Effective January 1, 1989, and thereafter, the Borough hereby
sets a rate for the collection of garbage in the amount of $84 per
year per living unit. Said fees shall be payable quarterly and in
advance; to wit, $21 shall be due on January 1, 1989, and every quarter
thereafter commencing on the first day of April, July and October
for 1989, and on the first day of each of the months aforementioned
and in all subsequent years until amended or rescinded by Council.
This article and these fees shall be applicable to residential properties
only, and the $84 annual fee is applicable and is due for each living
unit, apartment or family residence area in any building, apartment
building or boardinghome. Further, this fee shall be due and payable
whether or not garbage is collected from any house or living unit,
whether or not the same is occupied. An affidavit is requested of
the property owner or rental agent stating the property is no longer
for rent, so as not to be billed.

The following entities and persons are jointly and severally
obligated to pay said fee: any owner, landlord, tenant, rental agent
or occupant of any such living unit. The Borough shall have the right
to collect this fee against any and all of the above persons or entities
solely, singly, jointly and/or severally. Any fees, penalties, interest
or any other charges may be liened against the real property by in
rem or in personam proceedings.
The collector of fees prescribed herein is hereby designated
as the Turtle Creek Council of Governments, which shall be entitled
to receive the sum of $1 plus postage for each bill forwarded. Turtle
Creek Valley Council of Governments will also be entitled to receive
for any delinquent accounts any attorneys' fees or penalty due because
of delinquency.
All fees due herein shall be due and payable the first of the
month of the quarter as set forth herein above in § 55-1.
Mailing by the collector of a bill for this fee shall be conclusive
proof that a demand was made for the amount set forth in the collector's
records on the date of the mailing. All sums claimed in said notice
by the collector shall be delinquent if not paid within 30 days following
the date of the mailing by the collector. Commencing on the 31st day,
there shall be due a penalty of 10%, an attorney's fee of 5%
and simple interest calculated from that day forward in the amount
of 6% per annum. The collector may properly demand payment of said
fees by regular mail, postage prepaid.

This Article
I, including the rates, amounts, collection fees,
identity of the collector and such similar provisions may be amended
by ordinance, duly enacted, at any regular or special meeting.
