There is hereby created an Otero County Planning Commission
to be composed of seven members who shall be residents of Otero County.

A. The Otero County Planning Commission shall have such authority as
necessary and proper in reviewing subdivision applications and sustainable
development test site applications to carry out and promote Otero
County planning as set forth by the Board of County Commissioners.
The Otero County Planning Commission shall recommend to the Board
of County Commissioners programs and planning strategies with the
general purpose of guiding and accomplishing a coordinated, adjusted
and harmonious development of Otero County which will, in accordance
with existing and future needs, best promote health, safety, welfare,
order, convenience, prosperity, efficiency and economic development
as those needs are determined by the Board of County Commissioners.
B. The Otero County Planning Commission shall have the authority to
call before it any and all elected officials, department heads, officers
and employees of Otero County, who shall, at the reasonable request
of the Planning Commission, furnish such data, information and reports
as the Otero County Planning Commission may reasonably request.
C. The Otero County Planning Commission shall have the power to recommend
all subdivision applications and sustainable development test site
applications for approval by the Board of County Commissioners. The
Otero County Planning Commission shall have the authority to recommend
denial of subdivision applications and sustainable development test
site applications by the Board of County Commissioners. The Otero
County Planning Commission shall have the authority to approve summary
review subdivisions.
D. Appeals from the Otero County Planning Commission shall be determined
through the Planning Commission’s rules and regulations as set
forth below.
E. The Otero County Planning Commission shall have such other powers,
authority and jurisdiction as may be from time to time delegated to
said Planning Commission by resolution of the Board of County Commissioners.
The Board of County Commissioners of Otero County, due to the
heavy work load of the Otero County Planning Commission and the resignation
of several members of the Planning Commission creating a severe burden
on the remaining members of the Planning Commission which directly
effects the health, safety and welfare of the citizens of Otero County,
do hereby declare an emergency pursuant to NMSA 1978, § 4-37-7,
and, accordingly, declare that this article shall take effect immediately.
