Susquehanna Township hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act 45 of 1999, 35 P.S. § 87-210.101 through 87-210.1103, as amended from time to time, and its regulations.

The Township of Susquehanna hereby adopts, for purposes of establishing rules and regulations for the construction, alteration, equipment, fire protection and safety of buildings and structures, including administration, building permit and penalties and the building code, the 2003 International Building Code, adopted as a referenced standard by the Uniform Construction Code (UCC), amended as follows:
101.
The 2003 International Building Code, adopted as a referenced standard by the Uniform Construction Code (UCC), is hereby amended as follows:
101.1.
Section 1612.3 is amended to insert "Susquehanna Township" and "April 15, 1977."
101.2.
Section 1805.2.1.1 shall be deleted and replaced with the following text:
"1805.2.1.1 Frost Protection extending below the frost line of Susquehanna Township, which shall extend a minimum of 36 inches in depth, measured from the bottom of the footing to the surface."
101.3.
Section 3410.2 shall be amended by inserting "March 20, 1950" as the date that building codes first became effective in Susquehanna Township.
102.
The 2003 International Residential Code for one- and two-family dwellings, adopted as a referenced standard by the Uniform Construction Code (UCC), is hereby amended as follows:
102.1.
Section 101.1, Title, is amended to insert "Susquehanna Township."
102.2.
Table 301.2(1) is amended to insert the appropriate climatic and geographic design criteria as follows:
Ground Snow Load = 30 psf
Wind Speed = 90 mph
Seismic Design Category = B
Weathering of Concrete Probability = Severe
Front Line Depth = 36 inches
Termite Probability = Moderate to heavy
Decay Probability = Slight to moderate
Winter Design Temperature = 10° F.
Ice Shield Underlayment Required = Yes
Flood Hazards = Consult 04-15-77 FIRM AND FBFM
Air Freezing Index = 784
Mean Annual Temperature = 53.1° F.
102.3.
Section P2603.6.2 shall be amended to read:
"Building sewers that connect to private sewage disposal systems shall be a minimum of 36 inches below finished grade at the point of septic tank connection. Building sewers shall be a minimum of 36 inches below grade."
102.4.
Section P3103.1 shall be amended by inserting "12" as the number of inches that a vent pipe shall extend above a roof through which it penetrates, and also inserting "12" as the number of inches that a roof-penetrating vent pipe shall extend above anticipated snow accumulation.
103.
The 2003 International Plumbing Code, adopted as a referenced standard by the Uniform Construction Code (UCC), is hereby amended as follows:
103.1.
Section 101.1, Title, is amended to insert "Susquehanna Township."
103.2.
Section 106.6.2, Fee Schedule, is amended to insert "The fees for all plumbing work shall be indicated on a fee schedule adopted by resolution of the Board of Commissioners."
103.3.
Section 106.6.3, Fee Refunds, is amended by inserting "50" into the relevant space for Item #2 and "90" into the relevant space for Item #3 as the maximum percentages for refunds for fees.
103.4.
Section 108.4, Violation Penalties, shall be amended as follows: "Summary offense, punishable by a fine not exceeding $1,000 and costs. Each day that a violation of this part continues shall constitute a separate offense."
103.5.
Section 108.5, Stop Work Orders, shall be amended as follows: ". . .condition, shall be punishable by a fine not exceeding $1,000 and costs."
103.6.
Section 305.6.1, Sewer Depth, shall be amended by inserting: "36 inches below finished grade at the point of septic tank connection. Building sewers shall be a minimum of 36 inches below grade."
103.7.
Section 904.1, Roof Extension, shall be amended by inserting "12" as the number of inches that a vent pipe must extend beyond a roof through which it penetrates.
104.
The 2003 International Mechanical Code, adopted as a referenced standard by the Uniform Construction Code (UCC), is hereby amended as follows:
104.1.
Section 101.1, Title, shall be amended to insert "Susquehanna Township."
104.2.
Section 106.5.2, Fee Schedule, shall be deleted and replaced by: "The fees for mechanical work shall be indicated on a fee schedule, adopted by resolution of the Board of Commissioners."
104.3.
Section 106.5.3, Fee Refunds, shall be amended by inserting "50" into the relevant space for Item #2 and "90" into the relevant space for Item #3.
104.4.
Section 108.4, Violation Penalties, shall be amended as follows: "Summary offense, punishable by a fine not exceeding $1,000 and costs. Each day that a violation of this part continues shall constitute a separate offense."

