A. By
St. Charles County Ordinance 07-061, effective May 1, 2007, and pursuant
to Section 2.507 of the St. Charles County Charter and the recommendation
of the County Executive, the Division of Emergency Management within
the Department of Community Health and the Environment was transferred
to the former Sheriff's Department as the Division of Emergency Management
within that Department, with a sunset of April 30, 2015, unless earlier
extended. Under that ordinance, the functions of the Division in the
former Department of Community Health and Environment were placed
in the administrative structure of the former Sheriff's Department,
Bureau of Special Enforcement and all powers and duties, including
those set out below, formerly held by the Division within the Department
of Community Health and the Environment were transferred to the former
Sheriff's Department, Bureau of Special Enforcement.
Pursuant to Article
II, Section 2.507 of the St. Charles County Charter (2014) and the recommendation of the County Executive, and pursuant to the provisions of Article
IV, Sections 4.250 and 4.1300 of the St. Charles County Charter (2014), effective January 1, 2015, St. Charles County declares that the Division of Emergency Management within the former Sheriff's Department remains within the Police Department, within its Bureau of Special Enforcement with all of its powers and duties including those set out below.

B. The
Division shall be headed by a director who shall be a Merit System
employee pursuant to the St. Charles County Charter, Section 7.300
(2014). If the Division Director is not the Commander of the Bureau
of Special Enforcement, the Division Director will report to the Commander
of the Bureau of Special Enforcement.

C. All
employees and positions assigned to the Division of Emergency Management
within the former Sheriff's Department remain within the Police Department,
Bureau of Special Enforcement, Division of Emergency Management. In
addition, all equipment of the Division remains within the Police
Department, Bureau of Special Enforcement, Division of Emergency Management.

D. Powers And Duties.
1. The duties of "emergency management" shall include the preparation
for and execution of emergency functions in order to minimize and
repair injury and damage resulting from disasters caused by or arising
from natural disasters or from terrorism. These functions include,
at a minimum, audible warning sirens, communications, evacuation of
civilian personnel from stricken areas, the acquisition or arrangement
for emergency transportation or shelter and other functions relating
to civilian protection, together with all other activities necessary
or incidental to the preparation for and execution of the foregoing
functions, including the planning, coordination and execution of emergency
management services, disaster preparedness and emergency response
for St. Charles County.
2. The Bureau of Special Enforcement, through the Division of Emergency
Management, shall be responsible for the administration of the Division
and shall possess all other powers previously vested by order or ordinance
in the former and now abolished Emergency Management Agency.
3. Pursuant to Section 2.507 of the St. Charles County Charter and the
recommendation of the County Executive, the addressing and database
maintenance for the "911" system as carried out by the "911" database
specialist shall transfer from the Division of Emergency Management
to the Department of Dispatch and Alarm. Staff performing the duties
of addressing and database management for the "911" system shall report
to the Director of Dispatch and Alarm.
E. The
Police Department, as the superintending agency for the Division of
Emergency Management shall enforce all orders, rules and regulations
issued by the County Executive or his designee during a declared state
of emergency in St. Charles County. In the event of the occurrence
of a natural disaster or terrorist attack involving imminent danger
to lives or property in St. Charles County, the County Executive or
his designee may declare that a state of emergency exists in St. Charles
County and during the existence of that emergency may exercise the
power to enforce all rules and regulations related to emergency management,
including any powers granted to him by Federal law, State law (including,
but not limited to, Chapter 44, RSMo.) or County ordinance.
