Any person, firm or corporation who shall violate any provision
of this Article
IX shall, upon conviction thereof, be sentenced to
pay a fine of not more than $300 and/or to imprisonment for a term
not to exceed 90 days. Every day that a violation of this Article
IX continues shall constitute a separate offense.
In case any building or structure is erected, constructed, reconstructed,
altered, repaired, converted or maintained or any building, structure
or land is used or any hedge, tree, shrub or other growth is maintained
in violation of this chapter or of any regulations made pursuant hereto,
in addition to other remedies provided by law, any appropriate action
or proceedings, whether by legal process or otherwise, may be instituted
or taken to prevent such unlawful erection, construction, reconstruction,
alteration, repair, conversion, maintenance or use, to restrain, correct
or abate such violation, to prevent the occupancy of said building,
structure or land, or to prevent any illegal act, conduct, business
or use in or about such premises.
The remedies provided herein are cumulative and not exclusive
and shall be in addition to any other remedies provided by law.
In interpreting and applying the provisions of this chapter,
they shall be held to be the minimum requirements for the promotion
of health, safety, morals and general welfare of the municipality.
It is not intended by the adoption of this chapter to interfere with
or abrogate or annul any rules, regulations or permits previously
adopted or issued; provided, however, that where this chapter imposes
a greater restriction upon the use of buildings or premises or upon
the height of the building or requires larger open spaces than are
imposed or required by such rules, regulations or permits, the provisions
of this chapter shall control.
The legislative body may, in accordance with procedure established
by the law, on its own initiative or on petition, supplement, change,
modify or repeal such regulations, restrictions or boundaries as set
forth in this chapter. However, no such change shall become effective
until after a public hearing in relation thereto at which parties
in interest shall have an opportunity to be heard.
