No person owning, harboring, keeping, or otherwise responsible for,
or in charge of, any dog shall cause, suffer, or allow such dog to
soil, defile, defecate or commit any nuisance on any common thoroughfare,
sidewalk, passageway, right-of-way, bypath, play area, park, or any
other public place where people walk or congregate or on any private
property other than property owned or leased by the person owning
or otherwise responsible for said dog.
The dog involved is a dog certified to assist disabled individuals,
and the person charged has a disability which prevents the individual
from removing the excrement and properly disposing of it in a sanitary
manner.
A complaint under this section may be brought by an individual or
entity authorized by the Borough or by any private complainant.
Violation of § 53-47 is punishable, upon conviction, by a fine of not less than $75 nor more than $500. Each violation of this section is a separate offense.
