As used in this article, the following terms shall have the meanings indicated:
DRAINAGE SYSTEM
The piping within public or private premises which conveys sewage or other liquid waste to the East Lampeter Township sewerage system.
ELSA
East Lampeter Sewer Authority.
GREASE INTERCEPTOR
A receptacle designed to separate and retain oils, grease and fatty substances from wastes normally discharged.
OIL/WATER SEPARATOR
A receptacle designed to separate and retain oils (hydrocarbons) from wastes normally discharged.
OWNER
Any person, corporation, partnership, or other entity or entities vested with ownership, legal or equitable, sole or partial, or the operating tenant or lessee of any establishment listed in this article that discharges into the sewage system waste containing oils, fats, grease, sand, grit, heavy settleable solids or other flammable and deleterious materials.
SAND INTERCEPTOR
A receptacle designed to separate and retain sand, grit or heavy settleable solids from wastes normally discharged.
TOWNSHIP
East Lampeter Township, Lancaster County, Pennsylvania, or duly constituted and elected municipal authorities thereof.
A sand and/or grease interceptor and/or oil/water separator shall be installed in a wastewater drainage system whenever, in the opinion of the Enforcement Officer, a hazard may exist from the careless disposal of waste material containing oils, fats, grease, sand, grit, heavy settleable solids and other flammable and deleterious materials.
A. 
A sand interceptor and/or oil/water separator shall be installed in the drainage system of the following establishments: automobile service and repair facilities, garages or establishments where vehicles are washed or gasoline stored, dry cleaners using flammable solvents, aniline plants, tanneries, paint and varnish manufacturing plants, printing ink plants, shoe-polish plants, explosive plants, soap plants, cleaning fluid manufacturing plants, testing laboratories, or any place of manufacture where volatile flammable liquid is used and which, by accident or otherwise, may be admitted into the sewerage system.
B. 
A grease interceptor shall be installed in the waste line leading from sinks, drains or other fixtures when required by the Enforcement Officer and at all times in the following establishments: restaurants, hotel kitchens and bars, factory cafeterias or restaurants, bakeries, candy makers, fire companies, clubs or other establishments with food preparation or kitchen facilities where oils, grease and fats may be introduced into drainage systems in quantities that may cause buildup in the lines, line stoppage, or otherwise hinder or have an adverse effect on efficient sewage disposal.
C. 
The Enforcement Officer, in addition to the other powers set forth in this article, shall have the authority to exempt (with or without conditions) from the requirements of this article existing establishments which now contain a functioning grease and/or sand interceptor and/or oil/water separator which, after inspection, the Enforcement Officer determines is being effectively maintained and operated so as to prevent fats, grease, oils, sand, grit or heavy settleable solids from being deposited into the sewerage system of East Lampeter Township. Said exemption shall apply for only so long as the Enforcement Officer determines that said existing facilities are functioning properly and are being properly maintained and cleaned. The Enforcement Officer shall have the authority to require any owner to present a written certificate or other evidence acceptable to the Enforcement Officer of regular periodic cleaning of the system if he/she, in his/her discretion, deems that a problem may exist.
Sand interceptors shall be installed in addition to grease interceptors in any of the establishments referenced in the immediately preceding section that also discharge into the sewerage system of the Township liquid wastes containing sand, grit or heavy settleable solids.
A. 
A grease interceptor shall be constructed in accordance with ELSA specifications, as amended from time to time.
B. 
A sand interceptor shall consist of a single or multistage vented interceptor baffled or fitted with flow directing pipes and having suitable solid storage for adequate containment between cleanings.
C. 
An oil/water separator shall consist of a single or multistate interceptor specifically designed to separate oils (hydrocarbons) from the wastes normally discharged and having suitable oil (hydrocarbon) storage for adequate containment between cleanings.
A. 
The design, size and capacity of grease interceptors shall be in accordance with ELSA specifications, as amended from time to time.
B. 
The design, size and capacity of sand interceptors and oil/water separators shall be based on the expected amount of solids, wastes, and/or oils to be retained and the frequency between anticipated cleanings.
All grease and sand interceptors and oil/water separators shall be constructed of impervious materials capable of withstanding abrupt and extreme changes in temperature. The interceptors and separators shall be of substantial construction, watertight, and equipped with easily removable covers. The interceptors' and separators' outlets shall be oversized or vented to prevent siphonage of tank contents.
All drawings, sketches, catalog information showing locations, dimensional sizes, distances, construction materials and any other pertinent information, along with sizing calculations of all proposed interceptors and separators, must be submitted to the Township for its review and approval before any interceptor or separator may be installed.
The Township Public Works Director, or his/her designee, is hereby designated as the Enforcement Officer for the enforcement of the terms, conditions and restrictions of this article, is hereby clothed with police power when acting in such regard, and is authorized to bring prosecutions for any violations of this article on behalf of the Supervisors of the Township and to bring, in the name of the Township, any action at law or equity to compel compliance with this article, and to enjoin or abate any prohibited conduct under this article. The Township from time to time may, by resolution or motion, add, delete or change the person designated as Enforcement Officer.
The Enforcement Officer shall have the following additional authority and responsibility:
A. 
To inspect the installation of all grease and sand interceptors and oil/water separators to be installed or reinstalled pursuant to the preceding sections.
B. 
To prosecute any violations of the terms and conditions of this article or any rules and regulations adopted pursuant to this article.
C. 
To promulgate rules and regulations for the maintenance and operation of sand and grease interceptors and oil/water separators under this article which rules and regulations shall become effective when presented to and approved by motion of the Supervisors of the Township at any regularly scheduled meeting.
D. 
To enter, from time to time, any premises containing any sand and/or grease interceptor and/or oil/water separator with or without a warrant to ensure compliance with this article.
All owners who are required under this article to install sand and/or grease interceptors and/or oil/water separators shall be totally responsible for the maintenance, upkeep, repair, replacement and operation of said interceptor(s) and separator(s) and shall keep the same in good operation and repair and shall be responsible or liable for any loss or damage occurring from any failure to operate, maintain and replace when needed said interceptor(s) and separator(s).
Any owners failing to comply with any provision of this article shall be guilty of a summary offense and shall be subject to a fine or penalty not exceeding $500 per day, which fine may be collected by suit or by summary proceedings brought in the name of the Township before any Magisterial District Judge or by such other civil action in law or equity as may be deemed advisable by the Township.
A. 
Any prior ordinance inconsistent with this article is hereby deemed repealed, but only to the extent of such inconsistency.
B. 
The provisions of this article are declared to be severable. If any provision of this article is declared by a court of competent jurisdiction to be invalid or unconstitutional, such determination shall have no effect on the remaining provisions of this article.
C. 
This article shall be effective five days following its enactment.
