works Supervisor or any of his/her employees
under his/her supervision and direction may remove or may contract
for such removal with any garage man, service man, person, firm or
corporation any vehicle which creates an emergency situation by interfering
with the operation of any snow-removal equipment or any other emergency
vehicle after first attempting to give notice to the owner of said
vehicle that the same must be removed. The Supervisor may charge the
cost of removing such vehicle to the owner or the operator of the
vehicle.
B. During snow removal and snow emergencies. No person shall park, place
or leave standing any automobile, truck or other vehicle on any street
or public way after one hour from the time such area has been designated
and marked with signs or barriers by an agent of the Village indicating
no parking.
C. Street maintenance. Whenever it is necessary to clear or repair a
Village roadway or any part thereof, the Public Works Department shall
post such highways or parts thereof with signs bearing the words "No
Parking." Such signs shall be erected at least one hour prior to the
time that street maintenance work is to be commenced. No person shall
park a motor vehicle in violation of such signs.
D. Parking in driveways. No person shall park or leave standing any
motor vehicle in any private driveway without the permission of the
owner or lessee of the property upon which such driveway is located,
whether or not such driveway is posted to limit or restrict parking.
E. Parking vehicles with motor running. No person shall park or leave
standing any motor vehicle with the motor or refrigerator unit running
for more than five minutes within 300 feet of any residence within
the Village between the hours of 10:00 p.m. and 7:00 a.m.
F. Temporary no parking. When deemed necessary for special events or
in the interest of public safety, the Village Administrator or designee
may order the posting of no parking signs. Such no parking signs shall
be removed the day following the special event or when the Administrator
or designee determines that the interest of public safety is no longer
served.
G. Seasonal no parking. When signs have been erected at or reasonably
near the Village borders, as provided in § 349.13, Wis.
Stats., no person shall park any vehicle on any Village road or municipally
owned parking lot between the hours of 2:00 a.m. and 6:00 a.m. on
any day between November 1 and April 15 of the following year, except
physicians on emergency calls.
H. General loading zones. No person shall park, stop or leave standing
any vehicle for a time exceeding 15 minutes, whether attended or unattended,
except while loading or unloading passengers, material or merchandise
from such vehicle on the following streets or parts thereof:
(1) The north side of Hubertus Road, adjacent to 3718 Hubertus Road,
beginning 227 feet west of the center line of the intersection of
Scenic Road and Hubertus Road and ending 56 feet west of the point
of beginning.
(2) The south side of Hubertus Road, adjacent to 3723 Hubertus Road,
beginning 175 feet west of the center line of the intersection of
Scenic Road and Hubertus Road and ending 43 feet west of the point
of beginning.
No person shall park or leave standing any motor vehicle weighing
10,000 pounds or more or any semitrailer on any Village road or street
between sundown and sunup.
Any vehicle parked or left standing upon a highway, street or alley or other public grounds in violation of any of the provisions of this article or §
351-1 is declared to be a hazard to traffic and public safety. Such vehicle shall be removed by the operator, upon request of any law enforcement officer, to a position where parking, stopping, or standing is not prohibited. Any law enforcement officer, after issuing a citation for illegal parking, stopping, or standing of an unattended vehicle in violation of this article, is authorized to remove such vehicle to a position where parking is not prohibited. The officer may order a motor carrier holding a permit to perform vehicle towing services, a licensed motor vehicle salvage dealer or a licensed motor vehicle dealer who performs vehicle towing services to remove and store such vehicle in any storage garage or rental parking grounds or any facility of the person providing the Village services. In addition to other penalties provided by §
351-2, the owner or operator of a vehicle so removed shall pay the cost of towing and storage.
When any vehicle is found upon a street or highway in violation
of any provision of this article regulating the stopping, standing
or parking of vehicles and the identity of the operator cannot be
determined, the owner, as shown by the ownership of registration of
the vehicle supplied by the State Department of Transportation or
a comparable authority of any other state, shall be subject to the
appropriate penalty.
No person other than the owner or operator thereof shall remove
a Village parking ticket from a motor vehicle.
