A certain document, three copies of which are on file in the offices of the City Clerk and City Code Office of the City of Farrell, being marked and designated as the International Property Maintenance Code, 2009 edition, future supplements and amendments, and new editions as published by the International Code Council, is hereby adopted by reference, with the same effect as if fully and at large set forth herein as hereinafter amended by this chapter, the Property Maintenance Code of the City of Farrell in the State of Pennsylvania for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the Offices of the City of Farrell are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 287-2 of this article.

The following sections are hereby revised:
A. 
Section 101.1 Title. These regulations shall be known as the Property Maintenance Code of the City of Farrell, hereinafter referred to as this Code.
B. 
Section 103.5 Fees. The fees for activities and services performed by the department in carrying out its responsibilities under this code shall be as indicated in any resolution now or as hereafter adopted by the City of Farrell.
C. 
Section 106.4 Violation penalties. Any person who shall violate a provision of this Code, or fail to comply therewith, or with any other requirements thereof, shall be prosecuted within the limits provided by State or Local laws. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
Any person or any principal, officer, director, agent or employee of any firm or corporation who shall violate a provision of this Code shall be, upon conviction, sentenced to a fine of not more than $1,000, plus costs, or to a term of imprisonment not to exceed 90 days, or both.
D. 
Section 112.4 Failure to comply. Any person who shall continue any work after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not more than $1,000, plus costs of prosecution, or to a term of imprisonment of not more than 90 days, or both.
E. 
Section 202 General Definitions.
INDOOR FURNITURE
Any furniture which is created to be used as bedding furniture; or any stools; or any non-waterproofed furniture including upholstered furniture; or any appliances; or any furniture not sold specifically as porch or lawn furniture. Outdoor furniture is usually described as any furniture made of wood, plastic, metal or resin that can stand up to the elements for one year.
F. 
Section 302.10 Furniture. Indoor furniture on the exterior of a building is prohibited. The exterior of a building shall be defined as any area not enclosed by windows and/or screens. The occupant or owner of the structure shall be responsible for penalties applied from this section.
G. 
Section 308.4 Payment of Fees. The owner of every occupied premises, the operator of every establishment producing garbage or rubbish, and the owner of every occupied dwelling, prior to the payment due date of any garbage, rubbish or any waste removal service fee, shall satisfy the garbage, rubbish or waste removal fee, as applicable, and upon failure to comply shall be subject to the Violation Penalties, § 106.4, of the Code.
H. 
Section 602.4 Occupiable work spaces. Indoor occupiable work spaces shall be supplied with heat during the period from October 1 to May 15 to maintain a temperature of not less than 65° F. (18° C.) during the period the spaces are occupied.
Exceptions:
1.
Processing, storage and operation areas that require cooling or special temperature conditions
2.
Areas in which persons are primarily engaged in vigorous physical activities.
I. 
Section 705 CARBON MONOXIDE ALARMS AND DETECTION.
Section 705.1 General. Carbon Monoxide alarms shall be installed in dwellings in accordance with § 1103.9 of the International Fire Code, except that alarms in dwellings covered by the International Residential Code shall be installed in accordance with § R315 of that code.
Section 705.2 Carbon monoxide alarms and detectors. Carbon monoxide alarms and carbon monoxide detection systems shall be maintained in accordance with NFPA 720. Carbon monoxide alarms and carbon monoxide detectors that become inoperable or begin producing end-of-life signals shall be replaced.
Ordinance No. O-16-1979 of the City of Farrell entitled "The BOCA Basic Property Maintenance Code, First Edition, 1978" and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any clause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 287-3; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
This chapter and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall become effective immediately upon passage and publication thereof, in accordance with the Home Rule Charter of the City of Farrell and existing law.
