It shall be unlawful for any person, firm or corporation to set or maintain any fire upon any of the streets, sidewalks, alleys, curbs, curb stones or public grounds within the corporate limits of the City of Farrell, or to burn or cause to be burned thereon any paper, boxes, rubbish, litter, refuse, leaves or other material or substance of any kind.

It shall be unlawful for any person, firm or corporation to burn upon any premises, lot or property within the corporate limits of the City of Farrell any material of any kind which produces an offensive or noxious smoke or odors.
It shall be unlawful for any person, firm or corporation to set or maintain any fire within the corporate limits of the City of Farrell in damp, cloudy, foggy or windy weather.

No person shall burn upon any premises, lot or private property within the City, any loose dry paper or dry combustible materials of a non-noxious nature at any time during the day or night except: Monday through Saturday, both inclusive, between the hours of 6:00 a.m. to 9:00 a.m. from June 1, through September 30; and Monday through Saturday, both inclusive, between the hours of 6:00 a.m. and 8:00 a.m. and 5:00 p.m. and 7:00 p.m. from October 1 through May 31, but in no event, January through December, both inclusive, shall burning be permitted on a holiday.
The right to burn dry combustible materials of a non-noxious nature during the hours set forth in § 145-4, above, shall be subject to the following conditions:
A.
No fire shall be set or maintained closer than 10 feet from any building, structure or property line.
B.
No fire shall be permitted to burn unattended or be allowed to smolder.
C.
Every fire shall be built in and confined to a suitable noncombustible container covered with a screen of 1/2 inch or smaller mesh.

Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000, plus costs, or to a term of imprisonment not to exceed 90 days, or both. Each day that a violation continues shall constitute a separate offense.
