This Part shall be known and may be cited as
the "Traffic Law of the Town of Yorktown."
A.
Within their context words used herein shall have
the same meaning as defined in the Vehicle and Traffic Law of the
State of New York in force and effect from time to time.
B.
Streets, avenues, roads and highways as used in this
Part 1 shall mean streets, avenues, roads and highways within the
Town of Yorktown, excepting state highways.
C.
Directions as used in this Part 1 are not true compass
bearings. For simplicity, it is assumed that the lines of the Consolidated
Edison Power Lines run approximately north and south.
D.
Whenever hours are stated, they shall mean Eastern
standard time or Eastern daylight time, whichever is in force and
effect at the time.
The provisions of this article with respect
to parking shall not apply to the agents or employees of public service
corporations engaged in the erection of poles, the stringing of wires
or the repair, construction or inspection of lines, conduits or other
structures along or under any street, avenue, road or highway or persons
lawfully engaged in construction, reconstruction or repair of any
street, avenue, road or highway.
Except in the case of an emergency or in compliance
with the directions of a peace officer or traffic control sign, the
following shall govern the parking of vehicles on the public highways
of the Town of Yorktown:
A.
No parking. Parking shall be prohibited at all times
on the following streets or portions thereof as stated:
Allan Avenue, north side from NYSEG Pole No.
8 to its intersection with White Birch Drive; south side from NYSEG
Pole No. 12 to the fire hydrant at 1995 Allan Avenue (Section 10.1,

a period in excess of two hours on the following streets, areas or

No vehicle shall be parked, stored or left standing
on any town street or highway at any time between the hours of 1:00
a.m. and 7:00 a.m. during the period from the 20th of November to
the 20th day of April in each year. The provisions of this subsection
shall not apply to the parking of an ambulance or to a vehicle operated
by a physician or surgeon on a professional call. Additionally, due
to egregious parking deficiencies and the absence of any significant
safety concerns or obstacles to snow removal, parking may take place
within the following streets during the above-described period subject
to impacts from snow removal operations:

Parking shall be prohibited on weekends and holidays
during pool season between the hours of 10:00 a.m. and 8:00 p.m. on
the south sides of Upland Road, Burgess Road, Friends Road, except

Street and Longvue Street.

Parking shall be prohibited on the semicircular interior
driveway in front of Town Hall from the point of its easterly intersection
with Underhill Avenue to the point of its westerly intersection with
Underhill Avenue. The provisions of this subsection shall not apply:
(1)
To the exterior (Town Hall side) portion of said interior
driveway between the hours of 9:00 a.m. and 4:30 p.m. only, wherein
15 minute parking shall be permitted;
(2)
To police officers on official police business; and
(3)
To handicapped persons who have been issued a handicapped
parking permit pursuant to Vehicle and Traffic Law § 1203-a.

G.
Handicapped parking.

The Town Board of the Town of Yorktown finds and determines
that it is in the best interests of the residents of the Town of Yorktown
to grant certain parking privileges to physically handicapped persons
pursuant to § 1203-a of the Vehicle and Traffic Law of the
State of New York.
(2)
The Town Clerk of the Town of Yorktown is hereby appointed
the issuing agent for the Town of Yorktown with respect to the handicapped
parking permits herein provided for. Such permits shall be issued
to all eligible local residents who apply for one.
(3)
There is hereby adopted by the Town Board of the Town
of Yorktown, for the purpose of determining eligibility requirements
for handicapped parking permits the guidelines and application form
promulgated by the State of New York Office of Advocate for the Disabled
for such purpose as amended. Copies of said guidelines shall be on
file in the office of the Clerk of the Town of Yorktown and the same
are hereby adopted and incorporated as fully as if set out at length
herein, and from the date on which this section shall take effect,
the provisions thereof shall be controlling within the limits of the
Town of Yorktown.
(4)
The permit issued hereunder shall authorize the holder
thereof to park the motor vehicle for which the permit was issued
in those areas designated to be available for such purpose to physically
handicapped persons.
(5)
No person shall stop, stand or park a vehicle in any
area designated as a place for handicapped parking, unless the vehicle
bears a permit issued pursuant to this section.

Town Hall parking. No vehicle shall be parked, stored
or left standing in the parking lots to the south and west of the
Yorktown Town Hall on Mondays through Fridays between the hours of
8:30 a.m. and 5:30 p.m., except for vehicles being utilized by persons,
including, but not limited to, employees of the Town of Yorktown,
actually engaged in the transaction of business in the Yorktown Town
Hall building.

