(a) 
No person, firm or corporation shall create, cause or maintain any public nuisance within the township by the unreasonable creation of debris, dust, smoke, fly ash or noxious odors, offensive or disturbing to adjacent property owners and residents in the area.
(b) 
The following noises and disturbances are hereby declared to be a violation of this section; provided, however, that the specification of the same is not thereby to be construed to exclude other violations of this section not specifically enumerated:
(1) 
The operation of any off-road recreational vehicle, including but not limited to an ORV, ATV or snowmobile, as defined by the Uniform Traffic Code for Cities, Townships, Villages, as adopted by the township in Ordinance No. 62, as amended, on any property or realty owned, leased, or operated by the township.
(c) 
None of the prohibitions herein shall apply to any of the following:
(1) 
Any police vehicle, ambulance, fire engine or emergency vehicle while engaged in necessary emergency activities.

(a) 
Unsheltered storage of lumber, junk, trash or debris, or abandoned, discarded or unused objects or equipment, including but not limited to stripped, junked or other automobiles not in good and safe operating condition, and of any other vehicles, machinery, implements, furniture, stoves, refrigerators, freezers, cans, containers and/or equipment and personal property of any kind which is no longer safely usable for the purpose for which it was manufactured, for a period of 10 days or more, except in licensed junkyards, within the boundaries of the township, is hereby declared to be a nuisance and dangerous to the public safety, health and general welfare.
(b) 
No person in charge of or in control of a premises, whether as owner, lessee, tenant, occupant or otherwise shall create or maintain a nuisance anywhere within the boundaries of the township as such term is declared and defined in subsection (a) of this section.
(c) 
This section shall not apply with regard to any materials stored in an enclosed building. This section shall further not apply with regard to any vehicle on the premises of any business enterprise operated in a lawful place and in a lawful manner when the keeping or maintenance of such vehicle is necessary to the operation of such business enterprise, or with regard to a vehicle in an appropriate storage place or depository maintained in a lawful place and manner by the township or any other public agency or entity.

(a) 
Short title. This section shall be known and cited as the township construction debris containment ordinance.
(b) 
Purpose. The purpose of this section is to protect the public health, safety and welfare of property and persons in the township from the outdoor storage, accumulation and collection of waste, rubbish, garbage or other construction debris and/or materials.
(c) 
Enabling authority. This section is adopted in accordance with, and pursuant to, Act 246, Public Acts of 1945, as amended.
(d) 
Definitions. For the purpose of construction and application of this section, the following definitions shall apply:
CONSTRUCTION DEBRIS
Miscellaneous materials commonly discarded during the construction, renovation, or destruction of a dwelling or structure, including but not limited to: shingles, scrap wood, packaging materials, nails, tarps, installation, drywall, paint and stain containers, roofing material, pipes, wires, hoses, tubing, electrical supplies, trash, paper products and junk.
CONSTRUCTION SITE
Each and every lot upon which a building, dwelling or structure is being or is intended to be constructed.
CONTAINMENT DEVICE
A mobile container designed for containment and/or disposal of construction debris, rubbish, trash, junk, and scrap materials. It shall be a minimum of eight feet in length, eight feet in width and four feet deep. The containment device shall be constructed in such a manner as to effectively contain construction debris and shall have an attached lid capable of preventing the escape of debris.
LOT
A parcel of land occupied or intended to be occupied, by a building and its accessory building, or by group dwellings and their accessory buildings, together with any open spaces.
(e) 
Construction debris containment.
Device required. A construction debris containment device shall be required for each and every construction site for the purpose of disposing of all construction debris. The construction debris containment device shall remain on the construction site until such time as a certificate of occupancy has been issued by the township. The construction debris containment device shall be regularly emptied and continually maintained in a neat and orderly condition. The construction debris containment device shall be located 15 feet from all buildings.
(f) 
Prohibited conduct. It shall be unlawful for any person, firm corporation, partnership or other entity to maintain a construction site without providing, at the construction site, a construction debris containment device. It shall be unlawful to maintain a construction containment device which is not regularly emptied and continually maintained in a neat and orderly condition. It shall be unlawful for any person, firm, corporation, partnership or other entity to use land within township for the dumping or disposal of scrap, iron, junk, garbage, rubbish, or other construction debris.
It shall be unlawful for any person, firm, corporation, partnership or other entity to utilize a construction debris containment device for burning purposes.
(g) 
Penalty. A person, firm, corporation, partnership or other entity who violates the provisions of this section shall, upon conviction thereof, be guilty of a misdemeanor, and subject to a penalty not to exceed $500 or imprisonment in the county jail for a period not to exceed 90 days, or both such fines and imprisonment.

