Whenever any persons desire to build their own sidewalks, or
curbs and gutters, or to have them constructed by private contract
at a time before the City Council shall have taken any action toward
having such work done by public contract, they shall first obtain
from the City Clerk a permit to do so, and such sidewalks or curbs
and gutters shall be constructed in accordance with specifications
prescribed and adopted by the City Council and under the supervision
of the City Engineer, provided that after the City Council shall have
instructed the City Engineer to file an estimate on cost of contraction
of sidewalks or curbs and gutters along a portion of any street in
this City, any person owning property along or in front of which such
work is contemplated to be done may only apply for and be granted
a permit at any time previous to five (5) days before the date specified
for such estimate to be filed, and no permit shall be granted thereafter.

Whenever any person applies for a permit as provided for in
this Article, he/she shall deposit with the City Clerk an inspection
fee in the amount of ten dollars ($10.00) and a permit fee in the
amount of one dollar ($1.00) for each lineal foot of curb and gutter
to be constructed as a guarantee that the work will be completed within
sixty (60) days from the date of the permit; or, in lieu of a cash
deposit, a performance bond of like amount in a form acceptable to
the City; and upon such application and deposit being made, the City
Clerk shall issue a permit for the work, which permit shall be in
the following form:

That if the City Engineer's certificate of acceptance of the work
done under this permit, together with this permit, are presented to
the City Clerk within sixty (60) days from date hereof, the said sum
of ___________________________________________ dollars shall be returned
to the depositor, otherwise the full amount of said deposit shall
be forfeited to the City of Webb City, Missouri.

N. B. This permit expires _____________________, 20____, and
the work for which same is granted must be completed in time for the
City Engineer's certificate of acceptance to be presented and this
permit returned on or before said date.

When a permit under this Article is obtained, it shall be submitted
to the City Engineer with a request for the grade to be given for
the work specified in the permit. The City Engineer shall then proceed,
without any unnecessary delay, to set the grade stakes at the established
grade for such improvement, and he/she shall supervise the construction
of the sidewalk or curbs and gutters, and when the construction is
completed according to the specifications and grade given, he/she
shall issue a certificate of acceptance thereof, which certificate
shall be submitted to the City Clerk when the permit is presented
for the return of the deposit; and no permit shall be accepted and
cancelled by the City Clerk until the City Engineer's certificate
of acceptance is submitted to him/her, as evidence of the completion
of the work in a manner satisfactory to the City.

The City Engineer shall not be required to set grade stakes
for any sidewalk or curb and gutter to be constructed by private contract
until a permit therefor shall have been first obtained nor shall he/she
give a certificate of acceptance for any sidewalk or curb and gutter
which shall have been heretofore or may hereafter be constructed contrary
to the provisions of this Article; and all such sidewalks, curbs and
gutters shall be subject to condemnation by the City Council, and
the property along or in front of which such improvements are so constructed
shall be liable for the cost of reconstruction thereof in accordance
with the City's specifications and on the established grade.