Parking of commercial vehicles.
(1)
"Commercial vehicle" defined.

It shall be unlawful to park a commercial vehicle,
including trailers with or without trailer registration plates, in
any public street between the hours of 7:00 p.m. and 7:00 a.m. of
any day, unless said vehicle is engaged in the process of delivery
or rendition of services to premises in the immediate vicinity thereof.

It shall be unlawful to park a commercial vehicle,
including trailers with or without trailer registration plates, in
a residential area between the hours of 7:00 a.m. and 7:00 p.m. of
any day, in excess of two hours, unless said vehicle is engaged in
the process of delivery or rendition of services to the premises in
the immediate vicinity.

It shall be unlawful to perform maintenance on, wash
or vacuum a commercial vehicle parked in any public street located
in a residential area.[3]

Any person convicted of having violated or disobeyed
any provision of this subsection shall be punished by a fine of not
more than $100. Each day or fraction thereof on which any such violation
occurs or continues may be separately charged as a separate and distinct
violation for the purpose of punishment.

It shall be the duty of the Town Police Department, as well as the duly appointed Building Inspector and his or her agents, to enforce the provisions of this subsection and all rules, conditions and requirements adopted or specified thereto. The Police Department is authorized to have vehicles which are in violation of any of the provisions of this subsection towed away at the expense of the owner or operator of the vehicle, and the towing fee shall be paid by such owner or operator in addition to the fine prescribed in Subsection J(5) hereof. The Town Board of the Town of Yorktown finds and determines combat-wounded
service members have made great sacrifices which often go unrecognized.
Such wounded warriors often require assistance in transitioning back
into civilian life. Yorktown is proud to say that so many wounded
veterans have made Yorktown their home. Therefore, to honor such men
and women who have selflessly served their country, the Town will
designate certain parking spaces on the Town's public highways as
Purple Heart Parking to grant certain parking privileges to combat-wounded
veterans.
(2)
The Town Clerk of the Town of Yorktown is hereby appointed the issuing
agent for the Town of Yorktown with respect to the Purple Heart parking
permits. Such permits shall be issued at no cost to all eligible local
residents who provide to the Clerk either DD Form 214 or DD Form 215
duly issued by the United States Department of Defense.

The Purple Heart parking permit issued hereunder shall authorize
the holder thereof to park the motor vehicle for which the permit
was issued in those areas specifically designated for Purple Heart
recipients.
(4)
No person shall stop, stand or park a vehicle in any area designated
as Purple Heart parking, unless the vehicle bears a permit issued
pursuant to this section.

Every driver of a vehicle approaching a yield sign at the intersection of a main artery of travel designated in § 275-5 of this Part 1 shall slow down to a reasonable speed for existing conditions, or shall come to a full stop if necessary as, provided in Subdivision (b) of § 1172 of the Vehicle and Traffic Law, and shall yield the right-of-way to pedestrians and other vehicles as provided in Subdivision (b) of § 1142 of the Vehicle and Traffic Law, unless otherwise directed by a peace officer.

Except as expressly permitted by the United
States or the New York State Department of Transportation, and except
where the requirement for local delivery will permit no alternate
legal route, no person shall operate or move or cause or knowingly
permit to be operated or moved on any public street in the Town of
Yorktown any vehicle or combination of vehicles of a size or weight
exceeding the limitations provided for in this section.
A.
Width.
(1)
The width of a vehicle, inclusive of load, shall be
not more than 96 inches plus safety devices, on any Town highway in
the Town of Yorktown.
(2)
The provisions of Subsection A(1) shall not apply to vehicles and implements or combinations thereof, not over 13 feet in width, used solely for farm purposes, during the period from sunrise to sunset, provided at least two red flags not smaller than 24 inches square be displayed on the left front and rear of each vehicle or implement or combination thereof in such manner as to be clearly visible from the front and rear for a distance of at least 500 feet. However, no such vehicles, implements or combinations thereof shall be operated on any highway after 10:00 a.m. on any Saturday, Sunday or legal holiday, except for trips of two miles or less.
(3)
The provisions of Subsection A(1) shall not apply to omnibuses or buses used solely for the transportation of children to and from school, but the width of such omnibuses shall not exceed 98 inches.
(4)
Notwithstanding the provisions of Subsection A(1), racks for carrying hay, straw or unthreshed grain may have a width of 10 feet at top of the rack. In no case shall the width at the base of the rack exceed 102 inches, nor shall the width of a rack exceed 102 inches at any portion thereof while on any Town highway.
B.
The height of a vehicle from under side of tire to
top of vehicle, inclusive of load, shall be not more than 13 1/2
feet. Any damage to highways, bridges or highway structures resulting
from the use of a vehicle exceeding 13 feet in height where such excess
height is the proximate cause of the accident shall be compensated
for by the owner and operator of such vehicle.
C.
Length.
(1)
The length of a single vehicle, inclusive of load
and bumpers, shall not be more than 40 feet unless otherwise provided
in this subsection.

