ARTICLE VI TRAFFIC CODE

State speed limits adopted. The provisions of W.S.A., §§ 346.57, 346.58 and 346.59, are adopted as part of this section as if fully set forth herein, except as specified under W.S.A., § 349.11(3)(c).

Speed limits. No operator shall drive a vehicle in excess of the limits expressed on the following highways:

Fifty-five miles per hour:

	Pilgrim Church Road from South Lakeshore Drive to Highway 120/Willow Road intersection
	Highway 120 eastbound from Pilgrim Church Road/Willow Road intersection to County H

Forty-five miles per hour:

Main Street (Highway 50), from the intersection of Edwards Boulevard (Highway 120) to the east City limits

Forty miles per hour.

Main Street (Highway 50), from Curtis Street, to Edwards Boulevard (Highway 120)

Thirty-five miles per hour:

	Bloomfield Road, from the intersection of Wells Street, eastbound to City limits
	Elkhorn Road, from the intersection of George Street to the northwest City limits
	Sheridan Road, and Center Street and Interchange North intersection northeasterly to the City limits
	Main Street, from Sky Lane Drive to west City limits

Thirty miles per hour:

Sec. 74-204 Stop intersections.

The intersections designated are declared stop intersections. When stop signs are erected giving notice thereof, every operator of a vehicle approaching a stop sign at any such intersection shall stop as required by law.

Traffic signals. All traffic shall observe and obey traffic signals at the following locations:

The intersection of Broad Street and Main Street shall be controlled by traffic signals at all times.

The intersection of Main Street and Wells Street shall be controlled by traffic signals at all times.

The intersection of Main Street and Center Street shall be controlled by traffic signals at all times.

The intersection of South 50/Main Street and Highway 120/Edwards Boulevard shall be controlled by traffic signals when such signals are in operation. When they are not, this intersection shall be a four-way stop.

The intersection of Interchange North and entrance of Geneva Square Mall shall be controlled by traffic signals when such signals are in operation. When they are not in automatic mode, they will be signalized by flashing. When they are not operable, it will be an all-way stop.

Two-way stops. Traffic from two directions shall stop at the following intersections:

	Baker Street, westbound, and South Lakeshore Drive, southbound, where the two streets meet. Eastbound Baker Street can only turn south onto South Lakeshore Drive, and northbound South Lakeshore Drive can only turn westbound onto Baker Street, due to one-way streets in the area.

U-Turns. The operator of a vehicle shall not make a U-turn upon a highway at any place designated in § 346.33 Wis. Stat. The provisions of § 346.33, Wis. Stats. are hereby adopted and incorporated herein by reference. The City Council, by resolution, shall designate intersections wherein U-turns are prohibited. Signs prohibiting U-turns will be posted at such intersections.

Sec. 74-209 Vehicular weight limitations.

Turns.

	Traffic proceeding east on Wrigley Drive shall not turn left onto Broad Street
	Traffic proceeding south on Mill Street shall not turn left onto Main Street
	The left-hand lane of Center Street northbound at the intersection of Center Street and Main Street shall be left turn only
	The right-hand lane of Center Street northbound at the intersection of Center Street and Main Street shall be for through and right-hand turn traffic only

Sec. 74-208 No passing zones.

The parts of streets designated, are declared to be no passing zones. The operator of a vehicle shall not drive on the left side of the center of the roadway on any portion of a street which has been designated as a no passing zone, either by signs or by an unbroken line on the pavement on the right-hand side of and adjacent to the center line of the roadway. The following parts of streets are designated no passing zones:

Center Street, either direction, from Wrigley Drive to the south to Sheridan Springs Road to the north

George Street, either direction, from Wrigley Drive to the south to Sheridan Springs Road to the north

Main Street, either direction, from east City limits to beginning of four-way lane South 50

Interchange North, either direction, northerly from the north curbline of Grant Street to the west curbline of Center Street at its junction with South Interchange North

South 50, either direction, from South 12 where South 50 is a divided highway

South 120, either direction, from east curbline of South Lake Shore Drive easterly on Baker Street thence right on Lake Shore Drive southerly to the south City limits

Class B highways designated. All streets and alleys within the City limits except the following enumerated streets, are designated Class B highways and shall be subject to the weight limitations imposed by W.S.A., § 348.16:

Use of other streets by heavy traffic

No vehicle, except a motor bus, which is not equipped with pneumatic tires or has a combined vehicle load weight exceeding 10,000 pounds, shall be operated or moved on any street or alley not part of the heavy traffic route designated in Subsection (2) of this section in the City, except for the purpose of obtaining orders for moving or delivering supplies or commodities to or from a place of business or residence facing thereon, provided that in no event shall the weight of the vehicle and load on such other street exceed the limitations of W.S.A., § 348.16(3), pertaining to Class A Highways or deliveries on Class B highways.

