The purpose of this Part is to establish certain hours of the
day during which public parks, playgrounds and recreation areas of
the Borough of Burnham are closed to the public, except with special
permission granted by the Burnham Borough Recreation Board or by the
Borough Council of the Borough of Burnham for a particular park, playground
or recreation area to be open to the public on a particular day or
particular days for additional hours, and to provide for the proper
management, care, and control of said parks, playgrounds and recreation
areas and to otherwise provide for the health, peace and safety of
the residents of the Borough of Burnham.

All public parks, playgrounds and recreation areas of the Borough
of Burnham and within the Borough of Burnham shall be open to the
public daily between the hours of 8:00 a.m. and 8:00 p.m. from May
1 to and including August 31, and between the hours of 8:00 a.m. and
5:00 p.m. from September 1 to and including April 30. Otherwise, they
shall be closed unless special permission is granted by the Burnham
Borough Recreation Board or by the Borough Council of the Borough
of Burnham for a particular park, playground or recreation area to
be open to the public on a specified day or for additional hours.

The hours during which the public parks, playgrounds and recreation
areas of the Borough of Burnham are open or the hours of use and when
said parks, playgrounds and recreation areas are closed to the public
shall be conspicuously posted at the public park, playground or recreation
area.

Days and hours of operation of any public swimming pool owned
or operated by the Borough of Burnham shall be established seasonally
on an annual basis by the Borough Council of the Borough of Burnham
and notice of the hours of operation of the public swimming pool shall
be posted at the swimming pool. Closing of the said swimming pool
or the establishment of extended hours of operation in relation to
the swimming pool shall be established from time to time by Borough
Council as it deems appropriate.

It shall be unlawful for any person to remain in or to enter
a public park, playground, or recreation area during hours when the
public park, playground or recreation area is closed and not open
to the public, and any person convicted of this offense shall be sentenced
to pay a fine of not more than $600 and the costs of prosecution,
and upon failure to pay such fine and costs, to imprisonment for not
more than 10 days.