(2)
The length of a semitrailer or trailer shall not exceed
48 feet, except as provided in this subsection; provided, however,
that the length of any trailer or semitrailer being operated in combination
with another trailer or semitrailer shall not exceed 28 1/2 feet.

(3)
The length of buses having a carrying capacity of
more than seven passengers shall not exceed 45 feet, except that the
length of articulated buses shall not exceed 62 feet.

The provisions of this subsection shall not apply
to fire vehicles.
(5)
Any semitrailer with a length in excess of 48 feet
but not exceeding 53 feet may be operated on any qualifying highway
or specifically designated access highway if the distance between
the kingpin of the semitrailer and the center line of the rear axle
or rear axle group does not exceed 41 feet and if the semitrailer
is equipped with a rear-end protective device of substantial construction
consisting of a continuous lateral beam extending to within four inches
of the lateral extremities of the semitrailer and located not more
than 22 inches from the surface as measured with the vehicle empty
and on a level surface.

D.
Total length.
(1)
The total length of a combination of vehicles, inclusive
of load and bumpers, shall be not more than 65 feet unless otherwise
provided in this subsection.

(2)
The provisions of Subsection D(1) shall not apply to:
(a)
Vehicles of a corporation which is subject to
the jurisdiction of the interstate commerce commission, the public
service commission or other regulatory body and which are used in
the construction, reconstruction, repair or maintenance of its property
or facilities, provided that any such vehicle complies with the safety
requirements of the laws and regulations of the United States and
of New York State pertaining to over length vehicles;
(b)
Vehicles hauling poles, girders, columns or
other similar objects of excess length, provided that any such vehicle
complies with the safety requirements of the laws and regulations
of the United States and of New York State pertaining to such over
length vehicles;
(c)
Fire vehicles; and
(d)
Any vehicle or combination of vehicles which
is disabled and unable to proceed under its own power and is being
towed for a distance not in excess of 10 miles for the purpose of
repairs or removal from the highway.
(e)
Stinger-steered automobile transporters, while
operating on qualifying or access highways. Such vehicles shall not,
however, exceed 75 feet exclusive of an overhang of not more than
three feet on the front and four feet on the rear of the vehicle.