Through traffic 6,000 pounds gross weight and above is prohibited in and through parking lot area immediately east of City Hall between Geneva Street and alley (600 block of Geneva Street).

No parking, standing or stopping zones.

No vehicle shall be parked, stopped or standing, except to comply with the directions of a traffic officer in any of the following:

This subsection shall not apply to physicians on emergency calls or operators of authorized emergency vehicles during an emergency, nor to spaces within such areas which are authorized loading zones when used for loading or unloading.

Except where specifically designated, parking of vehicles is prohibited in all City parks unless a permit is first obtained from City Hall.

Parallel parking. Except as prohibited in Subsection (a)(1), parallel parking only shall be permitted in the following zones:

Broad Street, two stalls, on the east side of Broad Street from the corner of Wisconsin Street to the driveway of the drive-through windows of what is now PNC Bank.

Center Street, east side, south of Main Street

Center Street, east side, from Wrigley Drive to Wisconsin Street except for that section between the south entrance of the Cove parking lot to the White River

Center Street, west side, from Main Street to Wisconsin Street except for that section in the 300 Block of Center Street

Clover Street, west side, from Park Row to LaSalle Street

Cook Street, east side, from Geneva Street to North Street

Cook Street, west side, from Main Street to Wisconsin Street

Dodge Street, north side, from Broad Street to Center Street

Boat trailers. The parking of boat trailers or any similar device used for hauling boats, except single chassis vehicles, is prohibited on either side of the entire length of Baker Street or Campbell Street and South Lake Shore Drive and Wrigley Drive and on either side of the 100 block of Center Street. It shall be a violation of this section for any motor vehicle with a trailer or a trailer alone to be parked in the Sage Street parking lot (Parking Lot D)

Night parking.

There shall be no parking of any vehicle on any City street or municipal parking lot between 2:00 a.m. and 6:00 a.m. from November 15 of each year to March 31 of the following year, except for the municipal lot located at Sage Street Municipal Parking Lot D which parking shall not exceed 24 hours.

There shall be no parking of any vehicle on any City street or municipal parking lot in the Downtown Business District from 3:00 a.m. to 6:00 a.m. all year, except for the municipal lot located at Sage Street Municipal Parking Lot D which parking shall not exceed 24 hours.

For the purpose of Subsection (d)(2), "Downtown Business District" is defined as that portion of the City bounded by South Lake Shore Drive on the east; Cook Street on the west; Wrigley Drive on the south; and Geneva Street on the north.

The Police Department may tow away all vehicles which are parked in violation of this subsection.

Whoever shall violate this subsection may be subject to a forfeiture plus the costs of towing and storage.

Permission for parking for guests of residents may be granted by the Police Department on a per night basis for not more than 14 days for any one person or vehicle. Such permission may be granted by the Police Department upon a telephone notification for not more than three days. If request is made for permission to park for more than three days, the applicant shall complete an application at the Police Department. This subsection does not apply to Subsection (d)(2) above.

No parking, snow removal.

For the purpose of removing snow from the streets and surrounding areas, the Street Department may erect signs prohibiting parking in the particular area where snow is intended to be removed.

The Police Department may tow away all vehicles parked in violation of the no parking sign pursuant to this subsection.

Any person who violates this subsection may be subject to a forfeiture plus the cost of towing and storing the vehicle.

(f)

Backing into parking stalls. No person shall back a vehicle (other than a motorcycle) into any angled parking stall in the City. Construction and/or maintenance vehicles may obtain a permit to back a vehicle into a parking stall while actually engaged in their work from the City Clerk, Utility Commission or Meter Department.

(g)

Terrace parking. No person shall park a vehicle on the terrace area between the street and sidewalk at any time.

(h)

Limited time parking zones.

When signs are erected giving notice thereof, no person shall park a vehicle in a limited time parking zone, designated in Section 74-234, in excess of the time set forth in the schedule, except to comply with the directions of a traffic officer.

This subsection is subject to the provisions of Subsection (a)(1) of this section.

