The written regulations now in effect or hereafter promulgated
by the Elk Creek Recreation and Leisure Board for the use of said
swimming pool, tennis courts and other recreational facilities of
the Borough, as posted from time to time on or about each of said
facilities, are hereby declared to be a part of this article.
All persons using said pool, courts and other recreational facilities
are required to obey such regulations and the orders of lifeguards,
Borough Police and other Borough and Elk Creek Recreation and Leisure
Board employees based thereon, as same may from time to time be amended
and supplemented, with respect to the use of said facilities.
Any person who shall violate any of the said written and posted
regulations, as promulgated, amended or supplemented from time to
time, or the orders of duly authorized individuals based thereon may,
upon the orders of said Elk Creek Recreation and Leisure Board or
its duly authorized representative, be barred temporarily or permanently
from further use of the recreational facility involved and/or shall,
upon conviction of such violation, be sentenced to pay a fine of not
less than $5 nor more than $25 and, in default of payment of such
fine and costs, to imprisonment in the county jail for not more than
10 days.

The areas of parks and playgrounds where children are present,
such as Girard Borough Park and Municipal Swimming Pool, in the Borough
of Girard shall be designated 100% tobacco-free.
Appropriate signage will be posted designating tobacco-free
areas.
The community will be notified of this article.
Violators will be immediately ejected from the park or recreational
facility. Any person who violates this article shall, upon being found
liable therefor in a civil enforcement proceeding commenced by the
Borough before a Magisterial District Judge, pay a fine of not more
than $600, plus all court costs, including reasonable attorneys' fees,
incurred by the Borough in the enforcement of this chapter. No judgment
shall be imposed until the date of the determination of the violation
by the Magisterial District Judge. If the defendant neither pays nor
timely appeals the judgment, the Borough may enforce the judgment
pursuant to the applicable Rules of Civil Procedure. Each day a violation
exists shall constitute a separate offense. Further, the appropriate
officers or agents of the Borough are hereby authorized to seek equitable
relief, including injunction, to enforce compliance herewith.
