The authority of the municipality to adopt ordinances concerning traffic and parking is contained in N.J.S.A. 39:4-197. Various statutory provisions throughout Title 39 control the manner in which municipalities may regulate parking and traffic. N.J.S.A. 39:4-8 sets forth the requirements for approval of such ordinances.

a. 
Words and Phrases Defined. Words and phrases used in this chapter shall have the meanings given to them in N.J.S.A. 39:1-1.
b. 
Official Time Standard. Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time, as may be in current use in the Borough.
10-2.1. 
Declaration of Emergency. The Chief of Police or, in his/her absence, the ranking officer of the Police Department, is authorized to declare an emergency and direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires, public celebrations and similar occurrences require the avoidance of conditions which are hazardous or which interfere with the free flow of traffic.
10-2.2. 
Parking Prohibited. Upon the declaration of an emergency, there shall be no parking upon streets or parts of streets where EMERGENCY NO PARKING signs are displayed.
10-2.3. 
Parking during snow emergencies.
a. 
Notwithstanding the provisions of Subsections 10-2.1 and 10-2.2, whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicle shall be parked upon the following streets or highways or portions thereof as follows:
1. 
Jefferson Street on the east side in its entirety.
2. 
Division Avenue on the north side in its entirety.
3. 
Summit Avenue on the north side in its entirety.
4. 
Seventh Street on the east side in its entirety.
5. 
Garden Street on the east side in its entirety.
6. 
Patricia Court on both sides in its entirety.
b. 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
10-2.4. 
Notice. Notifications that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
10-2.5. 
Removal of Vehicles. Any unoccupied vehicle parked or standing in violation of this section is declared to be a nuisance, an obstruction to the flow of traffic and a danger to other vehicles using the highway. Any police officer may remove such vehicle or cause it to be removed.
10-2.6. 
Removal and Storage Charges. The owner shall pay all expenses incurred in removing or storing the vehicle before regaining possession of it. Removal and storage charges shall be in addition to any penalty imposed for violation of this section.
10-2.7. 
Signs. The effectiveness of this section is contingent upon signs being erected as provided by law.
10-3.1. 
Regulations Not Exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles contained in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
10-3.2. 
Parking Prohibited at all Times on Certain Streets. No person shall park a vehicle at any time upon any of the streets or parts of streets described in Schedule I attached to and made a part of this chapter.
10-3.3. 
Parking Prohibited during Certain Hours of Certain Days on Certain Streets.
a. 
No person shall park a vehicle between the hours specified of the days specified upon any of the streets or parts of streets described in Schedule II attached to and made a part of this chapter.
b. 
Appropriate signs shall be posted displaying the prohibited parking.
c. 
The penalty for violation of this subsection shall call for a fine of $15 for each offense.
10-3.4. 
Two Hour Parking. No person shall park a vehicle for longer than two hours at any time between the hours of 8:00 a.m. and 5:00 p.m., or as otherwise indicated in Schedule V, on any day, except Sunday and public holidays, upon any of the streets or portions of streets described in Schedule V attached to a made a part of this chapter.
10-3.5. 
One Hour Parking. No person shall park a vehicle for longer than one hour at any time on any day, except Sunday and public holidays, upon any of the streets or portions of streets described in Schedule IV attached to and made a part of this chapter.
10-3.6. 
Prohibited Overnight Parking. It shall be unlawful for any person to park the following described vehicles upon any of the streets of the Borough between the hours of 11:00 p.m. and 6:00 a.m., prevailing time, on any day:
a. 
Any commercial vehicle having a gross weight of 7,200 pounds or more and/or a maximum length of 19 feet, including vans registered with commercial plates, vans for commercial purposes, contracting equipment, vehicles registered as livery vehicles, taxis or any other business intended for the transportation of passengers for a fee, Borough emergency vehicles excluded.
b. 
All recreational vehicles having a gross weight of 5,200 pounds and/or a maximum length of 15 feet, including, but not limited to, motor homes, ATV (all-terrain vehicles), campers, boat trailers, utility trailers, landscaping trailers or any other type trailer requiring a New Jersey Department of Motor Vehicle registration plate, whether such registration plates are considered under Department of Motor Vehicle regulations to be commercial plates or private plates.
c. 
Any vehicles having more than four wheels exclusive of a spare wheel intended to be used as a spare tire.
d. 