(j)

Tow-away zones. When signs are erected giving notice thereof, any unauthorized vehicle parked in a tow-away zone, may be towed away at the owner's expense, and the following areas are designate tow-away zones:

	Baker Street, south side, from the east curbline of Wrigley Drive to the west curbline of South Lake Shore Drive
	City launching ramp at the intersection of Wrigley Drive and Center Street Fire House Ramp at 742 Marshall Street
	South Lake Shore Drive, both sides, from the south curbline of Baker Street to the north curbline of South Street
	South Lake Shore Drive, both sides, from the south curbline of Main Street to the north curbline of Cass Street
	Wrigley Drive, west side, from the north curbline of Campbell Street to the south curbline of Baker Street

(k)

Fire lanes.

When signs are erected giving notice, no person shall park any vehicle in a fire lane.

The Police Department shall tow away all vehicles parked in violation of this section.

Any person who violates this subsection shall be subject to a forfeiture plus the cost of towing and storing the vehicle.

(l)

Snow emergency.

Declaration of snow emergency. The Mayor, or in his or her absence, the President of the City Council, shall have the authority to declare a snow emergency whenever conditions arise which in his or her judgment necessitate the same, subject to the Council action as provided by statute.

Police and Fire Chiefs. Upon the declaration of a snow emergency, the Chief of Police and the Chief of the Fire Department are authorized to hire tow trucks, require snow plow accompaniment of rescue squads and ambulances, both inside and outside the corporate limits to the City, establish a public information telephone reception center, advise radios WTMJ and WLKG of declaration of snow emergency and to take any other action either or both may deem necessary under the circumstances.

Plowing. There is hereby established a snow emergency plowing priority system. A map of the streets of the City which designates the primary routes in yellow, the secondary routes in blue and the emergency facilities in red shall be maintained in the office of the City Clerk, the Police Department, the Fire Department and the Street Department. The Street Department shall first clear and keep clean all primary routes and entrances and exits to the emergency facilities. Then all secondary routes shall be cleared and maintained.

Parking. During a snow emergency, there shall be no parking on all primary and secondary routes. Any vehicles parked on such routes shall be towed away at the owner's expense, as provided in Section 74-220.

Termination. The snow emergency may be terminated by the Mayor or the City Council. The snow emergency shall be limited to the time during which such snow emergency conditions exist.

Limitation. This subsection shall not in any way limit or prohibit any authority conferred upon the Mayor, City Council, Chief of Police or Chief of the Fire Department by prior ordinance or statute.

(m)

Semi-trucks with or without trailers shall only be permitted to park on Geneva Parkway between signs placed along said roadway. Semi-trucks with or without trailers shall not be permitted to park on any other streets within the City of Lake Geneva. The provisions of Section 74-59 of this Code shall not apply to this subsection.

(n)

Upon streets where parking is authorized by official signs or markers, where parking stalls are designated by markings on the pavement, it shall be a violation of this section for any vehicle to be parked outside the lines or markings delineating the parking stall.

Sec. 74-211 No stopping.

When signs are erected giving notice, no person shall stop a vehicle in any designated no stopping zone during the times set forth except to comply with the directions of a traffic officer. This section shall not apply to physicians on emergency calls or operators of emergency vehicles during an emergency.

There shall be no stopping at any time on Main Street, south side, from the east line of Center Street, 133 feet east.

Sec. 74-212 Accident reports.

The operator of any vehicle involved in an accident shall immediately, or as soon as reasonably possible thereafter, file with the Police Department a copy of the report required by W.S.A., § 346.70, if any. If the operator is unable to make a report, any occupant of the vehicle at the time of the accident capable of making such report shall comply with this section. Such reports shall be subject to the provisions and limitations in W.S.A., §§ 346.70(4)(f) and 346.73.

Sec. 74-213 Unattended vehicles.

Prohibited. No person shall leave an automobile unattended on any street, parking lot, public ground or alley while the motor is running. No person shall permit a motor vehicle in his or her custody to stand or remain unattended upon any street, alley or public place in the City without first stopping the engine, locking the ignition, removing the key and taking it with him or her.

Officer to remove key. Whenever any police officer finds any motor vehicle standing in violation of the provisions in Subsection (a), the officer shall remove the key and deliver the same to the Police Department. Upon so doing, the officer shall attach to the vehicle a notice that the keys will be returned upon presentation of the notice and proof of ownership of the vehicle.

Motor vehicles weighing more than 6,000 pounds or exceeding 23 feet.

No person shall park for any period of time leave standing for any period of time any motor vehicle weighing more than 6,000 pounds or exceeding 23 feet in length on any public street in a residentially zoned district, public parking lot or property.

