A. The CED will protect the environment and the public health by assuming
responsibility for the permitting, inspection and enforcement of food
services, public swimming pools and on-site liquid waste disposal
systems of less than 2,000 gallons per day.
B. The CED will initially adopt the following New Mexico Administrative
Codes to establish a regulatory framework and fee structure for the
department.
(1) Food service and food processing: NMAC 7.6.2 et seq.
(2) Swimming pools: NMAC 7.18.2 , 7.18.3, 7.18.4 and 7.18.5 et seq.
(3) Liquid waste treatment and disposal: NMAC 20.7.3 et seq.
C. The CED will be responsible for developing required training, certification
requirements, education and public outreach.
D. The CED will establish and maintain an amicable liaison with the
NM State NMED and the federal EPA to remain aware of significant regulatory
changes and new validated science of interest to the CED areas of
responsibility.
E. The CED may conduct research and collect data as required or appropriate
to assist in mitigating or preventing environmental or public health
problems in Otero County.
F. The CED will strive to maintain an open office policy with a minimum
response time for public questions, assistance, complaints and permit
applications.
Properly certified CED staff will have the authority to issue
citations for violations of significant regulations and to initiate
other enforcement action as may be required.
No person shall interfere, hinder, or molest any staff of the
CED in the performance of any duty as herein provided.
Any violation of this chapter shall constitute a petty misdemeanor
and shall be punishable by a fine up to $300 and/or imprisonment of
no more than 30 days.