Any attached trailer or unattached trailer regardless of the status of the registration of the vehicle so attached.
e. 
No vehicle herein described as being prohibited to park on any street within the Borough between the hours of 11:00 p.m. and 6:00 a.m. shall be issued a resident only parking permit as provided for in Subsection 10-3.11.
The provisions of this subsection are not intended to prohibit vehicles parking on any street within the Borough between the hours of 11:00 p.m. and 6:00 a.m. that are registered as private passenger vehicle but not limited, and used for, personal transportation only, including vehicles commonly referred to as SUVs (sport utility vehicles), family vans, rear open-bed pickups and utility vans.
The owner of any vehicle described herein who shall violate or fail to comply with any of the provisions of this subsection, upon conviction thereof, shall be assessed a fine of $50 for each such violation.
10-3.7. 
Fifteen Minute Parking. No person shall park a vehicles for longer than 15 minutes at any time upon any of the streets or portions of streets described in Schedule III attached to and made a part of this chapter.
10-3.8. 
No Stopping or Standing on Certain Streets. No person shall stop or stand a vehicle upon any of the streets or parts of streets described in Schedule VI attached to and made a part of this chapter; nor shall any person stop or stand a vehicle within a legally established and marked fire zone located within any quasi-public area within the Borough.
10-3.9. 
Restricted Parking.
a. 
General. It shall be unlawful for any person to park a vehicle on any areas or streets or parts of streets reserved for designated vehicles as set forth in Schedule VII attached to and made a part of this chapter. Vehicles permitted to park will be properly identified.
b. 
Ambulance Corps Parking at Carlstadt Civic Center.
1. 
Purpose. The purpose of this paragraph is to provide designated parking spaces at the Carlstadt Civic Center for the exclusive use of the active members of the Carlstadt Volunteer Ambulance Corps to facilitate the members' ability to quickly respond to calls for assistance by providing such members with ready access to parking.
2. 
Designation of Spaces. Five permanent parking spaces shall be designated for the exclusive use of the Carlstadt Volunteer Ambulance Corps, as set forth in Schedule VII attached to and made a part of this chapter.
3. 
Identification of Spaces. Each of the parking spaces designated in Schedule VII shall be identified with a clearly visible sign displaying the following language:
RESERVED PARKING
AMBULANCE CORPS ONLY
Violators Will Be Towed
4. 
Removal of Vehicles. Any unoccupied vehicle parked or standing in violation of this section may be removed from the designated parking area by towing or other method, at the expense of the owner, who shall be responsible for payment of the cost of removal and storage of such vehicle.
5. 
Violations and Penalty. Every person violating any provision of this section shall be subject to a fine of not more than $50 or imprisonment for a term not exceeding 15 days, or both.
c. 
Senior Parking at Carlstadt Civic Center. All parking spaces, except those specifically reserved for members of the Ambulance Corps in Paragraph b above, shall be used exclusively by individuals authorized to use the Civic Center facility between the hours of 6:00 a.m. and 11:00 p.m. daily and to be used only by members of the Carlstadt Senior Clubs attending meetings in the Civic Center on Wednesdays between 9:00 a.m. and 6:00 p.m.
d. 
Parking Prohibited; Snow. Parking in the Ambulance Corps/Civic Center lot shall be strictly prohibited during any snow event and for a period of 24 hours after the lot has been cleared following any snow event. All vehicles parked in the lot that are not excepted under Paragraph b above shall be ticketed and towed at the expense of the owner.
10-3.10. 
Handicapped Parking.
a. 
Restricted Use. Pursuant to N.J.S.A. 40:48-2.46, which confers upon the Borough the right to establish handicapped parking spaces in order to preserve and safeguard the public health, safety, morals and welfare, certain areas are hereby established within the Borough which are private property and open to the public and which shall be designated as handicapped parking spaces.
Such areas shall be used by persons who have been issued special identification cards by the Division of Motor Vehicles in accordance with N.J.S.A. 39:4-205. No other person shall be permitted to park in these spaces described in Schedule VIII attached to and made a part of this chapter. Such spaces shall be marked by signs indicating that they are handicapped parking spaces in conformance with the manual on Uniform Traffic Control Devices for Streets and Highways, adopted March 20, 1973 and filed with the New Jersey State Department on March 21, 1973.
b. 