The operator or owner of any truck weighing more than 6,000 pounds or any truck tractor, motor bus, trailer or semitrailer exceeding 23 feet shall not park the same on any street in the City longer than 30 minutes, except for loading and unloading.

In commercial and industrially zoned districts where such parking is not otherwise prohibited or restricted, this section shall not prohibit any owner or operator of any of the above mentioned vehicles from parking such vehicles for longer than 30 minutes between the hours of 6:00 p.m. and 6:00 a.m. A commercial vehicle in excess of 23 feet in length may be parked on any public street in any district for a temporary period of time necessary to make a pickup or delivery from a building fronting on that street between the hours of 6:00 a.m. and 5:00 p.m., provided further that such pickup or delivery shall commence immediately upon parking the vehicle and continue without interruption until completed and in no circumstance shall such vehicle park on any public street in excess of 30 minutes.

Sec. 74-214 Abandoned vehicles.

Abandonment. No person shall leave unattended any motor vehicle, trailer, semitrailer or mobile home on any public street or highway, or public or private property, for such time and under such circumstance, as to cause the vehicle to reasonably appear to have been abandoned. When any such vehicle has been left unattended on any City street or highway, or on any public or private property, within the City without the permission of the owner for more than 48 hours, the vehicle is deemed abandoned and constitutes a public nuisance.

Removal and impoundment. Any vehicle in violation of this section shall be impounded until lawfully claimed or disposed of under Subsection (c), except if the Chief of Police or his representative determines the cost of towing and storage charges for the impoundment would exceed the value of the vehicle, the vehicle may be junked by the City prior to the expiration of the impoundment period upon determination by the Chief of Police or his representative that the vehicle is not wanted for evidence or other reason.

Disposal of abandoned vehicles.

Value more than $100.

If the Police Chief or his representative determines that the value of the abandoned vehicle exceeds $100, he or she shall notify the owner and lienholders of record by certified mail that the vehicle has been deemed abandoned and impounded by the City and may be reclaimed within 15 days upon payment of accrued towing, storage and notice charges, and if not so reclaimed, shall be sold.

If an abandoned vehicle determined to exceed $100 in value is not reclaimed within the period and under the conditions provided above, it may be sold by sealed bid at auction, or, if no satisfactory bid is received, at private sale.

After deducting the expense of impoundment and sale, the balance of the proceeds, if any, shall be paid into the City treasury.

Value less than $100. Any abandoned vehicle which is determined by the Chief of Police or his or her representative to have a value of less than $100 may be disposed of by direct sale by a licensed salvage dealer upon determination that the vehicle is not reported stolen.

Owner responsible for impoundment and sale costs. The owner of any abandoned vehicle, except a stolen vehicle, is responsible for the abandonment and all costs of impounding and disposing of the vehicle. Costs not recovered for the sale of the vehicle may be recovered by a civil action by the City against the owner.

Notice of sale or disposition. Within five days after the sale or disposal of a vehicle as provided in Subsection (c)(1) or (2), the Chief of Police or his representative shall advise the state Department of Transportation, Division of Motor Vehicles, of such sale or disposition on a form supplied by the Division. A copy of such form shall also be given to the purchaser of the vehicle and a copy shall be retained by the City.

Sec. 74-215 Driving onto lake.

No person shall remove, without proper authority, any rope, cable or barricade of any description which has been placed across any entrance to Geneva Lake. No person shall drive a motor driven vehicle in such a manner as to by pass or circumvent any barricade across an entrance to Geneva Lake when such barricade has been so placed by proper authorities for the purpose of warning drivers not to enter the frozen surface of Geneva Lake.

Sec. 74-216 Liquor in vehicles.

No underage person, unaccompanied by parent, guardian or spouse, may possess, transport or have under his or her control, any alcohol beverage in any motor vehicle, unless such person is employed by an alcohol beverage licensee and such possession is during regular working hours and in the course of his or her employment.

Sec. 74-218 Official traffic signs and signals.

No person shall have in his possession an open container containing an alcohol beverage in a motor vehicle on a public street, alley or highway within the City.

Sec. 74-217 Display of power prohibited.

No person shall make unnecessary and annoying noises with a motor vehicle by squealing tires, excessive acceleration of engine or by emitting unnecessary and loud muffler noises.

Street Superintendent to erect. The Street Superintendent shall procure, erect and maintain appropriate standard traffic signs, signals and markings conforming to the Uniform Traffic Control Devices Manual giving such notice of the provisions of this chapter as required by state law. Signs shall be erected in such locations and manner as the Street Superintendent shall determine will best affect the purposes of this chapter and give adequate warning to users of the street or highway.