E.
In determining the number of wheels and axles on any
vehicle or combination of vehicles within the meaning of this section,
only two wheels shall be counted for each axle, and axles which are
less than 46 inches apart, from center to center, shall be counted
as one axle. However, in the case of multiple tires or multiple wheels,
the sum of the widths of all the tires on a wheel or combination of
wheels shall be taken in determining tire width.
F.
Subject to the provisions of this § 275-11 governing maximum vehicle gross weights:
(1)
The weight per inch width of tire on any one wheel
of a single vehicle or a combination of vehicles equipped with pneumatic
tires, when loaded, shall be not more than 800 pounds.
(2)
The weight on any one wheel of a single vehicle or
a combination of vehicles, equipped with pneumatic tires, when loaded,
shall be not more than 11,200 pounds.
(3)
The weight on any one axle of a single vehicle equipped
with pneumatic tires, when loaded, shall be not more than 22,400 pounds.
(4)
The weight on any two consecutive axles of a single vehicle or a combination of vehicles equipped with pneumatic tires, when loaded, and when such axles are spaced less than eight feet from center to center, shall be not more than 36,000 pounds, except where axles are spaced eight feet or greater, but less than 10 feet, the weight on those two axles shall not exceed that permitted by Subsection G(2), and, in addition, shall not exceed 40,000 pounds. Axles to be counted as provided in Subsection E of this section.
(5)
A single vehicle, or a combination of vehicles having
three axles or more and equipped with pneumatic tires, when loaded,
may have a total weight on all axles not to exceed 34,000 pounds,
plus 1,000 pounds for each foot and major fraction of a foot of the
distance from the center of the foremost axles to the center of the
rearmost axle.
G.
Axles are to be counted as provided in Subsection F of this section. In no case, however, shall the total weight exceed 80,000 pounds. For any vehicles or combination of vehicles having a total gross weight less than 71,000 pounds, the higher of the following shall apply:
(1)
The total weight on all axles shall not exceed 34,000
pounds, plus 1,000 pounds for each foot and major fraction of a foot
of the distance from the center of the foremost axle to the center
of the rearmost axle; or
(2)
The overall gross weight on a group of two or more
consecutive axles shall not exceed the weight produced by application
of the following formula:
W = 500 ((L XN)/(N-1)+(12XN)+36)
where W equals overall gross weight on any group of two or more consecutive axles to the nearest five hundred pounds, L equals distance in feet from the center of the foremost axle to the center of the rearmost axle of any group of two or more consecutive axles and N equals the number of axles in the group under consideration, except that two consecutive sets of tandem axles may carry a gross load not to exceed 34,000 pounds, provided that the overall distance between the first and last axles of such consecutive sets of tandem axles is 36 feet or more. For any vehicle or combination of vehicles having a total gross weight of 71,000 pounds or greater, this subsection shall apply to determine maximum gross weight which is permitted hereunder, subject to the provisions of this § 275-11 governing maximum vehicle gross weights.

H.
No vehicle shall be operated on the public streets
of the Town of Yorktown other than on pneumatic tires.
I.
For the purpose of this section, the width of pneumatic
tires shall be ascertained by measuring the greatest width of the
tire casing when tire is inflated.
J.
No person shall operate or move a vehicle or a combination
of vehicles over, on or through any bridge or structure on any highway
if the weight of such vehicle, or combination of vehicles, and load,
is greater than the posted capacity of the structure, or exceeds the
height of the posted clearance as shown by an official sign.
K.
If a vehicle or combination of vehicles is operated
in violation of this section, an appearance ticket or summons may
be issued to the registrant of the vehicle, or, if a combination of
vehicles, to the registrant of the hauling vehicle, rather than the
operator. In the event the vehicle is operated by a person other than
the registrant, any appearance ticket or summons issued to the registrant
shall be served upon the operator, who shall be deemed the agent of
the registrant only for the purpose of receiving such appearance ticket
or summons. In addition, a notice containing all pertinent information
relating to the charge which is contained on the summons or appearance
ticket shall be mailed by or on behalf of the person who issued the
appearance ticket or summons to the registrant at the address given
on the registration certificate for the vehicle, or if no registration
certificate is produced at the time the appearance ticket or summons
is issued to the address of the registrant on file with the department
within five days after the date of issuance of the appearance ticket
or summons, but at least five days before the return date specified
on the appearance ticket or summons. Proof of mailing to the registrant
under this section shall be filed with the court in which the appearance
ticket or summons is returnable on or before the return date. The
provisions of this subdivision shall not apply to owner-operators
of any motor vehicle or to any motor vehicle or trailer which is registered
in the name of a person whose principal business is the lease or rental
of motor vehicles or trailers unless the motor vehicle or trailer
is being operated by an employee of the registrant or for a community
of interest other than the lease or rental agreement between the parties
to the lease or rental agreement.
L.
In any case wherein the charge laid before the court
alleges a violation of this section, any plea of guilty thereafter
entered in satisfaction of such charge must include at least a plea
of guilty to a violation of one of the subdivisions of this section.
No other disposition by plea of guilty to any other charge in satisfaction
of such shall be authorized; provided, however, that if the prosecuting
attorney, upon reviewing the available evidence, determines that the
charge of a violation of this section is not warranted, he may consent,
and the court may allow, a disposition by plea of guilty to that or
another charge in satisfaction of such charge; provided, however,
that the court must impose at least the minimum fine as authorized
in this section for the offense.
Any vehicle parked or abandoned on a public
highway in the Town of Yorktown during a snowstorm, flood, fire or
other public emergency which affects that portion of the public highway
upon which said vehicle is parked or abandoned may be removed by or
under the direction of the Chief of Police or the Superintendent of
Highways and stored in any suitable place. The Chief of Police and
the Superintendent of Highways are authorized to use Town equipment,
if available, and if not are authorized to lease from others tow trucks
and other necessary equipment required for such purpose. Such vehicles
shall be released only to the owner or his duly authorized agent upon
the production of proof of ownership satisfactory to the Town Attorney
and upon payment of the reasonable expenses and charges for such removal
or storage. Charges for such removal shall not exceed $25 and storage
charges shall not exceed $5 per day. A report of the removal and the
disposition of such vehicle shall be made to the Police Department,
and it shall be the duty of the Police Department to ascertain and
to notify him of the removal and disposition of such vehicle and of
the amount which will be required to redeem the same. The reasonable
charges for the use and rental of Town equipment and the equipment
of others shall be paid to the Town Clerk by the owner or his agent
and shall be deposited to the credit of the appropriate Town account.
The system of pavement markings duly adopted
for New York State highways is hereby adopted for all public highways
in the Town of Yorktown.