Spaces Required. The following areas shall have designated handicapped parking spaces for use by persons who have been issued special identification cards by the Division of Motor Vehicles. No other person shall be permitted to park in these spaces. Each space or group of spaces shall be identified with a clearly visible sign displaying the international symbol of access along with the following wording: "These Spaces Reserved for Physically Handicapped Drivers. Penalty $100 fine up to 90 days community service for violation." For vertical parking, each space shall be 12 feet wide to allow room for persons in wheelchairs or on braces or crutches to get in and out of either side of an automobile onto a level, paved surface suitable for wheeling and walking. The designated areas are as follows:
1. 
All public buildings and recreational areas in the Borough whether owned, rented or occupied by a governmental agency, board or commission.
2. 
All stores, whether retail or wholesale, no matter how described, which are either open to the public or to which the public is invited, and which provide off-street parking for at least 10 vehicles.
3. 
All banks and any other type of business or activity, no matter how described, which is either open to the public or to which the public is invited, and which provide off-street parking for at least 10 vehicles.
c. 
Penalty. Any person that shall be found guilty of a violation of this provision shall be subject to a fine not to exceed $250 upon the first offense and a fine of at least $250 and up to 90 days' community service on such terms and in such form as the court deems appropriate, or any combination thereof, for subsequent offenses.
10-3.11. 
Permit Parking.
a. 
In Front of Private Driveways.
1. 
When Permitted. The parking of motor vehicles may be permitted in front of private driveways whenever both the motor vehicle and driveway involved are owned by the same person and whenever the owner of the private driveway and the motor vehicle would otherwise have qualified for a handicapped parking space and such space is not available or whenever a member of the same household or a tenant of the owner is authorized by the owner to park in front of the private driveway; and where such parking is not otherwise prohibited and the permitted thereof would not interfere with the normal flow of traffic.
2. 
Permits. The Borough, through its designated agent(s), shall provide for the issuance of permits which authorize the parking of motor vehicles in front of private driveways and identify the location of the driveway in front of which the parking of a motor vehicle is permitted. The permit shall be issued to the owner of a private driveway and/or to a member of the same household or a tenant of the owner of a private driveway, provided that a completed application for a permit has been filed so identifying the entitled permit holder.
3. 
Eligibility; Limit; Display. An owner of a private driveway shall be eligible to apply for one permit for his/her own motor vehicle or for a member of the household or a tenant therein authorized by the owner to park in front of the private driveway. In the event the owner of the private driveway does not own a motor vehicle, a member of the owner's household or a tenant who owns a motor vehicle may be eligible to apply for a permit issued under this subsection. In no event shall there be more than one permit issued per private driveway. The permit shall be 5 1/2 inches by 8 1/2 inches in size, shall bear an appropriate certification of authenticity and shall be displayed prominently within the vehicle when it is parked so as to be seen from the middle of the street.
4. 
Fee; Renewal. The fee for each permit shall be as set forth in Subsection 4-8.2 of this revision and shall be valid for one year from the date of issuance. Each permit may be renewed, on an annual basis for a fee as set forth in Subsection 4-8.2 of this revision.
5. 
Restrictions. A motor vehicle shall not be permitted to be parked in front of a private driveway unless the owner of the private driveway or a member of the owner's household or a tenant has been issued a valid permit and the permit is property displayed.
b. 
Overnight Parking.
1. 
Restrictions. No person shall park or cause to be parked any vehicle of any kind between the hours of 2:00 a.m. and 9:00 a.m., prevailing time, except as specifically provided in Paragraph 3, below, upon any of the streets or portions of streets described in Schedule XVII attached to and made a part of this chapter.
2. 
Permit Required. Overnight parking between the hours of 2:00 a.m. and 9:00 a.m.,[1] prevailing time, shall be permitted to persons who have obtained a proper permit as provided herein from the Borough.

3. 
Qualifications for Permit. Parking permits shall be issued to an applicant who qualifies under any one of the following standards:
(a) 
Residents or occupant of a legal single-family or a legal two- family detached dwelling property abutting a street, avenue or road notwithstanding limitations set forth in Subsection 21-6.4, Off-Street Parking.
(b) 
Residents or occupant of legal multi-family dwellings abutting a street, avenue or road notwithstanding limitations set forth in Subsection 21-6.4, Off-Street Parking.