Removal of unofficial signs and signals. The Street Superintendent shall have the authority granted by W.S.A., § 349.09, and is directed to order the removal of a sign, signal, marking or device placed, maintained or displayed in violation of this chapter or W.S.A., § 346.41. Any charge imposed on a premises for removal of an illegal sign, signal or device shall be reported to the council at its next regular meeting for review and certification.

Sec. 74-219 Streets closed to travel.

Whenever any street, highway or alley is impassible or unsafe for travel during the construction or repair of any such street, highway or alley, and until it is ready for traffic, the authorities in charge of the maintenance or construction thereof shall apply to the Street Superintendent for permission to close the same by maintaining barriers at each end of the closed portion. The barriers shall be of such material and construction and so placed as to indicate that the thoroughfare is closed and shall be lighted at night.

Sec. 74-220 Towing charges for vehicles moved by City.

No unauthorized person shall remove, take down, alter the position of, destroy, pass over or beyond any barrier so erected or travel with any vehicle upon any portion of a thoroughfare closed by barriers as provided in this section, or travel in any manner upon the materials placed thereon as part of the repair or construction work or shall deface any materials so placed. In addition to the penalty provided by this chapter, any violator of this section shall be liable for all damages done to the highway, street or other thoroughfare or material thereon.

The owner of any abandoned vehicle or vehicle that is authorized to be moved by the Police Department shall, prior to having the possession of such vehicle returned to him, pay a reasonable towing charge as determined by the towing operator and shall also pay to the City the outside parking fee for each day such vehicle is in the City operated parking facilities.

Sec. 74-221 Parking meters.

Vehicle defined. "Vehicle," as used in this section, shall mean any device in, upon or by which any person or property is or may be transported upon a highway.

Parking station defined. "Parking stations" are the machines installed throughout the City for the purpose of accepting payment at stalls throughout the City.

Parking system defined. The "parking system" is hereby defined as the parking stations, parking spaces, and signage.

Parking station zones are ordained for the following areas and shall be limited to the time designated as follows:

Thirty-minute parking station zones for library material pickup and dropoff and authorized library use.

Main Street, 900 block, south side, parking spaces 215 through 219, west of Wrigley Drive, Library Park area as designated by posted signage shall be used for library book pickup and dropoff and authorized library use only when the library is open for business. No deposit in the parking station shall be required for this stall. When the library is closed to the public, deposits in the parking station are required at rates established by the City Council from time to time. Anyone violating the restrictions established herein for these spaces shall be charged a fine established by resolution of the City Council from time to time.

Hours. The limited parking in the parking station zones shall apply from 9:00 a.m. to 7:00 p.m., Monday through Sunday.

Exceptions. Each year from November 15 until the last Tuesday of January of the following year, free parking shall be established for all parking station zones except in the following zones where parking is free all year long:

(f)

Maintenance of parking system. Persons designated by the Mayor and City Council shall provide for installation of parking stations and signage, including curb and street marking lines, and shall maintain such stations, spaces, and signage in good condition. Signage shall be placed throughout the paid parking zones. Parking stations, erected conveniently throughout the downtown area shall display a signage or receipt showing legal parking upon deposit of proper coin, currency or credit card as indicated by the instructions on such parking stations. The receipt dispensed by the parking station shall indicate expiration of the parking period.

(g)

Deposit of payment. Parking stations only accept quarters, one-dollar coins, and Visa, Mastercard, and Discover credit cards for posted parking spaces. Parking space fees shall be in an amount as established by resolution of the Common Council from time to time. The parking of a vehicle beyond the period of time fixed by this section where any parking space is located and designated shall be a violation of this section. No person shall permit any such vehicle registered in his or her name to be parked overtime or beyond the period of time described above. Only one vehicle shall be parked in any one parking meter space, except for motorcycles where three motorcycles are permitted in each space.

(h)

Authorized City parking stickers. Parking sticker fees may be modified by the Common Council from time to time. Parking stickers are nontransferable and may become invalid if the holder loses his or her resident status by moving out of the City of Lake Geneva or Walworth County. It shall be a violation of this subsection to park in an unpaid metered stall with an expired parking sticker, park in an unpaid meter stall with a parking sticker not registered to the designated vehicle, park in an unpaid meter stall with an altered parking sticker, or park in an unpaid meter stall with the parking sticker not properly displayed, i.e., displayed on the wrong side of the windshield, taped to the windshield, or otherwise not displayed as noted on any disclaimers provided when the sticker is issued. Forfeiture for violations of this section shall be determined by resolution by the City Council from time to time.

