As used herein, the following terms shall have the meanings indicated:
LIMOUSINE
Any automobile or motor car used in the business of carrying passengers for hire to provide prearranged passenger transportation at a premium fare on a dedicated, nonscheduled, charter basis that is not conducted on a regular route and with a seating capacity of no more than 14 passengers, not including the driver, provided that such a vehicle is certified by the manufacturer of the original vehicle and the second-stage manufacturer, if applicable, to conform to all applicable Federal Motor Vehicle Safety Standards promulgated by the United States Department of Transportation pursuant to 49 CFR Part 571 (49 CFR 571.1 et seq.) and 49 CFR Part 567 (49 CFR 567.1 et seq.). In addition, a "Vehicle Emission Control Information" label, which contains the name and trademark of the manufacturer and an unconditional statement of compliance with the emission requirements of the Environmental Protection Agency, shall be present on the vehicle. Nothing in this article contained shall be construed to include taxicabs, hotel buses, buses employed solely in transporting school children or teachers, vehicles owned and operated directly or indirectly by businesses engaged in the practice of mortuary science when those vehicles are used exclusively for providing transportation related to the provision of funeral services, autobuses which are subject to the jurisdiction of the Department of Transportation, or interstate autobuses required by federal or state law or regulations of the Department of Transportation to carry insurance against loss from liability imposed by law on account of bodily injury or death in accordance with the standards established by N.J.S.A. 48-16.13.
LIMOUSINE DRIVER
Any person certified by the New Jersey Motor Vehicle Commission as qualified for employment as a "limousine driver" in accordance with N.J.S.A. 48:16-22.3a.
LIMOUSINE SERVICE
The business of carrying passengers for hire by limousine(s).
LIMOUSINE SERVICE LICENSE
A license issued by the Township of Hanover to a limousine service that meets the terms and conditions of Chapter 250 and applicable New Jersey statutes for the operation of a limousine service.
PERSON
Any individual, co-partnership, association, corporation, or joint stock company, their lessees, trustees, or receivers appointed by any court.
PRINCIPAL PLACE OF BUSINESS
The location of the office of a limousine service in the municipality where the limousine service is conducted, where two-way driver communications are available and/or initiated, where calls or electronic requests for limousine transportation are received, from which limousines are dispatched, where limousine drivers report for duty, and/or where the books and records of the limousine service are kept and maintained.
STREET
Any street, avenue, park, parkway, highway or other public place.
TAXICAB
Any automobile or motor car, commonly called taxi, engaged in the business of carrying passengers for hire which is held out, announced or advertised to operate or run or which is operated or run over any of the streets or public highways of this state, and particularly accepts and discharges such persons as may offer themselves for transportation from points or places to points or places within or without the state as defined by N.J.S.A. 48:16-1.
TAXICAB DRIVER
Any person who shall drive or operate a taxicab.
TAXICAB DRIVER'S LICENSE
A license required to be issued by the Hanover Township Committee to any person who operates a taxicab on the streets of Hanover Township.
TAXICAB OWNER'S LICENSE
A license issued by the Hanover Township Committee to the owner of a taxicab who has satisfied the requirements of Article III of Chapter 250 of the Hanover Township Code.
TRANSPORTATION NETWORK COMPANIES
A TNC is a corporation, partnership, sole proprietorship, or other entity that is registered as a business in the state or operates in the state and uses a digital network to connect a rider to a driver to provide a prearranged ride.
A. 
The Township Clerk shall review any and all applications. The Township Clerk shall present said application to any department and/or relevant Township employee for their review including the Police Department, for their recommendations and approval. Upon the Township Clerk's satisfaction that all required information has been provided by the applicant for a license required under Chapter 250, such application shall be presented to the Township Committee for approval or denial. In the event of denial, the Committee shall adopt a resolution setting forth the reasons for such action and the applicant, Clerk, and any other relevant entities shall be given an opportunity to be heard prior to adoption of such a resolution. All licenses issued under Chapter 250 are not transferable.
B. 
Any person who applies for and is issued a limousine license shall be required to pay the following non-refundable fees:
(1) 
Initial application fee of $50 (includes one driver and one vehicle), plus $10 fee for each additional driver and $50 fee for each additional vehicle;
(a) 
Identification cards: $10;
(b) 
$25 fee for replacement card.