Section 108.5, Stop Work Orders, shall be amended as follows: ". . .condition, shall be liable to a fine not exceeding $1,000 and costs."

The 2003 International Fire Code, adopted as a referenced standard by the Uniform Construction Code (UCC), is hereby amended as follows:
105.1.
Section 101.1, Title, shall be amended to insert "Susquehanna Township."
105.2.
Section 109.3, Violation Penalties, shall be amended as follows: "Summary offense, punishable by a fine not exceeding $1,000 and costs. Each day that a violation of this part continues shall constitute a separate offense."
105.3.
Section 202, General Definitions Fire Code Official, shall be amended to read: "The Township Fire Marshal, any fire company chief or assistant chief, Codes Enforcement Officer, health officer, or any police officer may be charged with the administration and enforcement of this code, or any other duly authorized representative."
105.4.
Section 506.1, Where Required, is amended by adding the following sentence at the end of this sentence: "Knox boxes shall be installed in accordance with Ordinance 99-5."
105.5.
Section 3204.3.1.1, Location, is amended by adding the following sentence at the end of this section: "The geographic limits in which the storage of flammable cryogenic fluids in stationary containers is prohibited shall be within any Zoning District depicted on the Zoning Map of Susquehanna Township except the CON, C-H, C-N, MU-1 and I-G Districts."
105.6.
Section 3404.2.9.5.1, Location, is amended by adding the following sentence at the end of this section: "The geographic limits in which the storage of Class I and Class liquids in above-ground tanks outside of buildings is prohibited shall be within any Zoning District depicted on the Zoning Map of Susquehanna Township except the CON, C-H, C-N, MU-1 and I-G Districts."
105.7.
Section 3804.2, Maximum Capacity Within Established Limits, is amended by adding the following sentence at the end of this section: "The geographic limits in which the storage of liquefied petroleum gas is restricted for the protection of heavily populated or congested areas cannot be established by Susquehanna Township because the Propane and Liquefied Petroleum Gas Act (35 P.S. §§ 1329.1-1329.19) does not permit municipalities to prohibit or regulate storage of these materials."
The following Appendixes are hereby also adopted as part of this code: Appendix B, Appendix C, Appendix E, Appendix F and Appendix G.

The 2003 International Energy Conservation Code, adopted as a referenced standard by the Uniform Construction Code (UCC), is hereby amended as follows:
106.1.
Section 101.1, Title, shall be amended to insert "Susquehanna Township."
107.
The 2003 International Existing Building Code, adopted as a referenced standard by the Uniform Construction Code (UCC), is hereby amended as follows:

Section 101.1, Title, shall be amended to insert "Susquehanna Township."
107.2.
Section 106.5.2, Fee Schedule, is deleted and replaced by: "The fees for work regulated by this code shall be as indicated on a fee schedule adopted by resolution of the Board of Commissioners."
107.3.
Section 106.5.3, Fee Refunds, is amended by inserting "50" into the relevant space for Item #2 and "90" into the relevant space for Item #3.
107.4.
Section 108.4, Violation Penalties, shall be amended as follows: "Summary offense, punishable by a fine not exceeding $1,000 and costs of prosecution. Each day that a violation continues after due notice has been served shall be deemed a separate offense," and by deleting "or by imprisonment not exceeding [number of days], or both such fine and imprisonment."
107.5.
Section 108.5, Stop Work Orders, shall be amended as follows: ". . .condition, shall be liable to pay a fine of not more than $1,000."
108.
The 2003 International Code Council Performance Code, adopted as a referenced standard by the Uniform Construction Code (UCC), is hereby amended as follows:
108.1.
Section 101.1, Title, shall be amended to insert "Susquehanna Township."
These regulations shall be known as the "Performance Code" of Susquehanna Township, hereinafter referred to as "the code."
