A municipal curb market shall be established and operated by the City of Farrell and the location of same shall be designated by the Council and Mayor on or before the 20th day of May of each year.

Any person, persons, firms or partnerships or corporations occupying or using any space at such municipal market shall first obtain a license to do so and shall pay for said license to the City of Farrell the fee as established from time to time by resolution of City Council.

The following rules and regulations shall govern all person, persons, firms, partnerships or corporations connected with or doing business at the said market place:
A.
Rule 1. Operation dates. The said market place shall be operated on Tuesday and Friday of each week commencing with the first Tuesday after the 4th of July of each year and ending at such time in the fall of the year as Council may deem proper.
B.
Rule 2. Operation time. The market shall open at 6:00 a.m. and close at 1:00 p.m. on each market day.
C.
Rule 3. Eligibility to lease. Only farmers who meet the guidelines as amended from time to time of the Farmers Market Nutrition Program of the Pa. Department of Agriculture or its successor will be permitted to lease space or stands at said municipal market. Farmers must identify their products as purchased or personally grown. In addition, however, space or stands may be leased for an open market operation, defined as a street market where generally, both new and used articles other than farm products are sold.
D.
Rule 4. Subletting prohibited. No purchaser or lessee of stands, blocks or sections will be permitted to sublet.
E.
Rule 5. Reselling prohibited. Any provisions, vegetables or fruits purchased at the said market shall be prohibited from being sold again at the same market.
F.
Rule 6. Additional rules and regulations. From time to time Council and the Mayor may make such other rules and regulations as shall be necessary for the proper conduct and operation of the market.
G.
Rule 7. Attendance and prices. No person shall dissuade or attempt to dissuade any person from attending municipal public market, or persuade or attempt to persuade any person to advance prices or to uniform prices for products offered for sale at or within the market.
H.
Rule 8. City rights reserved. The City reserves the right to eject any and all persons from the market grounds or to refuse to grant permits or licenses to make sales at the curb market.
I.
Rule 9. Registration certificate required. All persons renting space at the market shall be required to execute a registration certificate supplied by the proper City authority for that purpose.
J.
Rule 10. Enforcement. In addition to the authority reserved by City, this Article shall be monitored by and enforced by any authorized representative of the Pennsylvania Department of Agriculture or any other department authorized by the Commonwealth of Pennsylvania who oversees the Farmers Market Nutrition Program or any successor thereto.

Any person who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000, plus costs, or to imprisonment for a term not to exceed 90 days, or both.

As used in this article, the following terms shall have the meanings indicated:
Any tent, shed, lot, space or parcel of ground where a rental license fee or space charge is charged by the owner or lessor of said tent, shed, lot, space or parcel of ground to a person or persons occupying the said tent, shed, lot, space or parcel of ground for temporarily establishing a stand or stopping to sell his, their or its products, such as provisions, vegetables, fruits, poultry, fish, oysters, meats or other food products, including all products or goods sold at curb markets.
No person shall operate an open market or a marketplace within the limits of the City of Farrell without first obtaining a license from the Mayor of the City of Farrell to operate the same.

The annual license fee shall be as established by resolution from time to time by City Council to be paid annually on or before the first day of June, which license fee shall be paid by the operator, owner or lessor of said open market or open marketplace.
All food products sold at such market or markets shall comply with the Pure Food Acts of the Commonwealth of Pennsylvania as to their quality, measure, contents, wrapping and preservation of same.
No person, persons, firms, partnerships or corporations hiring space in said markets shall be permitted to occupy any space on any lot, place, tent, shed, ground or parcel of land within five feet from the walk.

All person or persons, firms, partnerships or corporations hiring a space at such open market or open market place or places operated by an individual or individuals, firms, partnerships or corporations shall first be required to obtain a license from the Mayor to sell their goods at such open market, which license fee shall be as established from time to time by resolution of City Council.
No hucksters or peddlers shall be permitted to hire, buy or rent space at such open market or marketplace unless such huckster or hucksters or peddlers shall first obtain an annual license and pay the annual license fee to the City of Farrell in addition to all licenses or charges provided for in this article.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000, plus costs, or to a term of imprisonment not to exceed 90 days, or both. Each day that a violation continues shall constitute a separate offense.
