A. 
License. Contractors doing commercial work must obtain a license with the Township of Hamilton from the Director of Community and Economic Development. The fee for this license is set forth in Chapter 215, Fees, of the Township Code. Contractors doing work on a residential property must be licensed with the New Jersey Division of Consumer Affairs. Property owners may do their own work, however, they must obtain a permit and comply with all of the requirements regarding curb and sidewalk construction.
B. 
Permit. A curb and sidewalk permit must be obtained before any new work or repair work is done. This may be obtained from the Director of Community and Economic Development upon payment of the fee set forth in Chapter 215, Fees, of the Township Code, for new or replacement work.

Application for a permit under this article shall be made to the Director of Community and Economic Development by the owner of the premises or his agent upon forms provided by the Township and shall contain the following information:
A. 
The name and address of the applicant.
B. 
The name and address of the person who is to perform the proposed work, and the name and address of the owner of the property on which the work is to be performed, if other than the applicant.
C. 
The location, by street number or otherwise, of the premises where the work is to be done.
D. 
The estimated cost of the proposed work.
E. 
A line and grade plan showing the proposed work, including its exact location with respect to a street intersection or some other fixed and prominent object, as well as its width and relationship to the grade of the street and the adjacent property and, in the case of a driveway apron, its slope or pitch.
F. 
Any other information that the Director deems necessary in order to determine whether the work will comply with this article.
All curbs and sidewalks and repairs to them shall be installed in accordance with the Township specifications for curbing and sidewalks, which are hereby adopted. A copy of the specifications is on file in the office of the Municipal Clerk, and the specifications are incorporated in this article as though set out at length.
A. 
After curb permits have been issued by the Director of Community and Economic Development, the Township will, upon request, set the necessary stakes for curbline and grade in a reasonable length of time, depending upon the workload. Curbs will be staked out only once. If the stakes are destroyed, an additional charge will be made for restaking.

B. 
It shall be the curb contractor's or owner's responsibility to see that all grade stakes are removed upon completion of the job.

The Director of Community and Economic Development must be notified 24 hours prior to the pouring of new concrete for either curbs or sidewalks. If this notice is not received, the Township reserves the right to reject the curbs or sidewalks or revoke the license of any contractor violating this provision.
Poor workmanship by a permittee under this article will result in rejection of the work and revocation of the contractor's license.
All concrete used in curb and sidewalk work shall be protected from damage by traffic, rain, vandalism, etc. If the concrete is damaged, it will be the responsibility of the permittee to remove the damaged concrete and replace it with new concrete.

No concrete used in curb or sidewalk work is to be poured when the temperature is expected to drop below freezing. If any possibility exists of the temperature dropping below freezing, the concrete shall be protected by an adequate covering of hay or other means approved by the Director of Community and Economic Development or his representative. Any concrete left exposed to freezing temperature without approved protection must be removed and replaced.
Concrete curbing machines, if approved by the Director, may be used in work on curbs and sidewalks.
Driveway widths and location will be in accordance with the Township's typical construction details for streets.
During construction on curbs or sidewalks, barricades and warning lights must be placed to protect the public.
Construction of less than 75 linear feet of new sidewalk or curb shall not be permitted unless the construction covers the entire frontage of a building lot or will complete the installation of curbs or sidewalks for a building lot.

The Director of Community and Economic Development is authorized to order any changes in the requirements set out in this article or in the specifications because of unusual field conditions. The decision of the Director shall be final, and any changes ordered by him in the field must be complied with.

Violation of any provision of this article or failure to abide by the specifications shall be just cause for revocation of a license by the Director of Community and Economic Development. The license shall not be renewable within one year of the date of revocation thereof.
