There is hereby established the Millvale Borough Planning Commission under the provisions of the Pennsylvania Municipalities Planning Code, Act 247 of July 31, 1968 as amended.[1]

A. 
The Planning Commission shall consist of five members, all of whom shall be citizens of the Borough of Millvale, County of Allegheny and Commonwealth of Pennsylvania. The members of the Planning Commission shall serve without compensation.
B. 
All members of the Commission shall be appointed by Borough Council. The term of each of the members of the Commission shall be for four years or until a successor is appointed, except that the terms of the members first appointed shall be so fixed so that no more than two members shall be reappointed or replaced during any future calendar year. In the event of vacancies, the Chairman of the Planning Commission shall promptly notify Borough Council concerning the vacancies, and such vacancy shall be filled for the unexpired term.

The Planning Commission shall have all the powers and duties conferred and imposed upon it as set forth in the Pennsylvania Municipalities Planning Code, established by the Act of July 31, 1968, P.L. 805, No. 247, as amended and reenacted (53 P.S. § 10101 et seq.).[1]

B. 
In the performance of its powers and duties, any act or recommendation of the Planning Commission which involves engineering considerations, shall be subject to review and comments of the Borough Engineer, which shall be incorporated and separately set forth in any report, written act or recommendation of the Planning Commission.
The Planning Commission may, with the consent of Borough Council, accept and utilize any funds, personnel or other assistance made available by the county, the commonwealth, or the federal government, or any of their agencies, or from private sources. The Borough Council may enter into agreements or contracts regarding the acceptance or utilization of the funds or assistance in accordance with the governmental procedures of the Borough.
The Planning Commission shall be conducted pursuant to said Pennsylvania Municipalities Planning Code[1] and unless expressly provided otherwise in this chapter, the provisions of said Act shall govern.
