Whenever any person authorized by law or by any ordinance of the City to erect, maintain and operate in or through the City any telephone, magnetic telegraph or electric line, intends to construct such line in or through the City, such person or corporation shall file with the City Clerk a written application addressed to the City Council, asking the Council to specify locations for such poles, piers, abutments and other fixtures as the applicant may desire to erect and maintain in, along, or across the streets and alleys of the City. The application shall show the location of the telephone, magnetic telegraph or electric line along and across the streets and alleys of the City, and the number of wires intended to be erected and maintained. The City Clerk shall forthwith lay the application before the Mayor of the City, and the Mayor may, if he/she thinks fit, call a special meeting of the Council to act on the application.

At a meeting of the Council called for the purpose of acting on an application under Section 510.010, or if no such meeting is called, then at the next regular meeting of the Council held after the filing of such application with the Clerk, the application shall be presented by the City Clerk to the Council and the Council shall then, or as soon thereafter as they can determine what specifications the circumstances require, by ordinance specify where poles, piers, abutments and other fixtures necessary to be placed in streets or alleys of the City in the construction of such telephone or telegraph or electric lines shall be placed, and in like manner specify the kind of poles to be used, the height at which the wire or wires shall be strung from the ground, and the depth of which poles, piers and abutments are to be sunk in the ground in the construction of such telephone, telegraph or electric line, and such other particulars as may be found necessary or proper for the preservation of the streets or alleys of the City from unnecessary damage, and for prevention of unnecessary obstruction of the public use of such streets or alleys, and to prevent interference with the vested rights of others heretofore granted for water works and electric light purposes.

No person shall in the construction of any telephone, magnetic telegraph or electric line dig any hole, or put up any support for a wire in any street or alley of this City, or stretch any wire along or across any street or alley of the City without specifications for the construction of such telephone, telegraph or electric line being first made by the City Council, or otherwise than in accordance with the specifications made by the Council for the construction of such telephone, telegraph or electric line.

Any hole made in any street or alley of the City, and any pole or other permanent erection made in any street or alley of the City in violation of this Chapter is hereby declared to be a nuisance and the same shall be abated.
