[HISTORY: Adopted by the Township Committee of the Township

A.
There is hereby established in the Township of White a State Uniform
Construction Code enforcing agency to be known as the "White Township
Ordinance Enforcement Office," consisting of a Construction Official,
Building Subcode Official, Plumbing Subcode Official, Electrical Subcode
Official, Fire Protection Subcode Official and such other subcode
officials for such additional subcodes as the Commissioner of the
Department of Community Affairs, State of New Jersey, shall hereafter
adopt as part of the State Uniform Construction Code. The Construction
Official shall be the Chief Administrator of the enforcing agency.
B.
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such position.
C.
The public shall have the right to do business with the enforcing
agency at one office location, except for emergencies and unforeseen
or unavoidable circumstances.
A.
A fee for a construction permit shall be the sum of the subcode fees listed in Subsection A(1) through (16) hereof and shall be paid before a permit is issued.
(1)
Plan review fee. The fee for plan review shall be 20% of the amount
to be charged for the construction permit fee for the applicable subcodes.
(2)
Basic construction fee. The basic construction fee shall be the sum
of the parts computed on the basis of the volume or cost of construction,
the number of plumbing fixtures and pieces of equipment, the number
of electrical fixtures and devices and the number of sprinklers, standpipes
and heat and/or smoke detectors at the unit rates provided herein,
plus any special fees.
(3)
Building subcode fee. The building subcode fee shall be:
(a)
New construction fees: $0.035 per cubic foot of volume for all
use groups, provided that the minimum fee shall be $60; except that
the minimum fee for Use Groups A-1, A-2, A-3, A-4, F-1, S-1 and S-2
shall be $100; and the fee shall be $0.001 per cubic foot of volume
for structures on farms, including commercial farm buildings under
N.J.A.C. 5:23-3.2(d), used exclusively for the storage of food or
grain, or the sheltering of livestock, with the maximum fee for such
structures on farms not to exceed $750, provided that the minimum
fee shall be $60.

(b)
Renovations, alterations and repairs fees. Fees for renovations,
alterations and repairs shall be based on the estimated cost of the
work. The fee shall be in the amount $24 per $1,000 of the estimated
cost of the work of work up to $50,000 and $20 per $1,000 of the estimated
cost of the work for work over $100,000 and $16 per $1,000 of the
estimated cost of the work for work over $100,001, provided that the
minimum fee shall be $60, except that the fee for other minor work
shall be $15 per $1,000 of the estimated cost of the work, provided
that the minimum fee shall be $60, with the exception of work under
the flat fee rate as follows.

(d)
Addition fees. Fees for additions shall be computed on the same basis as for new construction for the added portion in Subsection A(3)(a) above.
(f)
Demolition fees. Fees for demolition shall be $85 for one- and
two-family buildings; except that the buildings accessory to one-
and two-family buildings shall be $50, and all other structures shall
be $125. Fees for the demolition of underground storage tanks shall
be $65 each.

(g)
Moving building fees. Fees for moving of a building shall be
$210.

(h)
Elevator fees. Elevator permit fees shall be in accordance with
N.J.A.C. 5:23-12.1 et seq.
(i)
Sign fees. Fees for signs shall be $1.75 per square foot computed
on one side only for double-faced signs, provided that the minimum
fee shall be $60.

(j)
Asbestos abatement fees. Fees for asbestos abatement shall be
in accordance with N.J.A.C. 5:23, Subchapter 8.
(k)
Manufactured home fees. Fees for manufactured homes shall be
$60 per thousand of cost for site preparation of foundation and utilities
with a minimum fee of $60.

(l)
Lead hazard abatement fees. The fee for lead hazard abatement
work shall be $180.

(m)
Lead abatement clearance fees. The fee for lead abatement clearance
shall be $40.

(n)
Outdoor boiler/furnace fees. The fee for an outdoor boiler/furnace
shall be $50.

(o)
Tents fee. The fee for tents (over 900 square feet or more than
30 feet any direction) shall be $90.

(q)
Asbestos remediation fee. The fee for asbestos remediation shall
be in accordance with N.J.A.C. 5:23-8.9.

Standpipes. The fee for each standpipe shall be $212.
(c)
Oil-fired appliance. The fee for each oil-fired appliance, which
is not connected to the plumbing system, shall be $60.
(d)
Kitchen exhaust. The fee for each kitchen exhaust system shall
be $46.
(e)
Incinerator. The fee for each incinerator shall be $460.
(f)
Crematorium. The fee for each crematorium shall be $460.
(g)
Pre-engineered suppression systems. The fee shall be $85 each.
(h)
Smoke detectors and heat detectors.

Manual or automatic alarm systems. The fee shall be $50.

Chimney (metal or masonry). The fee shall be $50 each.

Certificate of occupancy/approval. The minimum fee for a certificate
of occupancy/approval shall be $25.
(a)
Minor work. Minor work as defined in N.J.A.C. 5:23 shall be
$0.
(b)
Utility buildings and structures. Utility buildings and structures
less than 10,000 cubic feet in volume shall be 10% of the construction
permit fee, provided that the minimum fee shall be $25.
(c)
Residential buildings. Residential buildings shall be 10% of
the construction permit fee, provided that the minimum fee shall be
$25.
(d)
Other buildings. All other buildings shall be 10% of the construction
permit fee, provided that the minimum fee shall be $25.
(e)
Multiple certificates. Multiple certificates of occupancy shall
be $25 per tenant or use. (Optional: may be flat fee or percentage
in above.)
(8)
New Jersey Uniform Construction Codes use group change. The fee for
a certificate of occupancy incidental to a use group is $125.

Certificate of continued occupancy. The fee for a certificate of
continued occupancy shall be $100.
(10)
Elevator certificate of compliance. Fees for certificate of
compliance for elevators shall be as provided in N.J.A.C. 5:23-1 2.6(a)
and (b).
(12)
Change of contractor. The fee for a change of contractor shall
be $25.
(13)
Lapsed permit. The fee to reinstate a lapsed permit shall be
50%.
(14)
No certificate of continued occupancy letter request. The fee
for a letter stating that no certificate of continued occupancy is
required shall be $10.
(15)
Fees in this schedule shall be rounded off to the nearest dollar.
(16)
State training fees. In accordance with the specifications and
guidelines of N.J.A.C. 5:23-4.19, a surcharge will be collected then
remitted and reported quarterly to the New Jersey Department of Community
Affairs.
B.
Waiver of fees for disabled persons.
(1)
No person shall be charged a construction permit surcharge fee or
enforcing agency fee for a construction, reconstruction, alteration
or improvement designed and undertaken solely to promote accessibility
by disabled persons to an existing public or private structure or
any of the facilities contained therein.
(2)
No disabled person or parent or sibling of a disabled person shall
be required to pay any municipal fee or charge in order to secure
a construction permit for any construction, reconstruction, alteration
or improvement which promotes accessibility to the disabled person's
living unit.
(3)
BLINDNESS
DISABLED PERSON
Definitions. As used in this subsection, the following terms shall
have the meanings indicated:
Central visual acuity of 20/200 or less in the better eye
with the use of corrective lens.
A person who has the total and permanent inability to engage
in any substantial, gainful activity by reason of any medically determinable
physical or mental impairment, including blindness, and shall include,
but not be limited to, any resident of the municipality who is disabled
pursuant to the Federal Social Security Act (45 U.S.C. § 416),
or Federal Railroad Retirement Act of 1974 (45 U.S.C. § 21),
or is rated as having a sixty-percent disability or higher pursuant
to any federal law administered by the United States Veterans'
Administration.