Business in the City of Lake Geneva. Any business owner holding a valid business license to operate in the City limits of Lake Geneva may purchase for a two-year period up to two City parking stickers. This sticker allows parking for up to two consecutive hours per day without depositing payment in the parking station. This sticker also allows for up to 10 consecutive hours per day (9:00 a.m. to 7:00 p.m.) in the 227 South Shore Drive Parking Lot I. The fee and the requirements for this sticker shall be established from time to time by resolution of the City Council.

Nonresident property owner. Any person who owns a second home in the City of Lake Geneva with a vehicle registered to that person shall be eligible for a City parking sticker. This sticker allows parking for up to two consecutive hours per day without depositing payment in the parking station. This sticker also allows for up to 10 consecutive hours per day (9:00 a.m. to 7:00 p.m.) in the 227 South Shore Drive Parking Lot I. This sticker renews every even-numbered year. The fee and the requirements for this sticker shall be established from time to time by resolution of the City Council.

Parking lot pass. A parking lot pass is valid at all municipal parking lots, excluding Newport Lot and North Shore Lot, from 9:00 a.m. until 7:00 p.m., seven days a week. Parking is available on a first-come-first-served basis, and the placard holder may be forced to park in a space located elsewhere and deposit the required payment if there are no available spaces in the lots described in this Subsection (3). Parking availability is not guaranteed. The fee and the requirements for this placard shall be established from time to time by resolution of the City Council. Only 40 placards are issued annually and are provided on a first-come first-served basis.

Resident. Any person who is a resident homeowner or resident tenant eligible to vote in the City of Lake Geneva with a vehicle registered to that person at his/her City address shall be eligible for this type of parking sticker. This sticker allows parking for up to three consecutive hours per day without depositing payment. This sticker also allows for up to 10 consecutive hours per day (9:00 a.m. to 7:00 p.m.) in the 227 South Shore Drive Parking Lot I. This sticker renews every even-numbered year. The fee and the requirements for this sticker shall be established from time to time by resolution of the City Council.

Walworth County. Any resident of Walworth County with a vehicle registered to that person at his/her Walworth County address may purchase a City parking sticker which will allow parking for up to two consecutive hours per day within the City without depositing payment. This sticker also allows for up to 10 consecutive hours per day (9:00 a.m. to 7:00 p.m.) in the 227 South Shore Drive Parking Lot I. This sticker renews every even-numbered year. The fee and the requirements for this sticker shall be as established by resolution of the City Council.

(i)

Damage to parking station. No person shall deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking station.

(j)

Complaint by traffic officers. Authorized traffic officers or parking personnel shall take the parking space number and the state vehicle tag number of all vehicles violating the provisions of this section and violations of a no parking zone, parking near a fire hydrant, for unauthorized vehicle parking in a handicap zone, for backing into a parking stall and for parking more than three motorcycles in a parking stall and make complaint therefore in the appropriate department or court for the City. Traffic officers or meter persons shall have the authority to issue citations for all parking related violations.

(k)

Penalties. Any person who shall violate the time limits established in this section or fail to make payment as required by Subsection (e) may stipulate to his guilt or enter a plea of nolo contendere and pay a forfeiture and any penalties at a time and in an amount as established by resolution of the Common Council. Such person shall also pay any applicable collection charges if submitted to an agency for collection.

(l)

Challenges to Parking Citations.

Parking citations shall not be withdrawn by officers or supervisors except for extraordinary circumstances where it is apparent the parking citation was issued in error.

Parking citations shall only be excused by the Parking Manager, the Comptroller, or the City Administrator.

Parking Department clerks or other Parking Department support services staff located at the front counter in City Hall will provide general information to citizens as to the parking regulations in the City of Lake Geneva. The Parking Department Manager, the Comptroller or City Administrator should be contacted to address unusual complaints or for more detailed explanations, if required.

Citizens being informed of the general information and wishing to further challenge the parking citation shall be referred to the Parking Manager or, in their absence, the Comptroller or City Administrator.

Any challenge to the parking citation shall be made to the Parking Manager within 30 days of the citation's issuance.

If the challenge is denied, and the citizen still wishes to contest the parking citation, the citizen must notify the Parking Department of their desire to appeal the parking citation within 10 days of the denial, and a municipal ordinance citation with an appropriate court date to appear in Municipal Court will be issued to the citizen.

Failure to comply with the time deadlines set forth above shall preclude any further appeal of the parking citation.