(c) 
Business permits. Nonresident business owners and employees of legal business entities abutting a street, avenue or road and caretakers providing services at residential dwellings abutting a street, avenue or road shall be issued a limited permit for parking between 6:00 a.m. and 9:00 a.m. only. Overnight parking by nonresidents is prohibited.
4. 
Permit Applications and Authority to Issue; Temporary Guest Passes; Business Permits.
(a) 
Application and Issuing Authority. Applications for permits shall be available at the office of the Zoning Code Official. Upon completion of such application, the Zoning Code Official shall verify all information by way of an on-site inspection or by any other means available regarding the applicant's qualifications as prescribed in Paragraph 1, above.
(b) 
Temporary Guest Pass. Each resident or occupant residing in an area designated in Schedule XVII may make application at the office of the Zoning Code Official for a temporary guest pass. Applications for a temporary guest pass for overnight parking shall be reviewed and permits issued on a case by case basis by the Zoning Code Official. Each temporary guest permit issued shall indicate the license plate of the vehicle and the days for which it is valid. The recipient shall place the permit in a conspicuous area of the vehicle to which it applies so that the same is clearly visible through the front window driver's side of vehicle.
(c) 
Business Permits.
(1) 
Any owner, lessee or employee of a business or caretaker providing service to a resident in the Borough of Carlstadt who is a nonresident shall be entitled to a business parking permit for nonresidents upon completion of an application and proof of business activity, employment or caretaker services at such location being submitted to the Zoning Official, together with a copy of the individuals driver's license and vehicle registration.
(2) 
Proof of business ownership may be established by providing a copy of a document bearing the name of the business and the street address. Proof of employment may be established with a copy of a pay stub, letter from employer on the business letterhead or similar document. Caretakers may provide information detailing the necessity of their service by letter directed to the Zoning Official.
(3) 
Current employment status will be verified with the employer prior to issuance of a business permit to any employee applicant.
(4) 
Business parking permits shall be effective during the limited hours of 6:00 a.m. and 9:00 a.m. only. Nonresident overnight parking is otherwise prohibited.
(5) 
Carlstadt business establishments shall be deemed to include the Borough of Carlstadt and the Board of Education of the Borough of Carlstadt.
(6) 
The Police Department and Code Enforcement Officers of the Borough of Carlstadt shall be entitled to obtain periodic verification of all relevant information and shall have the power to invalidate any business permit issued pursuant to this section if the information indicates nonentitlement to the business permit.
5. 
Restrictions. No vehicle as described in Subsection 10-3.7 shall be issued a resident only parking permit.
6. 
Fee. There shall be no cost or fee assessed for the initial issuance of a parking permit or for a renewal of a parking permit required as a result of a change in the vehicle identified in the original permit or change of address of the owner of a vehicle to another area designated in Schedule XVII.
7. 
Posting and Design of Permit.
(a) 
The parking permit shall be of a design and manufacture which will enable the permit to be posted conspicuously on the interior of the rear driver side window of the vehicle. The parking permit shall be placed beside the left drive door for Jeeps. Placement of the permit contrary to the aforesaid will cause the permit to be invalid.
(b) 
Business permits shall be of a design and manufacture which will enable the permit to be placed conspicuously on the interior rear view mirror facing out through the front windshield of the vehicle.
8. 
Responsibility for Enforcement; Exemptions.
(a) 
Enforcement. Enforcement shall be the responsibility of the Police Department.
(b) 
Exemptions.
(1) 
Exemption shall be granted to vehicles belonging to residents of the Borough displaying emergency services license plates, displaying handicapped license plates or placards while parked in a legally marked handicapped parking space, vehicles owned by the Borough, vehicles owned by volunteers or employees of the police or fire departments or ambulance corps.
(2) 
Temporary exemption shall be granted by the Police Department on a day to day basis to visitors and/or guests of residents affected by these restrictions upon proper notification to the Police Department of all information required by the department.
9. 
Penalty. The fine for violation of this subsection shall be $25.
10-3.12. 
Parking for Official Borough Vehicles.
a. 
Purpose. The purpose of this section is to facilitate the designation of the location of parking spaces for official Borough vehicles by the Mayor and Council, as deemed necessary and appropriate, on an annual basis.
b. 
