The PLUAC shall be organized as follows:
A. Said
advisory council shall be named the "Otero County Public Land Use
Advisory Council (PLUAC)."
B. The
PLUAC shall be comprised of a board of nine members appointed by the
Board of Otero County Commissioners.
C. Members
of the PLUAC shall serve as follows: Beginning with January of 1996,
when the appointment of its members next occurs, four members shall
be appointed for the term of one year. The other five members shall
be appointed for the term of two years. Thereafter, subsequent appointments
made pursuant to this subsection shall be for two-year terms for all
appointees.
D. The
PLUAC shall conduct its business under Robert's Rules of Order
and in accordance with the Open Meetings Act (NMSA 1978, § 10-15-1).
E. The
PLUAC shall have a mission of fact finding in nature relevant to the
natural resources within Otero County and all matters relating thereto
and shall make reports/recommendations to the Board of County Commissioners
from time to time.
F. The
PLUAC, through its Chairman and members, shall establish various subcommittees
as are deemed necessary by its members to accomplish its fact finding
mission.
G. The
subcommittees established shall consist of no more than three members
of the PLUAC and shall consist of a minimum of three, but no more
than six, individuals from the Otero County citizenry at large.
H. The
members of the citizenry at large who shall serve on the subcommittees
shall be residents of Otero County.
I. The
PLUAC shall be provided a meeting place with adequate equipment to
make an electronic and/or stenographic record of its proceedings.
J. The
PLUAC shall coordinate with the County Clerk and legal counsel from
either the County or an independent source.
K. The
PLUAC shall have an initial budget as the Board of County Commissioners
shall deem necessary, to enable remuneration of out-of-pocket expenses
and/or per diem for travel and the conduct of business.
The PLUAC will develop a proposed land management system which
will acknowledge and protect the split estate of individual property
rights which exist on the public lands. These individual rights include,
but are not limited to, recreation, hunting, fishing, wildlife watching,
water, fuelwood harvesting, timber harvesting, mining, and grazing.
Subject to approval, oversight, and appeal to the County Commission,
the PLUAC should have the power to determine user fees; determine
land uses; negotiate contracts for uses; hear appeals on disputes
between the competing claims; hear appeals of all issues related to
the use, operation, and management of the lands; oversee management
by County employees; enact and enforce rules related to land uses;
advise the County Commission on all issues related to public lands;
and make decisions related to the intergovernmental relations bearing
on public lands.
