After the passage of this article, it shall be unlawful for any person, firm or corporation to sell, or offer for sale, used wearing apparel and miscellaneous merchandise without first obtaining from the City Clerk a license therefor; nonresidents being ineligible to apply and providing penalties for violation thereof.
Application for license shall be made to the City Clerk upon suitable form to be provided by said City Clerk, setting forth:
A. 
The nature of articles of wearing apparel and miscellaneous merchandise to be sold.
B. 
The name and address of the person or persons who are conducting the sale.
C. 
The reason for desiring a license for the sale of goods.
D. 
Setting forth from whom the goods being sold were obtained.
No license shall be granted under this article for a longer period than one day (Sundays and holidays excepted) at any one location.
No person, firm or corporation holding a license shall conduct thereunder a sale at any other place or places than that designated therein.

The applicant, upon being granted a license, shall pay to the City Clerk, for the use of the City of Farrell, a license fee as established from time to time by resolution of City Council.
The provisions under this article shall not, however, apply to judicial sales, or sales by executors or administrators, nor to sales of unredeemed pledges by or in behalf of licensed pawnbrokers in the manner prescribed by law, nor to the sale of farm products, farming implements, livestock, household goods sold from private homes, real estate, machinery and equipment, nor to personal property nor in the general line of merchandise.
In the event that said sale is being conducted by an organized charitable organization with the proceeds going to the use of said charity, then in that event the City Clerk is authorized to waive the provisions requiring the payment of a fee.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000, plus costs, or to a term of imprisonment not to exceed 90 days, or both. Each day that a violation continues shall constitute a separate offense.