(2) 
Limousine license renewal fee of $50 (includes one driver and one vehicle), plus a $10 fee for each additional driver and $50 fee for each additional driver;
(a) 
Identification cards: $10 per card;
(b) 
$25 fee for replacement card.
C. 
Any person who applies for and is issued a taxi license shall be required to pay the following non-refundable fees:
(1) 
Initial application fee of $50 (includes one driver and one vehicle), plus $50 fee for each additional driver and $20 fee for each additional vehicle;
(a) 
Identification cards: $10 per card;
(b) 
$25 fee for replacement card.
(2) 
Taxi license renewal fee of $50 (includes one driver and one vehicle), plus a $50 fee for each additional driver and $20 for each additional driver;
(a) 
Identification cards: $10 per card;
(b) 
$25 fee for replacement card.
All taxicabs and limousines licensed or regulated under Chapter 250 shall be garaged and shall not be parked or stored on any street or in any residential driveway in the Township of Hanover. All taxicabs and limousines shall be parked in compliance with any and all zoning restrictions.
A. 
Expiration. All licenses issued pursuant to Chapter 250 shall expire on December 31 of each year.
(1) 
Any application that is submitted after February 1 of the calendar year shall be treated as an initial application and not a renewal.
B. 
Renewal. Any license issued under Chapter 250 may be renewed each year upon application to the Township Clerk, provided that the applicant provides satisfactory updated application information and pays the fees established under § 250-2B above, and as set forth in Chapter 125, entitled "Fees," of the Code of the Township of Hanover. Any person who fails to renew a license granted hereunder by December 31 of any year, but who submits a satisfactory renewal application prior to January 31 of the following year, may be issued a renewal license upon the payment of a late penalty as provided in Chapter 125, entitled "Fees," of the Code of the Township of Hanover. If no renewal application is filed by an existing license holder by January 31, the affected license shall be deemed to have expired as of December 31. Upon submission of the application, said application shall be reviewed by the Clerk and all relevant members of the Township, including but not limited to the Hanover Police Department and Hanover Zoning Department, for compliance with all relevant provisions as stated in § 250-2.
A. 
Any license issued under and pursuant to Chapter 250 is subject to revocation for any of the following listed below and which must be reported to the Township Clerk within seven business days:
(1) 
Submission of false data in an application;
(2) 
Failure to pay the licensing fee;
(3) 
Violations of the traffic laws;
(4) 
Violation of any statutory requirements for taxicab and limousine operations, as set forth in N.J.S.A. 48:16-1 et seq.;
(5) 
Violation of any of the requirements set in any section of Chapter 250;
(6) 
Operation of a vehicle which is unsafe or in any other respect is in violation of the traffic laws;
(7) 
It is determined that a licensed vehicle is in an unsafe and/or unsanitary condition;
(8) 
Other conduct of a nature warranting revocation of such license;
(9) 
Any license may be temporarily suspended for a violation of the above listed requirements pending a hearing before the Township Committee.
B. 
No license may be permanently revoked prior to the licensee being provided with notice and an opportunity to be heard by the Township Committee, and a vote by the Township Committee to revoke such license. At said Committee meeting, the Township reserves the right to provide an opportunity for members of the public and the municipality to be heard.
C. 
Any conviction of the requirements listed above in Subsection A shall require a hearing before the Township Committee, whereas a final determination will be made regarding the suspension or revocation for the term of the license.
The provisions of Chapter 250 shall not be construed to limit or restrict the obligations of taxicab or limousine services and/or drivers to comply with all other requirements of the Township Municipal Code or any other applicable laws.
This chapter shall be enforced by the Township Clerk with the assistance of the Police and/or Building Departments.
A. 
Any person, owner, or operator who is found guilty of violating any provision of this chapter shall upon conviction, be subject to a fine not exceeding $2,000 or to imprisonment, for a term not to exceed 90 days, or both. Each and every violation of this chapter or each and every day that this violation occurs shall be construed as a separate and distinct violation hereof.
B. 
Any violation of Chapter 250, which is not already required pursuant to the provisions in N.J.S.A. 39:1-1 et seq., shall be prohibited but enforceable under this chapter.