A.
The system of traffic control devices duly adopted
for New York State highways is hereby adopted for all public highways
in the Town of Yorktown.
B.
Every person shall obey the instructions of any official
traffic-control device applicable to him placed in accordance with
the provisions of this Part 1, unless otherwise directed by a traffic
or police officer, subject to the exceptions granted the driver of
an authorized emergency vehicle.
A.
No motor vehicles, motorcycle or other vehicle of
any description whatever shall be run, driven or operated upon Town
highways within the Town of Yorktown at a rate of speed greater than
30 miles per hour, except on the following Town highway, the speed
limit shall be 40 miles per hour.

Intent. It is the intent of this subsection to provide improved compliance
with the speeding limitations at or near entrances to schools within
the Town.
(2)
The Town hereby designates school zones at the schools listed in Subsection D(3) below. The school zones shall be in effect on school days between 7:00 a.m. and 6:00 p.m., unless otherwise stated. Unless otherwise posted, the speed limit in such school zones is established at 15 miles per hour for a distance of 300 feet in either direction from the building line of the schools. Any violation of the posted speed limit within the times indicated will result in a doubling of the otherwise applicable fine.

Unlawful speed contest.

(1)
This subsection shall be known and may be cited as the "Yorktown
Drag Racing Law."
(2)
No person shall participate in an unlawful speed contest in or upon
any public street, highway, or place within the Town of Yorktown.
An unlawful speed contest is defined as the operation of two or more
vehicles from a point side by side at accelerating speeds in a competitive
attempt to outdistance each other, or the operation of one or more
vehicles over a common selected course from the same point to the
same point wherein timing is made of the participating vehicles involving
competitive accelerations or speeds. The operation of two or more
vehicles side by side, either at speeds in excess of permitted speeds
on any public street, highway, or place within the Town or rapidly
accelerating from a common starting point to a speed in excess of
such permitted speeds, shall be prima facie evidence of an unlawful
speed contest.
(3)
Notwithstanding anything to the contrary in this chapter, a violation
of any of the provisions of this section shall be punishable by a
fine of not less than $1,000 nor more than $5,000.
A.
Any person violating any provisions of this chapter
relating to parking shall be guilty of a traffic infraction and shall
be punished by a fine as follows:

B.
Any person violating any provisions of this chapter
relating to full stop signs and yield signs shall be guilty of a traffic
infraction and shall, for a first conviction thereof, be punished
by a fine of not more than $100 or by imprisonment for not more than
15 days or by both such fine and imprisonment; for a conviction of
a second violation, both of which were committed within a period of
18 months, such person shall be punished by a fine of not more than
$200 or by imprisonment for not more than 45 days or by both such
fine and imprisonment; and for a conviction of a third or subsequent
violation, all of which were committed within a period of 18 months,
such person shall be punished by a fine of not more than $300 or by
imprisonment for not more than 90 days or by both such fine and imprisonment.
C.
Weight and dimensions.

(1)
The violation of the provisions of §§ 275-11A and 275-13 of this Part 1 shall be punishable by a fine of not less than $200 nor more than $500, or by imprisonment for not more than 30 days, or by both such fine and imprisonment, for the first offense; by a fine of not less than $500 nor more than $1,000, or by imprisonment for not more than 60 days, or by both such fine and imprisonment, for the second or subsequent offense, in both cases plus the fine provided in Subsection C(2).