Sec. 74-222 Snowmobiles.

State statutes adopted. The statutory provisions describing and defining regulations with respect to snowmobiles in W.S.A., ch. 350, including all subsequent revisions and additions thereto, are hereby adopted and by reference made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this section. Each section of the Wisconsin Statutes adopted by this section shall bear the same number in this chapter as it has in the Wisconsin Statutes.

Public parks. No person shall operate a snowmobile in the public parks or public grounds within the City.

Trespass. No person shall operate a snowmobile on the property of another without the express or implied consent of the owner or occupant.

Hours limited. No person shall operate a snowmobile within the City between 10:00 p.m. and 6:00 a.m.

Sec. 74-223 Bicycles.

Registration.

Required. No City resident shall operate a bicycle upon any public street, highway, roadway or alley within the City unless such bicycle is properly registered and has attached to it a proper registration device.

Fee schedule: two-dollar registration fee.

Term. The registration shall be good for the life of the bicycle or until ownership changes, at which time it must be reregistered.

Inspection. The Police Department shall cause to be inspected each bicycle presented for registration and may refuse to register any bicycle found to be in unsafe mechanical condition or not equipped as required.

Operation without tags or in unsafe manner. No person shall operate any bicycle not properly registered or carrying a proper identification tag upon any street, highway, roadway or alley in the City, or operate any bicycle in an unsafe manner or in violation of any state law.

Change of ownership. Within 10 days after any bicycle registered hereunder has changed ownership or been permanently dismantled and taken out of operation, such information shall be reported to the Police Department by the person in whose name the bicycle has been registered.

Sec. 74-225 Required use of red flashing lights for school buses.

Warning device. No bicycle shall be operated on City streets unless equipped with an audible signal.

(f)

Parking. No person shall leave or park a bicycle at such a place or in such a way as to create a hazard to pedestrians, automobile operators or anyone else.

(g)

Riding on sidewalks, Riviera and tennis courts prohibited. No person shall ride a bicycle, skate board, roller skates or any similar device upon a sidewalk within the business district; Broad Street from Geneva Street to Wrigley Drive; Main Street from Cook Street to Mill Street; Center Street from Geneva Street to Wrigley Drive; Wrigley Drive from Main Street to Baker Street; or the complete area surrounding the Riviera Ballroom; being sidewalks; lawns and piers; or the tennis courts located at Badger High School; East View School and Maple Park.

Sec. 74-224 Skitching.

No person shall cling to or be towed by a motor vehicle on any public roadway in the City except as otherwise authorized by law.

The operator of a school bus equipped with flashing red lights as specified in W.S.A., § 347.25(2), as amended from time to time, shall actuate such lights in residential and business districts of the City when pupils or other authorized passengers are to be loaded or unloaded at a location at which there are no traffic signals and such persons must cross the street or highway before being loaded or after being unloaded. The above-described lights shall be actuated at least 100 feet before stopping to load or unload such pupils or other authorized passengers and shall not be extinguished until loading or unloading is completed and persons who must cross the highway are safely across.

Sec. 74-226 Loading and unloading zones.

No vehicle shall be parked, stopped or left standing in any zone designated during the time set forth in the following schedules:

Sec. 74-227 Transporting persons in cargo areas of motor trucks prohibited.

Upon issuance of a City permit, a vehicle may be parked in a loading and unloading zone for a period to exceed the normal time for loading and unloading. Such permit shall be displayed in the front window of the vehicle while it is parked.

No person may operate upon a street, alley or highway, a motor truck having a gross weight of 10,000 pounds or less, when any person is in an open cargo areas of the motor truck.

Subsection (a) does not apply to any of the following:

A person operating a farm truck in conjunction with farm operations.

A person operating a motor truck in a parade sanctioned by a local municipality.

A person operating a motor truck for the purpose of transporting licensed deer hunting during the authorized deer hunting season.

Sec. 74-228 Traffic control signal emergency preemption devices.

A person riding in a cargo area engaged in necessary duties as an employee.

"Authorized emergency vehicle" means an authorized emergency vehicle, as defined in W.S.A. § 340.01 (3) (a), (c), (g) or (i), owned by the City of Lake Geneva or by another municipality or other agency that is authorized by the City of Lake Geneva pursuant to Subsection (e) below.

"Traffic control signal emergency preemption device" is a device, located on or within a traffic control signal, that is designed to receive an electronic, radio, light, or sound transmission from an approaching vehicle that alters the normal sequence of the traffic control signal to provide or maintain a green signal for the vehicle to proceed through the intersection.