(a) 
No person shall cause or create any unreasonable or improper noise or disturbance, injurious to the health, peace or quiet of the residents and property owners of the township.
(b) 
The following noises and disturbances are hereby declared to be a violation of this division; however, the specification of such noises and disturbances is not thereby to be construed to exclude other violations of this division not specifically enumerated:
(1) 
The sounding of any horn or signal device on any automobile, motorcycle, bus, or other vehicle for any purpose other than to avoid an accident or collision.
(2) 
The playing of any radio, phonograph or any musical instrument in such a manner or with such volume as to annoy or disturb the quiet, comfort or repose of other persons.
(3) 
Yelling, shouting, hooting or singing on the public streets between the hours of 11:00 p.m. and 7:00 a.m., or at any time or place so as to annoy or disturb the quiet, comfort or repose of any persons in the vicinity.
(4) 
The keeping of any animal, bird or fowl which emanates frequent or extended noise which shall disturb the quiet, comfort and repose of any person in the vicinity.
(5) 
The operation of any automobile, motorcycle or other vehicle so out of repair, so loaded or constructed as to cause loud and unnecessary grating, grinding, rattling, exhausting, or other noise disturbing to the quiet, comfort or repose of other persons.
(6) 
The operation of any steam whistle attached to a boiler of any type except for the purpose of giving notice of the time to begin or stop work or as a warning of fire or other danger, or for other purposes upon special permit therefor from the township board.
(7) 
The discharging outside of any enclosed building of the exhaust of any steam engine, internal combustion engine, motor vehicle, or motorboat engine except through a muffler or other similar device which will effectively prevent loud or explosive noises resulting therefrom.
(8) 
The erection, excavation, demolition, alteration or repair of any building or premises in any platted residential district or section of the township, including the streets and highways therein, in such a manner as to emanate noise or disturbance unreasonably annoying to other persons, other than between the hours of 6:00 a.m. and sundown on weekdays except in cases of urgent necessity, in the interest of public health and safety, upon receipt of a permit therefor from the building inspector of the township, which permit shall limit the period that the activity may continue.
(9) 
The emission or creation of any excessive noise on any street which unreasonably interferes with the operation of any school, church, hospital or court.
(10) 
The creation of any loud or excessive noise, unreasonably disturbing to other persons in the vicinity in connection with the loading or unloading of any vehicle, trailer, box car, or other carrier, or in connection with the opening or destruction of bales, boxes, crates, or other containers.
(11) 
The use of any drum, loudspeaker, or other instrument or device for the purpose of attracting attention to any performance, show, sale or display of merchandise which, by the creation of such noise, shall be unreasonably disturbing to other persons in the vicinity.
(12) 
The operation of any racetrack, proving ground, testing area, or obstacle course for motorcycles, motor vehicles, boats, racers, automobiles or vehicles of any kind or nature in any area of the township not specifically zoned for such an operation and/or where the noise emanating from such area would be unreasonably disturbing and annoying to other persons in the vicinity.
(13) 
The operation of any off-road recreational vehicle, including but not limited to an ORV, ATV or snowmobile, as defined by the Uniform Traffic Code for Cities, Townships and Villages, as adopted by the township in Ordinance No. 62, as amended, between the hours of 11:00 p.m. and 7:00 a.m. or at any time or place so as to annoy or disturb the quiet, comfort or repose of any persons in the vicinity.
(c) 
None of the prohibitions enumerated in subsection (b) of this section shall apply to any of the following:
(1) 
Any police vehicle, ambulance, fire engine or emergency vehicle while engaged in necessary emergency activities.
(2) 
Excavation or repair of bridges, streets or highways by or on behalf of the township, state or county between the hours of 6:00 p.m. and 7:00 a.m. when the public welfare, safety and convenience render it impossible to perform such work during other hours.

Any person found violating any of the provisions of this division shall, upon conviction, be punished as provided in section 1-11. The provisions of this division may also be enforced by suit for injunction, damages or other appropriate legal action.