(2)
A violation of the provisions of § 275-13F(5) of this Part 1 by any vehicle or combination of vehicles whose weight exceeds the weight limitations as set forth in either of such sections, or the weight limitations specified by a permit issued by the United States or New York State Department of Transportation, shall be punishable by fines levied on the registered owner of the vehicle or vehicles, whether at the time of the violation the vehicle was in the charge of the registered owner, or his agent or lessee in accordance with the following schedule [in addition to the fines as prescribed in Subsection C(1)]:

(4)
In connection with the weighing of a vehicle or combination of vehicles, if it is found that there is a violation of § 275-13F(5) and also of § 275-13F(3) and (4), or both § 275-13F(3) and (4), there shall be a single fine imposed and the maximum amount of such fine shall not exceed the highest fine that could be imposed under Subsection C(1) or this subsection.

D.
Any person violating the provisions of this article
relating to the speed of a motor vehicle shall be guilty of a traffic
violation.
(1)
Every person convicted of a traffic speed violation
shall be punished as follows:
(a)
Where the court records or enters that the speed
upon which the conviction was based exceeded the applicable speed
limit by not more than 10 miles per hour, by a fine of not less than
$30 nor more than $100;
(b)
Where the court records or enters that the speed
upon which the conviction was based exceeded the applicable speed
limit by more than ten miles per hour but not more than 30 miles per
hour, by a fine of not less than $60 nor more than $200 or by imprisonment
for not more than 15 days or by both such fine and imprisonment; and
(c)
Where the court records or enters that the speed
upon which the conviction was based exceeded the applicable speed
limit by more than 30 miles per hour, by a fine of not less than $120
nor more than $400 or by imprisonment for not more than 30 days or
by both such fine and imprisonment.
(2)
Notwithstanding the foregoing provisions of this subsection,
the maximum fine provided herein for the violation for which the person
is sentenced may be increased by an additional $100 if the conviction
is for a second violation of any subsection of this section where
both violations were committed within an 18 month period, and the
maximum fine provided herein for the violation for which the person
is sentenced may be increased by an additional $250 if the conviction
is for a third or subsequent violation of any subdivision of this
section where all such violations were committed within an 18 month
period. Where an additional fine is provided by this subsection, a
sentence of imprisonment for not more than 30 days may be imposed,
in place of, or in addition to, any fine imposed.
E.
Any person violating any provision of this article
relating to traffic control devices shall be guilty of a traffic violation
and shall, for a first conviction thereof, be punished by a fine of
not less than $50 nor more than $150 or by imprisonment for not more
than 15 days or by both such fine and imprisonment; for a conviction
of a second violation, both of which were committed within a period
of 18 months, such person shall be punished by a fine of not less
than $100 nor more than $250 or by imprisonment for not more than
45 days, or by both such fine and imprisonment; and for a conviction
of a third or subsequent violation, all of which were committed within
a period of 18 months, such person shall be punished by a fine of
not less than $250 nor more than $450 or by imprisonment for not more
than 90 days or by both such fine and imprisonment.
F.
Any person found guilty of a traffic violation occurring
in a posted construction zone for which the fines under this section
are applicable shall be subject to a fine in an amount double the
otherwise applicable fine.

A.
The Chief of Police shall have the authority to temporarily prohibit parking of vehicles along a street or highway in the Town for up to seven consecutive days. The Chief of Police shall post signs to such effect, and it shall be unlawful for any person to park or leave unattended any vehicle in violation thereof. Penalties for violations of this provision will be imposed pursuant to § 275-18.

A.
Stop when traffic obstructed.
(1)
No operator shall enter an intersection or crosswalk
unless there is sufficient space beyond such intersection or crosswalk
in the direction in which he is proceeding to accommodate his vehicle
or street car without obstructing the passage of other vehicular traffic
or pedestrians, notwithstanding any traffic-control signal indication
to proceed.
(2)
At all intersections designated herein as "Don’t
Block The Box" intersections, the Highway Department shall, at the
discretion of the Highway Superintendent, paint stripes on the roadway
indicating the area of the intersection into which a vehicle should
not enter unless there is sufficient space beyond such area to accommodate
the vehicle without obstructing other vehicles or pedestrians. The
Highway Department shall also, at the discretion of the Highway Superintendent,
erect "Don’t Block The Box" signs at each such intersection,
which signs shall set forth the penalty for violation of this section.