"Transmitter" in this section means a device that emits a signal for the purpose of activating a traffic control signal emergency preemption device.

Only authorized emergency vehicles may operate within the City of Lake Geneva with a transmitter or in which a transmitter is located. No operator of an authorized vehicle may use a transmitter except when responding to an emergency call, when pursuing an actual or suspected violator of the law, or when responding to, but not when returning from, a fire alarm, except that transmitter may be activated by authorized personnel for periodic testing, maintenance or repair of the transmitter or traffic control signal emergency preemption device. Unless authorized by the City of Lake Geneva as provided herein or in Subsection (e) below, any other use of a transmitter is prohibited. This subsection does not apply to a motor carrier or person in the business of selling transmitters to authorized users who transports a transmitter in original, unopened packaging or in an inoperative condition in an enclosed storage compartment of the vehicle.

The use of a transmitter by authorized emergency vehicles not owned by the city of Lake Geneva is allowed only if specifically authorized by the City of Lake Geneva pursuant to the following procedure: A request by an outside agency for authorization to utilize a transmitter should be submitted in writing to the City Administrator. Submittal shall also include a copy of the requesting agency's certificate of insurance and verification that emergency vehicle operators have completed a comprehensive training program. An application for use of the transmitter within the City of Lake Geneva shall be reviewed by a committee consisting of the Fire Chief, Police Chief, and the Director of Public Works, or their designees. Signing of appropriate contracts may be required. The decision of the committee shall be final and may be revoked at any time.

Sec. 74-230 Penalty.

The penalty for violation of any provision of this chapter shall be a forfeiture and penalty assessment if required by W.S.A., § 165.87, a jail assessment if required by W.S.A., § 53.46(1), plus any applicable fees prescribed in W.S.A., § 814.

State forfeiture statutes. Any forfeiture for violation of Section 74-200 shall conform to the forfeiture permitted to be imposed for violation of the statutes adopted by reference, including any variations or increases for subsequent offenses.

Local regulations. Except as otherwise provided in this chapter, the penalty for a violation of this chapter shall be as provided in Section 1-12 of this Municipal Code.

Parking regulations. Except as otherwise provided in this chapter, the penalty for a violation of this chapter shall be as provide in Section 1-12 of this Municipal Code.

Sec. 74-231 Shortcut through business property.

It shall be unlawful for any person to operate or drive any vehicle, so as to pass over the parking lot or driveway used in the operation of any business property, thereby avoiding traveling through an intersection over the usual lanes of traffic.

Sec. 74-232 Violation; penalty.

No person who has been convicted of a violation of any provision of this chapter shall be issued a license or permit by the City of Lake Geneva, Wisconsin, except a dog license, until the forfeiture imposed for such violation and any penalty assessment, court costs and fees or surcharge is paid.

Sec. 74-233 Enforcement.

Enforcement procedure. This chapter shall be enforced according to W.S.A., §§ 23.33, 66.12, 345.11—345.61, 350.17, and ch. 800.

Deposit.

Any person arrested for a violation of this chapter may make a deposit of money as directed by the arresting officer at the police station, the Clerk of Court's office or by mailing the deposit to such places. The arresting officer or the person receiving the deposit shall notify the arrested person, orally or, in writing, that:

If the person makes a deposit for a violation of a traffic regulation, the person need not appear in court at the time fixed in the citation and the person will be deemed to have tendered plea of no contest and submitted to a forfeiture and penalty assessment if required by W.S.A., § 165.87, a jail assessment if required by W.S.A., § 53.46(1), plus any applicable fees prescribed in W.S.A., § 814, not to exceed the amount of the deposit that the court may accept as provided in W.S.A., § 345.37.

The amount of the deposit shall be determined in accordance with the deposit schedule established by the Wisconsin Judicial Conference and shall include the penalty assessment established under W.S.A., § 165.87, a jail assessment if required by W.S.A., § 53.46(1), and costs. If a deposit schedule has not been established, the arresting officer shall require the alleged offender to deposit the forfeiture established by the Chief of Police, which shall include the, penalty assessment established under W.S.A., § 165.87. Deposits for nonmoving violations shall not include the penalty assessment.

The arresting officer or the person receiving the deposit shall issue the arrested person a receipt therefore as required by W.S.A., § 345.26(3)(b).

Petition to reopen judgment. The arresting officer or the person receiving the deposit shall issue the arrested person a receipt therefor as required by W.S.A., § 345.26(3)(b).

Sec. 74-234 Limited time parking zones.
