As used in this chapter, the following terms shall have the
meanings indicated:
LITTER
All articles and waste materials commonly described as garbage,
refuse, rubbish and wastepaper.
PRIVATE RECEPTACLE
A metal, wooden or other storage container covered so as
to prevent litter from being scattered therefrom by animals, the wind
or other natural causes.
PUBLIC PLACE
All highways, sidewalks, waterways, including ditches, and
all public parks, grounds and buildings.
No person shall throw or deposit litter in or upon any public
place within the Town.
No person shall throw or deposit litter in or upon any private
place within the Town, other than within a private receptacle, except
under such circumstances that such litter cannot be propelled by the
wind or other natural cause onto or within any public place.

A. No person, while a driver or passenger in a vehicle, shall throw
or deposit litter upon any highway or other public place.
B. A municipality, or any individual, firm or corporation acting on
its behalf, or any other individual, firm or corporation shall not
cause or permit any solid waste, garbage, refuse, rubbish or wastepaper
to be transported on any vehicle unless such solid waste, garbage,
refuse, rubbish or wastepaper has a cover, tarpaulin or other device
which completely closes in the opening on the vehicle while such vehicle
is being operated, so as to prevent the falling of any such substances
from the vehicle, whether such vehicle is full or empty. If the load
is so arranged so that no loose substance can fall from or blow out
of the vehicle, then a covering is not necessary.

A. Violation of any of the provisions of this chapter is hereby declared
to be an offense against such chapter.
B. For every violation of §§
216-2,
216-3 or
216-4A of this chapter, the person violating the same shall be subject to a fine of not more than $200 or imprisonment not exceeding 30 days, or both.
C. For every violation of §
216-4B of this chapter, the person, firm or corporation violating the same shall be subject to a fine of not less than $250 and not more than $500 or imprisonment not exceeding 30 days, or both.
