A. 
Adopted. The provisions, except as modified in this Article, of the 2018 International Fire Code, including Appendixes A, B, C, D, and I, three (3) copies of which are on file in the office of the City Clerk, are hereby incorporated in this Chapter and made a part hereof as though set forth fully herein and are hereby adopted as the official Fire Code of the City.
B. 
Amendments.
1. 
Wherever the phrase "name of jurisdiction" or "local Governing Body" appears, it shall be construed to mean the "City of Webb City, Missouri."
2. 
Section R313.2 of the International Fire Code is hereby repealed, and the following is hereby enacted in its place:
R313.2 Multiple-Family (R-3) dwellings automatic fire systems. An automatic residential fire sprinkler system shall be installed in multiple-family dwellings, as defined in Webb City Code Section 405.020.
Exception: An automatic residential fire sprinkler system shall not be required for additions or alterations to existing buildings that are not already provided with an automatic residential sprinkler system.
C. 
The International Fire Code adopted by this Article shall be administered and enforced by the Fire Chief.
D. 
General Penalty.
1. 
Whenever in the code adopted in this Section, or in any rule, regulation, notice or order promulgated by any officer or agency of the City under authority duly vested in him/her or it by said code, any act is prohibited or is declared to be unlawful or an offense or misdemeanor or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, upon conviction of a violation of any such provision of the code adopted herein or of any such ordinance, rule, regulation, notice or order, the violator shall be punished by a fine not exceeding five hundred dollars ($500.00) or by imprisonment in the City or County Jail not exceeding ninety (90) days or by both such fine and imprisonment; provided, that in any case wherein the penalty for an offense is fixed by a Statute of the State, the statutory penalty, and no other, shall be imposed for such offense, except that imprisonments may be in the City prison or workhouse instead of the County Jail.
2. 
Every day any violation of the code adopted herein or any other ordinance or any such rule, regulation, notice or order shall continue shall constitute a separate offense.
3. 
Whenever any act is prohibited by the code adopted herein, by an amendment thereof, or by any rule or regulation adopted thereunder, such prohibition shall extend to and include the causing, securing, aiding, or abetting of another person to do said act. Whenever any act is prohibited by this code, an attempt to do the act is likewise prohibited.

The Fire Chief shall have power to modify any of the provisions of the Code adopted by this Article, upon application in writing by the owner or lessee or his/her duly authorized agent, when there are practical difficulties in carrying out the strict letter of the Code, provided that the spirit of the Code shall be observed, public safety secured and substantial justice done. The particulars of such modification, when granted or allowed, and the decision of the Fire Chief thereon shall be entered upon the records of the department and a signed copy shall be furnished the applicant.
