[CC 1989 §14-11]
A. 
Subject to the provisions of Section 140.260, the Chief of Police shall be the executive head and commanding officer of the Police Department and shall be responsible for and have authority over all personnel of the department necessary to conserve the peace and preserve good order within the City and to maintain a high standard of administration, training, discipline, morale and operations in the Police Department.
B. 
The regular workweek of the Chief of Police shall be forty (40) hours per week and shall consist of such additional hours of duty as shall be deemed necessary and shall be required at no additional compensation.
C. 
In the event of a vacancy in the office of the Chief of Police by reason of death, removal, resignation or other cause, the office shall be filled in the same manner as prescribed in Section 115.150 of this Code.

A. 
The Chief of Police is hereby authorized to hold a public sale during the months of April and August of each year for the purpose of disposing of all unclaimed property in possession of the Police Department.
B. 
There shall be published in a newspaper of general circulation in the City a notice stating the time, date and place of the sale along with a description of the property to be sold. Said notice shall be printed for two (2) consecutive weeks immediately prior to the sale.
C. 
Each piece of property shall be sold separately and shall be sold to the highest bidder.
D. 
No property shall be sold unless it has been in the possession of the Police Department at least six (6) months and after all reasonable efforts have been made to discover and identify the owners of said property and to contact them.

A. 
An Assistant Chief of Police may be employed by the City and, if so employed, shall assume the authority of the Chief of Police in the absence of the Chief of Police. In the event of the death, resignation or removal of the Chief of Police, the Assistant Chief of Police shall assume the duties and responsibilities of the Chief of Police until such time as a new Chief of Police shall be employed by the City. In the event the City has not employed an Assistant Chief of Police, the duties of the Assistant Chief of Police shall be performed by the highest ranking officer junior to the Chief of Police.
B. 
The regular workweek of the Assistant Chief of Police shall be forty (40) hours per week, consistent with the work schedule of the balance of the Police force exclusive of that of the Chief of Police.
C. 
The Assistant Chief of Police shall be responsible for the preparation and execution of a Police training program.

The Police Department shall be charged with the maintenance of law and order within the City and the personnel of the Police Department shall be conservators of the peace within the City and shall patrol on such beats and at such times as may be designated by the Chief of Police. They shall continuously be on the alert, vigilant and active in prevention of depredations, disturbances of the peace and violations of the law of the State, this Code and other ordinances of the City and in making of arrests in maintaining and preserving order and the peace of the City.

Every member of the Police Department who shall be commissioned as a Police Officer shall have power at all times to make or order arrests with proper process for any offense against the laws of the City and to keep the offender in the City prison or other proper place to prevent his/her escape until a trial can be had before the proper officer, unless the offender shall give a good and sufficient bond for his/her appearance for trial, and shall also have power to make arrests without process in all cases in which any offense shall be committed in his/her presence. Every member of the Police Department is empowered to serve and execute all warrants, subpoenas, writs or other process issued by the Municipal Court of the City at any place within the limits of Jasper County, Missouri.

Any Police Officer who is dispatched to the scene of an accident occurring on any public thoroughfare, or when making an arrest for any cause, shall make a complete investigation and file a written report as designated by the Police Chief. Such report shall state the time of arrest or incident or accident, location, names and addresses of injured parties, names and addresses of witnesses, diagrams of accident scenes and all other relevant facts which may come to his/her attention. No Police Officer shall make any investigation of any accident which may occur upon other than public thoroughfares of the City which may involve motor vehicles.

A. 
The Police Department shall consist of the following personnel: one (1) Chief of Police, the Assistant Chief of Police, lieutenants, sergeants, corporals, patrolpersons, DARE, K-9 officers, emergency services dispatchers and Animal Control Officers as are set annually by the Council in accordance with the City's budget.
B. 
All Police personnel must have a high school diploma or equivalent and in addition the following requirements shall pertain to the various classifications:
1. 
Chief of Police: graduate of an accredited Police academy, P.O.S.T. certified, and at least five (5) years experience in law enforcement work.
2. 
Assistant Chief of Police: graduate of an accredited Police academy, P.O.S.T. certified, and at least three (3) years experience in law enforcement work.
3. 
Lieutenant: at least thirty-six (36) months experience as a Police patrolperson, with at least twelve (12) continuous months as a Police sergeant with the City of Webb City Police Department, P.O.S.T. certified, and a graduate of an accredited Police academy.
4. 
Sergeant: at least thirty-six (36) months experience as a Police patrolperson, with at least twelve (12) continuous months as Police corporal with the City of Webb City Police Department, P.O.S.T. certified, and a graduate of an accredited Police academy.
5. 
Corporal: at least twenty-four (24) months experience as a Police patrolperson, with at least twelve (12) continuous months as a Police patrolperson with the City of Webb City Police Department, P.O.S.T. certified, and a graduate of an accredited Police academy.
6. 
Patrolperson: P.O.S.T. certified, a graduate of accredited Police academy, and those certification/training requirements established by State law generally and specifically under Chapter 590, RSMo., regarding municipal Peace Officers.
7. 
D.A.R.E. patrolperson: in addition to the requirements of patrolperson, must have completed approved courses for teaching drug abuse resistance education.
8. 
K-9 patrolperson: in addition to the requirements of patrolperson, must have completed approved courses for handling Police dogs.
9. 
Emergency services dispatcher: completion of an approved course for emergency services dispatch procedures.
C. 
The Police Department may also consist of one (1) or more Police dogs as may be established annually by the City's budget. Such Police dogs shall be considered officers of the City when acting under the supervision and handling of a patrolperson trained to handle Police dogs.

No member of the Police Department shall be permitted to engage in or receive compensation for any work, occupation or profession in addition to his/her duties as a member of the Police Department except as may be approved by the Chief of Police and the Personnel Administration Board. In case of small, temporary jobs the Chief of Police is hereby authorized to make temporary approval without reference to the Personnel Administration Board.

A. 
Every member of the Police Department shall appear in the prescribed uniform when on duty with the following exceptions:
1. 
Chief of Police, Assistant Chief of Police: May wear either the prescribed uniform or appropriate civilian attire;
2. 
Detective: Those officers assigned to the Detective Division may wear appropriate civilian attire; provided, when testifying in court, detectives shall wear formal attire, including dress pants, coat and tie.
3. 
Officers on special assignment: At times when special investigations or assignments dictate, uniformed officers may wear civilian attire, with prior approval of the Chief of Police or Assistant Chief of Police.
B. 
All members of the Police Department when on duty shall be immaculate, clean and presentable to the public.

In the discharge of his/her duties, the Chief of Police shall be subject to the supervision and direction of the Mayor. The Assistant Chief of Police and all other members of the Police Department shall be subject to the supervision and direction of the Mayor and their superior officers in the Police Department.

A. 
Lieutenants shall have authority over sergeants, corporals, emergency services dispatchers and Police patrolpersons and shall be subject to such duties as shall be designated by the Chief and Assistant Chief of Police.
B. 
Sergeants shall have authority over corporals, emergency services dispatchers and Police patrolpersons.
C. 
Corporals shall have authority over emergency services dispatchers and Police patrolpersons and shall be subject to such duties as shall be designated by their superior officers.

A. 
No sergeant shall be eligible for promotion to the rank of lieutenant unless and until the officer has at least thirty-six (36) months experience as a Police Officer, has served the last twelve (12) continuous months in the grade of sergeant with the Webb City Police Department, has participated in the necessary testing for the position, has received at least a satisfactory score in the last annual employee evaluation and is not the subject of any type of internal investigation, department reprimand or probation at the time that the promotion is to become effective.
B. 
No corporal shall be eligible for promotion to the rank of sergeant unless and until the officer has at least thirty-six (36) months experience as a Police Officer, has served the last twelve (12) continuous months in the grade of corporal with the Webb City Police Department, has participated in the necessary testing for the position, has received at least a satisfactory score in the last annual employee evaluation and is not the subject of any type of internal investigation, department reprimand or probation at the time that the promotion is to become effective.
C. 
No Police patrolperson shall be eligible for promotion to the rank of corporal unless and until the officer has at least twenty-four (24) months experience as a Police Officer, has served the last twelve (12) continuous months in the grade of patrolperson with the Webb City Police Department, has participated in the necessary testing for the position, has received at least a satisfactory score on the last annual employee evaluation and is not the subject of any type of internal investigation, department reprimand or probation at the time that the promotion is to become effective.

The Mayor, upon recommendation of the Chief of Police, may employ a special traffic officer who shall remain a special officer and shall be employed on a month-to-month basis and shall hold his/her commission at the pleasure of the Mayor. The special traffic officer herein authorized shall be charged with the duty of enforcing all provisions of this code and other ordinances regulating parking in metered areas within the City. The special traffic officer provided for herein shall not be considered to be an employee of the Police Department of the City nor entitled to the privileges of the merit laws of the City applicable to regular Police Officers.

The Chief of Police shall prepare and may from time to time amend rules and regulations not inconsistent with this Code or State law for the government of the Police Department and the conduct of the members thereof. Such rules and regulations and amendments thereto, when approved by the Mayor and adopted by resolution of the City Council, entered of record in the journal of the Council and placed on file in the office of the City Clerk, shall be binding on all members of the Police Department and it shall be unlawful for any member of the Police Department to violate or fail to comply with any such rule or regulation and shall subject such member to disciplinary action as set out in the Personnel Policy.

A. 
Any Webb City Police Officer in fresh pursuit of a person who is reasonably believed by him/her to have committed a felony in this State or who has committed or attempted to commit in the presence of such officer any criminal offense or violation of a City ordinance, or for whom such officer holds a warrant of arrest for a criminal offense, shall have the authority to arrest and hold in custody such person anywhere in this State, provided that such fresh pursuit may only be initiated from within the City limits of Webb City and shall be terminated once the pursuing Police Officer is outside the City limits and has lost contact with the person being pursued.
B. 
The term "fresh pursuit", as used in this Section, includes fresh pursuit as defined by the common law, and also the pursuit of a person who has committed a felony or the offense of driving while intoxicated or driving with excessive blood alcohol content or who is reasonably suspected of having committed a felony or the offense of driving while intoxicated or driving with excessive blood alcohol content. It shall also include the pursuit of a person suspected of having committed a supposed felony or the offense of driving while intoxicated or driving with excessive blood alcohol content, though no felony or the offense of driving while intoxicated or driving with excessive blood alcohol content has actually been committed, if there is reasonable ground for believing that a felony or the offense of driving while intoxicated or driving with excessive blood alcohol content has been committed. Fresh pursuit, as used therein, shall not necessarily imply instant pursuit, but pursuit without unreasonable delay.

A. 
Any Police Officer of the City of Webb City who completed the basic Police training as established by Chapter 590, RSMo., shall have the authority to respond to an emergency situation outside the boundaries of the City.
B. 
No Police Officer shall be required by reason of this Section to leave the jurisdiction to respond to an emergency situation, but said Police Officer shall use his/her said discretion and judgment as to leaving the City to respond to any emergency situation. It shall be the policy of the City that said Police Officers shall not leave the City inhabitants with inadequate Police protection or be absent for extended periods of time, but that the response shall be in aid of and to assist the authorities of the County or the municipality in which the emergency situation is located. No Police Officer of the City shall be authorized to make an arrest by reason of this authorization to respond nor shall he/she be authorized to use his/her weapon except to protect himself/herself or to effectuate an arrest for a serious felony endangering the lives or threatening serious property damage to one (1) or more persons in this area.
C. 
The authority contained herein shall permit the response by one (1) or more City Police Officers in an area surrounding this municipality or an area of five (5) miles. The Chief of the Police Department may in his/her discretion authorize additional response beyond this area.
D. 
Every response to an emergency situation outside of the City shall be reported by the Chief of Police to the Mayor, with an explanation for the reason for the response.
E. 
As used in this Section, "emergency situation"means any situation in which the Law Enforcement Officer has a reasonable belief that a crime or offense is about to be committed, is being committed, or has been committed involving injury or threat of injury to any person, property, or governmental interest and such officer's response is reasonably necessary to prevent or end such emergency situation or mitigate the likelihood of injury involved in such emergency situation. The determination of the existence of any emergency situation shall be in the discretion of the officer making the response or in the discretion of an officer or governmental officer of the City in which the emergency situation is alleged to be occurring.

A. 
A Police Officer may request identification of any person in public places or on public property when the officer has reasonable suspicion of a violation of this Code, a City ordinance, or a State or Federal Statute. When such request is made by an officer, the person so requested shall be required to show the officer written identification if the person has such identification on his or her person, and if not, to tell the officer his or her name and address, and if a person be a minor, the name and address of his or her parents or guardian. Any person refusing to give such identification when so requested shall be deemed guilty of a misdemeanor.
B. 
Penalty For Violation. Any person violating this Section shall be punished upon conviction thereof as provided by Section 100.110.