Designation of Permissible Parking Spaces. The Mayor and Council, when necessary, shall designate by resolution the location of permissible parking spaces for the Fire Chief vehicle, K-9 vehicle and any other Borough vehicle the Mayor and Council deem necessary and appropriate. These designated parking spaces shall be utilized only for the designated purpose by the designated vehicle.
c. 
Size of Space Designated. Such parking spaces as designated in Paragraph b, above, are to be 22 feet in length to be measured from a point designated in front of the property location by placement of a sign indicating thereon that this space is reserved for the designated purpose only. The 22 feet shall be measured from the front of each sign for a distance of 22 feet therefrom.
10-3.13. 
Parking; Village Green Park and Patricia Court; Snow. Vehicles parked in the municipally-owned angled spaces located on the south side of Broad Street at Village Green Park and the municipally-owned parking spaces on Patricia Court shall be removed within 24 hours following any snow event. All vehicles that remain parked in those designated areas after that time shall be ticketed and towed at the expense of the owner.
10-4.1. 
Through Streets Designated. Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule IX attached to and made a part of this chapter are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through street, except where yield signs are provided for in the designations.
10-4.2. 
Stop Intersections Designated. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule X attached to and made a part of this chapter are hereby designated as stop intersections. Stop signs shall be installed as provided therein.
10-4.3. 
Lane Use Restrictions.
a. 
Right Lane for Right Turns on Certain Streets. All persons operating motor vehicles in the right lane on the streets or parts of streets described in Schedule XI, attached to and made a part of this chapter must make a right turn.
b. 
Left Turns. The center lane of each Hoboken Road approach to Hackensack Street hereby is reserved for left turn movements only.
10-4.4. 
Turn Prohibitions. No person shall make a turn at any location listed and only in the manner described upon any of the streets or portions of streets described in Schedule XVIII attached to and made a part of this chapter.
Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule XII attached to and made a part of this chapter are hereby designated as one-way streets in the direction indicated.
10-7.1. 
School Play Areas. On any day the Carlstadt public schools are in session no person shall drive a vehicle, except for the purpose of making deliveries, during the hours of 8:00 a.m. and 4:00 p.m. on any of the streets or parts of the streets described in Schedule XV attached to and made a part of this chapter.
10-7.2. 
Loading and Unloading of School Children. Notwithstanding any other provisions of this code, on any day the Carlstadt public school is in session, persons wishing to load and unload children at the school shall be permitted to do so in the "drop-off zone," without parking, on both sides of the horseshoe-shaped roadway immediately adjacent to the front of the Carlstadt public school on the southeast portion of the school property with ingress and egress to Washington Street.
Such persons loading or unloading school children may not stand or park their vehicles within the drop-off zone.
10-7.3. 
School Bus Stops. The locations described in Schedule XIX are hereby designated as school bus stops.
10-7.4. 
School Crossing Guard Posts. The locations described in Schedule XX are hereby designated as school crossing guard posts.
The locations described in Schedule XIV attached to and made a part of this chapter are hereby designated as bus stops.
A traffic control signal shall be installed and operated at the intersection of Hoboken Road and Hackensack Street, and the traffic signal installation shall be in accordance with the provisions of N.J.S.A. 39:1 et seq., and shall conform to the design, and shall be maintained in operation as authorized by the State Department of Transportation.
It shall be unlawful for any person to park a vehicle in an area designated as a special loading zone as specified in Schedule XVI attached to and made a part of this chapter.
Appropriate signs shall be posted displaying the prohibited parking, stopping and standing, and the turning laws shall be marked on the road surfaces.
10-12.1. 
General Penalty. Unless another penalty is expressly provided for by New Jersey Statute or by Subsection 10-12.2, below, every person violating any of the provisions of this chapter shall be subject to a fine of not more than $50, plus a cost of court assessment of $2, Emergency Medical Technician Training Fund assessment of $0.50 plus a $2.50 fine, Body Armor Replacement Fund assessment of $1, New Jersey Forensic DNA Lab Fund assessment of $2, and Autism Medical Research and Treat Fund assessment of $1, or imprisonment for a term not exceeding 15 days, or both.
10-12.2. 
Specific Penalties. Any person convicted of violating the specific subsections set forth below shall be liable for the respective fines, costs and surcharges itemized in Section 10-12.1, listed collectively as "Surcharge" below as follows:
