As used in this Chapter, the following terms shall have these prescribed meanings:
ABUT
To physically touch or border upon; to share a common property or lot line.
ACCESS
A way or means of approach to provide physical entrance to a property.
ACCESSORY BUILDING
A subordinate use of a building or land that is incidental to and customary in connection with the main building or use which is located on the same lot as the main building or use. Also referred to as "accessory structure".
ACCESSORY STRUCTURE SETBACK LINE
A line delineating the minimum allowable distance between a property line or the right-of-way line of an abutting street and an accessory structure.
ACCESSORY USE
A use of land or building or portion thereof customarily incidental and subordinate to the principal use of the land or building and located on the same lot with the principal use.
ACCURATELY-SCALED PHOTO SIMULATION
A set of representational photographs or video of the location of a proposed antenna from different angles and locations presented in a format that provides the ability to scale dimensions with accuracy.
ADDITION
An extension or increase in floor area or height of a structure.
ADEQUATE PUBLIC FACILITIES
For the project proposed sufficient quantities of water, water pressure and infrastructure to provide water service; treatment plant capacity, sewer line capacity and infrastructure to provide sewer service; distribution pipe size and reserve capacity to provide storm water service; traffic capacity to handle existing and proposed needs as deemed adequate according to the County standards consistently applied to all proposed projects.
ADJACENCY COMPATIBILITY
A land use or zoning district of similar form, function, design, character or safety as the adjacent land use or zoning district.
ADJACENT
Having a common border or end point or across a road, street, sidewalk, right-of-way or thoroughfare.
ADMINISTRATIVE OFFICER
The Director or his/her designee within the Planning Division of the Department of Land Use, Development and Code Enforcement.
ADULT
Any person who has reached eighteen (18) years of age.
ADULT BUSINESS
See Article V, Division 5, Section 400.1770.
ADULT ENTERTAINMENT
See Article V, Division 5, Section 400.1770.
ADULT MEDIA
See Article V, Division 5, Section 400.1770.
ADULT VIDEO VIEWING BOOTH

AGRICULTURAL OPERATION
Use of land where the land is devoted to the production of plants, animals or horticultural products, including forests and forest products; harvest and management; dairy farming; grazing and pasturage; truck gardening; bee keeping; the raising of crops, fruit and nursery stock; viticulture; fish farms; fur-bearing animal farms; and the harvesting, processing, packaging, packing, shipping, marketing and selling of products produced on the premises; incidental farm occupations; and such uses as machinery, farm equipment and domestic repair and construction. Agricultural operation shall not include commercial feedlots, slaughterhouses or the removal of trees for the purpose of development or redevelopment or the removal of trees without replanting.
AGRICULTURAL SALES AND SERVICES
Establishments or places of business engaged in sale from the premises of feed, grain, fertilizers, pesticides or similar goods or in the provision of agriculturally related services. Typical uses include hay, feed and grain stores and tree service firms.
AGRICULTURE
The planting, cultivating, harvesting and storage of grains, hay, plants, grapes, fruits or trees commonly grown in the County as well as the raising and breeding of livestock, poultry or similar animals.
AGRICULTURE-RELATED FEEDING OR DISPOSAL
Commercial feedlots for the raising and selling of farm animals. Also referred to as "concentrated animal feeding operation" or "CAFO".
AIRCRAFT
Any contrivance now known or hereafter invented for flight in air.
ALLEY
See "STREET".
ALTERATION
Any addition, removal, extension or change in the location of any exterior surface of a main structure or accessory structure.
ALTERNATIVE COMMUNICATION TOWER STRUCTURE
Manmade trees, clock towers, bell steeples, light poles and similar alternative-design mounting structures that camouflage or conceal the presence of antennas or towers.
AMERICANS WITH DISABILITIES ACT (ADA)
The 1990 Federal law designed to bring disabled Americans into the economic mainstream by providing them equal access to jobs, transportation, public facilities and services (e.g., accessible parking space standards).[1]

APPEAL
A challenge of an administrative interpretation or a request for variance from any of the zoning provisions of this UDO. Zoning appeals shall be to the Board of Zoning Adjustment.
APPLICANT
The owner of land or the owner's authorized agent or any person authorized by this UDO for which an approval in relation to this UDO is sought.
APPROVING AUTHORITY
The County Council, Planning and Zoning Commission or the Director depending on the proposal or request for a decision. See Article IV of this UDO.
ARCHITECTURAL CHARACTER AND APPEAL
The structures that are designed with respect for the timeless and enduring qualities. They are comparable in scale, shape, character and materials to the surrounding structures.
ART AND CRAFT STUDIO (GENERAL)
A use involving the production of works of art. This use shall include the incidental sale to consumers of those works produced on site.

AUTOMOTIVE SERVICE
An establishment or place of business primarily engaged in the sale of products related to automobiles and the provision of services related to automobile maintenance, repair and reconstruction. The following automotive use types shall be defined as follows:
1. 
AUTOMOTIVE CONVENIENCE STATION (C-STORE)A building or premises where gasoline, diesel fuel and oil may be dispensed at retail with no automobile repair facilities. Uses permissible also include the sale of cold drinks, packaged foods, tobacco and similar household convenience goods and limited automobile supplies for station customers.
2. 
AUTOMOTIVE PARKING GARAGE OR LOTA garage or area, available to the public, for the temporary parking of motor vehicles.
3. 
AUTOMOTIVE PARTS AND SUPPLY STOREAn establishment or place of business primarily engaged in the sale of merchandise that is associated with the use, repair or upkeep of automobiles.
4. 
AUTOMOTIVE RENTAL AGENCYAn establishment or place of business primarily engaged in renting automobiles for a temporary period of time.
5. 
AUTOMOTIVE REPAIR SHOPThe use of a building or premises for the repair of automobiles or other motorized vehicles or the installation or repair of equipment or parts on motorized vehicles, such as mufflers, brakes, tires, radios, transmissions, glass and engines or engine parts, but excluding dismantling or salvage. Automotive repair shops also include:
a. 
AUTOMOTIVE PAINT OR BODY SHOPThe use of a building or premises for the repair of automotive bodies and/or major mechanical works, straightening of body parts, painting, welding or storage of automobiles that are not in operable condition.
b. 
TIRE RETREADING OR REPAIR SHOPThe use of a building or premises for the repairing or retreading of automotive tires.
6. 
AUTOMOTIVE SALES, LEASE AND RENTALSAn establishment or place of business primarily engaged in the sale, lease or rental of automobiles, vans and trucks less than two (2) tons, including incidental parking and servicing of vehicles available for sale, lease or rent or lease.
7. 
AUTOMOTIVE SERVICE STATIONBuildings and premises where gasoline or diesel fuel is dispensed at retail for automobiles, recreation vehicles and motorcycles and where, in addition, at least one (1) of the following services is rendered: sale, replacement or servicing of spark plugs, oil, water hoses, brake fluids, batteries, distributors, tires, carburetors, brakes, fuel pumps or other automotive parts or accessories. See "AUTOMOTIVE REPAIR SHOP" where major mechanical activities are allowed.
8. 
AUTOMOTIVE TIRE STOREAn establishment or place of business primarily engaged in the sale of tires and services relating to the repair or purchase of tires for automobiles.
9. 
AUTOMOTIVE WASHINGWashing and cleaning of automobiles and related light equipment. Typical uses include auto laundries or car washes.
AUTOMOTIVE SERVICE STATION

AUTOMOTIVE TIRE STORE

AUTOMOTIVE UPHOLSTERY SHOP
An establishment or business providing service to the general public primarily for the sale of upholstery goods or similar products or the repair of damaged vehicle interiors in need of reupholstery.
AUTOMOTIVE WASHING
See "AUTOMOTIVE SERVICE".
AVIATION FIELD, AIRPORT AND HELIPORT
An area of land or water that is used or designed for the landing and takeoff of aircraft and includes buildings and facilities thereon for the shelter, servicing or repair of aircraft.
BAR OR TAVERN
An establishment or place of business primarily engaged in the preparation and retail sale of alcoholic beverages for consumption on the premises, from which at least fifty percent (50%) or more of the gross income is derived from the sale of alcoholic beverages, including taverns, bars, cocktail lounges and similar uses other than a "restaurant", as that term is defined in this Article.
BASE FLOOD
The 100-year flood (the one percent (1%) chance flood event). Also known as the regional flood.
BASE FLOOD ELEVATION
The highest point expressed in feet above sea level of floodwaters occurring in the regulatory base flood (the one percent (1%) chance flood event). Also known as the 100-year elevation.
BASEMENT
That portion of a building that is partly or completely below grade.
BED AND BREAKFAST HOMESTAY
An establishment or place of business that is a private, owner-occupied residence with one (1) to three (3) guest rooms, occupied or used as a transient abiding place of individuals or groups of individuals who are lodged for compensation, with or without food service.
BED AND BREAKFAST INN
An establishment or place of business consisting of between three (3) and twelve (12) guest rooms, occupied or used as a transient abiding place of individuals or groups of individuals who are lodged for compensation and making available those services normally provided by hotels.
BEST MANAGEMENT PRACTICES
Measures or technology applied to a problem or project and includes a schedule of activities, practices and maintenance procedures. Also referred to as BMP.
BIG BOX STORES
The retail sales establishments in freestanding industrial-style one-story buildings, with first (1st) floor areas exceeding one hundred thousand (100,000) square feet.
BILLBOARD
A permanent off-premises sign exceeding thirty-two (32) square feet in size. A billboard includes wall signs, pole signs on separate parcels, signs affixed to parked or placed vehicles or equipment and other signs otherwise attached to structures or supported by braces on the ground.

BLOCK
A platted tract of land entirely surrounded by public highways, streets, streams, railroad rights-of-way or parks or a combination thereof. In places where the platting is incomplete or disconnected, the Director shall determine the outline or perimeter of a block.
BLOCK FACE
The portion of a block that abuts a street.
BOARD
The Jefferson County, Missouri Board of Zoning Adjustment.
BOARD OF ZONING ADJUSTMENT
An officially constituted body whose principal duties are to hear appeals and, where appropriate, grant variances from the strict application of the zoning order. Also referred to as "Board of Adjustment" or "BOA".
BOARDING HOUSE OR LODGING HOUSE
A building, other than a hotel, occupied as a single housekeeping unit, where lodging or meals are provided for five (5) or more persons for compensation, pursuant to previous arrangements, but not for the public or transients.
BOAT DEALER
See "RECREATIONAL VEHICLE SALES".
BREWERY
A business shall be considered a brewery if its primary activity is the brewing and selling of beer, with an annual production in excess of ten thousand (10,000) barrels.

BROADCAST
To transmit information over the airwaves to two (2) or more receiving devices simultaneously, including transmission over local television or radio stations, satellite systems or wireless data communications networks.
BUFFER
An open and unpaved ground area around the perimeter of a tract of land that may include required screening so as to provide green space that is used to physically separate or screen one use or property from another so as to visually shield or block noise, lights or other nuisances.
BUFFERING
Something that lessens or absorbs the shock of an impact.
BUILDER
A person undertaking the construction of a residential, commercial or industrial improvement.
BUILDING
Any structure having a roof supported by columns or walls and intended for the shelter, housing or enclosure of any individual, animal, process, equipment, goods or materials of any kind.
BUILDING AND GROUNDS MAINTENANCE SERVICE
An establishment or place of business primarily engaged in the provision of maintenance and custodial services to firms, business or individuals. Typical uses include janitorial, mowing, landscape maintenance or window cleaning services.
BUILDING CODE
The Building Code as adopted by and as amended from time to time by Jefferson County, Missouri. The Building Code governs building design, construction and maintenance.
BUILDING COVERAGE
The floor area of the building at grade, also known as the building's footprint.
BUILDING ELEVATION
An exterior wall of a building exposed to public view.
BUILDING, EXISTING
A building erected prior to or for which a valid building permit has been issued prior to, and is valid on, the effective date of this UDO.
BUILDING HEIGHT
The vertical distance measured from the highest of the following three (3) levels:
1. 
From the street curb level;
2. 
From the established or mean street grade in case the curb has not been constructed; or
3. 
From the average finished ground level adjoining the building, where it sits from back of curb or street pavement to the highest point of:
a. 
The coping of a flat roof or to the deck line of a mansard roof (excluding roof top equipment and architectural fenestrations);
b. 
To the average height of the highest gable of a pitched roof or hipped roof; or
c. 
The maximum height of any segment of a stepped or terraced building except as exempted in Section 400.1690(A).
BUILDING LINE

BUILDING OFFICIAL
The Director of the Department of Land Use, Development and Code Enforcement of Jefferson County, Missouri, or his/her designee.
BUILDING PERMIT
The written permission issued by the Building Division for the construction, repair, alteration or addition to a structure.
BUILDING SETBACKS
The line delineating the limits of the required yard and establishing the point behind which a building can be constructed.
BULKHEAD
The retaining wall created along a body of water behind which fill is placed.
CAFO (CONCENTRATED ANIMAL FEEDING OPERATION)
A parcel of land with or without buildings, used or intended to be used for the confined feeding, breeding, raising or holding of animals in excess of three hundred (300) animal units and specifically designed to store and accumulate animal manure and other waste products in holding areas and lagoons. Animal unit is as defined by the rules of the Missouri Department of Natural Resources in effect as of January 30, 1996.
C-STORE
A convenience store. A store selling a limited variety of food and pharmaceutical items; open long hours for the convenience of customers.
CAMP
The plot of ground in which two (2) or more campsites are located, established or maintained for occupancy by camping units as temporary living quarters for recreation, education or vacation purposes.
CARPORT
A roofed structure providing space for the parking or storage of motor vehicles and enclosed on not more than three (3) sides.
CELLULAR TOWER
See "TOWER".
CENTRALIZED SEWERS
The system of sewers owned or operated by a municipality or a public or private sewer district or similar authority that conveys sewage to a wastewater treatment plant for treatment and disposal, holding a permit therefore from the Missouri Department of Natural Resources.
CERTIFICATE OF OCCUPANCY
A document issued by the Building Official allowing the occupancy or use of a building and certifying that the structure or use has been constructed and will be used in compliance with all the applicable County codes and regulations.
CHURCH, TEMPLE OR SYNAGOGUE
A building or group of buildings that are used to conduct organized religious services. Also referred to as a "place of worship".
CITY
Any incorporated municipality in Jefferson County, Missouri.
CLUB, CIVIC OR FRATERNAL ORGANIZATION
A membership association composed of persons who are bona fide dues paying members and to whom (and their guests) use of facilities owned or leased by the association is generally restricted. This definition shall include buildings owned or operated by a person for a social, educational or recreational purpose, but not primarily for profit and not primarily to render a service that is customarily carried on as a business. This definition shall include organizations such as the American Legion, Masonic Lodge and Veterans of Foreign War.
COMMISSION
The Planning and Zoning Commission of Jefferson County, Missouri.
COMMON GROUND
The land within or related to a development, that is designed and intended for the common use or enjoyment of the residents of the development and their guests and that may include such complementary structures and improvements as are necessary and appropriate. Also known as "common open space".
COMMON OPEN SPACE

COMMUNICATION TOWER
See "TOWER".
COMPREHENSIVE PLAN
The Jefferson County Official Master Plan, as amended.
CONCEPT PLAN
The schematic or conceptual design for land development, for informal review purposes, that carries no vesting rights or obligations on any party.
CONCEPTUAL DEVELOPMENT PLAN
The set of schematic plans or representative drawings to allow review of large scale, mixed use developments.
CONCEPTUAL LANDSCAPE PLAN
The generalized landscape plan indicating the boundaries of a tract or tracts under common ownership and identifying proposed landscaping types and locations on that tract or tracts.
CONDITIONAL USE
A use permitted in a particular zoning district only when separate regulations, i.e., conditions, imposed by the County Council to mitigate adverse impacts of the use are fully met.
CONDITIONAL USE PERMIT
A permit issued by the Director stating that the conditional use meets all conditions set forth by the County Council and the UDO.
CONDOMINIUM
Real estate, portions of which are designated for separate ownership and the remainder of which is designated for common ownership solely by the owners of those portions. Real estate is not a condominium unless the undivided interests in the common elements are vested in the unit owners.
CONDOMINIUM PLAT
A drawing prepared by a registered land surveyor which contains the information required by the provisions of Subsection (2) of Section 448.2-109, RSMo.
CONSTRUCTION CONTRACTOR
A person engaged in the construction of buildings, engaged in heavy construction (such as streets, bridges or utilities) or specialized in construction trades such as plumbing, heating and air-conditioning, electrical wiring, masonry, roofing or gutters, well drilling or house painting.
CONSTRUCTION EQUIPMENT
Any self-propelled or non-propelled equipment designed for off-road use in grading or construction, including trailers, attachments and component parts for this equipment.
CONSTRUCTION MATERIALS, SALES AND SERVICES
Establishments or places of business primarily engaged in the retail or wholesale sale of materials used in the construction of buildings or other structures, as well as construction activities and the outdoor storage of construction equipment or materials on lots other than construction sites. Typical uses may include lumberyards, building materials stores, tool and equipment rental or sales and building contractors.
CONSTRUCTION SITE
The authorized area of space to store construction materials, cranes or other equipment specifically used for construction and to conduct construction activities.
CONTINUANCE
The postponement or adjournment of a zoning or subdivision petition to a future meeting date.
CONVALESCENT, NURSING OR RETIREMENT HOME
An intermediate care facility primarily engaged in providing inpatient nursing and rehabilitative services to residents who require watchful care and medical attention or treatment, but not on a continuous basis, although staff is on duty twenty-four (24) hours per day.
COUNTY
The appointed staff (or designees) of Jefferson County, Missouri.
COUNTY CODE
This Unified Development Order or any other adopted code of Jefferson County, Missouri, as amended.
COUNTY COUNCIL
The Governing Body of Jefferson County, Missouri.
COUNTY ENGINEER
The Director of the Department of Public Works of Jefferson County, Missouri, or his/her designee.
COUNTY EXECUTIVE
The person who holds the office of County Executive as provided in Home Rule Charter of Jefferson County, Missouri.
COURT
An unoccupied open space, other than a yard on the same lot with a building, which is bounded on two (2) or more sides by the walls of such building. Also referred to as "courtyard".
COVENANTS
A document imposing restrictions on a parcel of property that runs with the land burdened by such restrictions and may be enforced by a proceeding in equity.
CREMATORY
The mortuary where corpses are cremated.
CUL-DE-SAC
A street having one (1) end open to traffic and being terminated by a vehicular turnaround.
CURB CUT
The opening along the curb line at which point vehicles may enter or leave the roadway (see Division 3 of this Article).
CURB LEVEL
The top of the curb at the average curb height in front of the lot or in the case of a corner lot, the point along the abutting streets where the curb level is the highest.
CUSTOM ORDER SHOP
A business establishment that offers handmade or special order merchandise, one of a kind original art work, home furnishings or similar merchandise, but which maintains no outside inventory on site other than display items.
DANCE CLUB
See Article V, Division 5, however, a dance club shall not include dance academics, schools or studios where dancing is permitted only by students and instructors engaged in dancing instruction.
DANCE STUDIOS OR SCHOOLS
Establishments wherein dancing is only allowed by students and instructors engaged in dancing instruction.
DATE OF SUBSTANTIAL COMPLETION
The date determined by the County when construction is adequately complete, in accordance with the approved plans, so the owner may occupy or utilize the work or portion noted for its approved purpose as detailed in the approved plans.
DAY
A calendar day reckoned from Midnight to Midnight unless otherwise noted in a Section of this UDO.
DAY CARE CENTER

DAY CARE FACILITY
Terms associated with day care facilities shall be defined as follows:
1. 
DAY CARE, GROUPA building occupied by a day care provider that receives less than ten (10) persons for care for any part of a twenty-four (24) hour day, without overnight stays.
2. 
DAY CARE CENTERA building occupied by a day care provider that receives more than ten (10) persons for care for any part of a twenty-four (24) hour day, without overnight stays.
DAY CARE HOME

DAYS (CALENDAR)

DECK
A platform greater than eighteen (18) inches in height and located in the side or rear yard serving as a floor and located above the finished grade that is usually directly adjacent or attached to a building.
DEDICATION
The intentional transfer by the developer, with the consent of the County Council, to the public ownership or of an interest in land for a public purpose.
DEFLECTED PATTERNS
To camouflage a communication tower by the use of materials, colors or textures eliminating the visual obtrusiveness of the tower or antenna.
DENSITY
The number of families, individuals, dwelling units, households or housing structures per unit of land.
DENSITY, CALCULATED
The resulting density number by subtracting from the total acreage of a site the acreage of areas that provide street right-of-way to or on the site, slopes in excess of fifty percent (50%) (2:1 slopes) and areas of floodway, then dividing by the zoning district's number of lots per acre. Also referred to as "site density".
DENSITY, SITE

DESIGN AND CONSTRUCTION MANUAL
The Design and Construction Manual of Jefferson County, Missouri, as amended.
DESIGN PROFESSIONAL
The architect, landscape architect, surveyor, arborist, forester or engineer registered or licensed to practice in the State of Missouri. When used in this UDO, this term shall apply to the professional with the qualifications to perform the work.
DESIGN SPEED
The maximum safe speed at which a vehicle can be expected to operate on a roadway (almost always substantially higher than the posted speed limit).
DESIGN STANDARDS
The set of guidelines and/or criteria defining parameters to be followed in site and/or building design and development.
DEVELOPER
A person who engages in development of land whether or not that person is the landowner.
DEVELOPMENT
Any manmade change to improved or unimproved land including, but not limited to, buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations, other than pre-development geotechnical investigation by an engineer registered or licensed to practice in Missouri.
DEVELOPMENT PLAN
The dimensioned presentation of the proposed development of a specified parcel of land that reflects thereon the location of buildings, easements, parking arrangements, public access, street pattern and other similar features.
DIRECTOR
The Director of County Services and Code Enforcement or a Jefferson County, Missouri, staff member assigned to act in his or her behalf.
DISPOSED OF AN INTEREST IN
To transfer or part with, as by giving or selling.
DISTILLERY
A business shall be considered a distillery if its annual production exceeds fifty thousand (50,000) proof gallons per year.

DOG RUN
An enclosed outdoor area intended for the exercising and/or containment of dogs and similar animals.
DRAINAGE AREA
That area in which all of the surface runoff resulting from precipitation is concentrated into a particular stream.
DRIVE-IN MOTION PICTURE THEATER
See "THEATER".
DRIVE-UP ESTABLISHMENT
A place of business that encourages customers to receive services or obtain goods, usually through a window or automated device, while remaining in their motor vehicle. This definition includes establishments or places of business such as dry cleaners, banks, pharmacies, grocery stores and any similar business. This definition does not apply to restaurants or package liquor establishments.
DWELLING
A building or portion thereof designed and used exclusively for residential occupancy. The following words or terms associated with dwelling shall have the following meanings:
1. 
FOUR-FAMILY DWELLING (FOURPLEX)A dwelling situated on one (1) lot occupied exclusively by four (4) families, respectively, in separate dwelling units living independently of each other.
2. 
GARDEN APARTMENT BUILDINGA multi-family dwelling in which a dwelling unit may be located above another.
3. 
LOFT DWELLINGA dwelling located above the first (1st) floor of a non-residential use such as a store or office.
4. 
MANUFACTURED HOMESee "MANUFACTURED HOME" in this Article.
5. 
MULTI-FAMILY DWELLINGA dwelling situated on one (1) lot occupied by three (3) or more families in separate dwelling units living independently of each other.
6. 
SINGLE-FAMILY ATTACHED DWELLING (TOWN HOUSE, TOWN HOME OR ATTACHED VILLA)Single-family dwellings sharing a common wall, but situated on separate lots designed to be occupied exclusively by separate families.
7. 
SINGLE-FAMILY DETACHED DWELLINGA dwelling situated on one (1) lot designed to be occupied exclusively by one (1) family.
8. 
THREE-FAMILY DWELLING (TRIPLEX)A dwelling situated on one (1) lot occupied exclusively by three (3) families, respectively, in separate dwelling units living independently of each other.
9. 
TWO-FAMILY DWELLING (DUPLEX)A dwelling situated on one (1) lot occupied exclusively by two (2) families, respectively, in separate dwelling units living independently of each other.
DWELLING UNIT
The one (1) or more rooms designed, occupied or intended for occupancy as separate living quarters with cooking, sleeping and sanitary facilities provided within the dwelling unit for the exclusive use of a single-family maintaining a household.
DWG FORMAT
The electronic format of an AutoCAD drawing file.
EARTHEN BERM
The mound of earth. (See Division 3 of this Article for illustration.)
EASEMENT
A grant to the public or a person, by the owner of land, for the use of a described area of the land for specified purposes, where fee simple title to the land remains with the property owner. (See Division 3 of this Article for illustration.)
EFFECTIVE DATE
The date the order adopting this UDO takes effect.
ELDER CARE HOME
The array of care services such as adult day service, assisted living facilities, home health care and specialized care services such as geriatric care management.
EMPLOYEE
Any and all persons, including managers and entertainers, who work in or at or render any services directly related to the operation of a business.
ENVIRONMENTAL IMPACT ASSESSMENT
The statement of the effect of proposed development and/or other major private or governmental actions on the environment required by Federal law. Also referred to as "EAS".
EROSION AND SEDIMENT CONTROL/STORMWATER MANAGEMENT DESIGN MANUAL
The design criteria adopted in writing by Jefferson County, Missouri.
EROSION AND SEDIMENT CONTROL/STORMWATER MANAGEMENT PLAN
A set of representational drawings or other documents for a land disturbance site approved by the County as a prerequisite to obtain a land disturbance permit.
EXISTING USE
The use of a lot or structure at the time of the effective date of this UDO.
FAMILY
Two (2) or more persons related by blood or marriage, including not more than two (2) lodgers or boarders, living together and occupying a single housekeeping unit with common kitchen facilities or a group of not more than four (4) persons (excluding servants), who need not be related by blood or marriage, living together by joint agreement and occupying a single housekeeping unit with common kitchen facilities.
FASCIA
A vertical plane that represents the transition from the eave height at the load-bearing walls to the roof line.
FEE SIMPLE
Ownership of real property, as fee simple absolute, whereby the owner owns a specified piece of land without being subject to defeasance or condition that would deprive the owner of title to the land.
FENCE
A freestanding structure not otherwise part of any building or other structure resting on or partially buried in the ground that forms a barrier and is used to delineate a boundary or as a means of confinement or privacy.
FINAL PLAT
The map of all or a portion of a subdivision that is presented to the approving authority for final approval.
FINIAL
The sculptured ornament, often in the shape of a leaf or flower, at the top of a gable, pinnacle or similar structure.
FLAG LOT
A lot that cannot be further subdivided according to this UDO, does not meet minimum frontage requirements and where access to the public road is by a private right-of-way or driveway. (See Division 3 of this Article for illustration.)
FLOOD FRINGE
The portion of the flood hazard area outside of the floodway. (See Division 3 of this Article for illustration.)
FLOOD HAZARD AREA
The floodplain consisting of the floodway and flood fringe area. (See Division 3 of this Article for illustration.)
FLOOD INSURANCE RATE MAP (FIRM)
The official map of the County on which the flood hazard boundaries and corresponding flood zones have been delineated, pursuant to the Flood Insurance Study establishing insurance rates applicable to the County.
FLOOD INSURANCE STUDY (FIS)
The official report provided by the Federal Emergency Management Agency. The report contains flood profiles, as well as the Flood Boundary/Floodway Map and the water surface elevation of the base flood.
FLOODPLAIN
The floodway and floodway fringe as identified by the Federal Insurance Program through its Flood Insurance Rate Map for Jefferson County, Missouri, dated April 5, 2006, and subsequent revisions. (See Division 3 of this Article for illustration.)
FLOODPLAIN DEVELOPMENT PERMIT
The permit issued by the approving authority to allow any manmade change to improved or unimproved real estate including, but not limited to, buildings or other structures, mining, dredging, filling, grading, paving, excavation or dwelling operations or storage of equipment or materials.
FLOODWAY OR REGULATORY FLOODWAY
The channel of a river or other watercourse and the adjacent floodplain areas that must be kept free of encroachment so that the one percent (1%) annual chance flood can be carried without substantial increase in flood heights.
FLOOR AREA, GROSS (GFA)
The sum of the gross horizontal areas of the several floors, measured in square feet, including the basement floor, measured from the exterior faces of the exterior walls or from the centerline of walls separating two (2) buildings. The total floor area of a building shall also include elevator shafts and stairways at each floor, floor space used for mechanical equipment, penthouses, interior balconies and mezzanines, enclosed porches and floor area devoted to accessory uses. The total floor area shall not include areas or space devoted to off-street parking or loading and uncovered porches, terraces and loading docks.
FLOOR AREA, NET (NFA)
The sum of the net horizontal floor area of the several floors of a building measured from the exterior faces of the exterior walls or from the interior faces of walls separating two (2) buildings.
1. 
The net floor area of a building does not include:
a. 
Basements, when used for storage;
b. 
Enclosed porches;
c. 
Floor area devoted exclusively to storage;
d. 
Entrance lobbies;
e. 
Interior covered common areas designed primarily for pedestrian circulation;
f. 
Public restrooms;
g. 
Floor space occupied by mechanical, telephone and electrical equipment and mechanical penthouses;
h. 
Stairwells, escalators and elevator shafts; and
i. 
Interior off-street parking and loading areas.
2. 
The net floor area of a building does not include:
a. 
Basements, when used for other than storage;
b. 
Penthouse, excluding mechanical penthouses;
c. 
Interior balconies and mezzanines, excluding those designed and used as pedestrian common space; and
d. 
Attic space, when not used for storage but occupied by one (1) or more persons.
FLOOR AREA RATIO (FAR)
The numerical value obtained through dividing the gross floor area of a building or buildings by the area of the lot on which the building or buildings are located. (See Division 3 of this Article for illustration.)
FOUR-FAMILY DWELLING (FOURPLEX)
See "DWELLING, MULTI-FAMILY".
FOUR-SIDED ARCHITECTURE
The display, design or construction of all sides of a building with similar architectural details, materials and colors to avoid the appearance of a back side of any wall.
FRATERNAL ORGANIZATION
See "CLUB, CIVIC OR FRATERNAL ORGANIZATION".
FREIGHT AGENCY OR SHIPPING COORDINATOR
An establishment primarily engaged in the remote arrangement of freight or cargo transportation and not located where the freight or cargo is handled, stored or transported.
FREIGHT TERMINAL
A building or premises where trucks load and unload cargo and freight and where the cargo and freight may be broken down or aggregated into smaller or larger loads for transfer to other vehicles or modes of transportation.
FRONTAGE
That side of a lot abutting a right-of-way line or access easement.
FRONTAGE ROAD
See "STREET".
GARAGE
An accessory building of a main building that is primarily used for storage of a motor vehicle.
GARDEN APARTMENT BUILDING
See "DWELLING".
GARDEN CENTER
A business that sells garden equipment, seeds and associated supplies.
GOVERNING BODY
The County Council of Jefferson County, Missouri.
GRADE
The average elevation of the finished surface of the ground, paving or sidewalk within the area between the building and property line or, when the property line is more than five (5) feet from the building, between the building and a line five (5) feet from the building.
GRADE, STREET
The slope of a road, street or other public way specified in percentage of vertical to horizontal measurements.
GREEN SPACE
See "OPEN SPACE".
GREENHOUSE
A building whose roof and sides are made largely of glass or other transparent or translucent material and in which the temperature and humidity can be regulated for the cultivation of plants for subsequent sale or for personal enjoyment.
GREENWAY
The linear open space established along either a natural corridor, such as a riverfront, stream valley or ridge line, or over land along a railroad right-of-way converted to recreational use, a canal, a scenic road or other route.
GROCERY STORE, GENERAL
Establishments with ten thousand (10,000) or greater square feet of gross floor area or more that are primarily engaged in the retail sale of food or household products for home consumption. Typical uses include large grocery stores (including the sale of beer and wine in unopened containers for off-premises consumption or where revenue from the sale of groceries comprises at least fifty-one percent (51%) of the gross income of the establishment during a calendar year and where at least fifty-one percent (51%) of the total display or shelf space is devoted to groceries other than beer and wine), delicatessens, meat markets, retail bakeries and candy shops.
GROCERY STORE, LIMITED
Establishments less than ten thousand (10,000) square feet of gross floor area that are primarily engaged in the retail sale of food or household products for home consumption. Typical uses include those uses specified for grocery store, general.
GROUP HOME FOR PERSONS W/DISABILITIES, HOSPICE OR SPECIAL CARE
A home for persons with disabilities, including hospice and/or other special care needs, or a residential facility where meals, lodging, supervision and training are provided. Halfway houses and detention facilities are not included in this definition.
GUEST HOUSE
An accessory use to a dwelling designed and intended for the housing of visitors to a property at the invitation of the property residents and meeting or exceeding the standards for single-family dwellings.
HALFWAY HOUSE
An establishment primarily engaged in the provision of personal care and services related to parolees, prisoners or juveniles who have been released from prison, jail or assigned to a residential care facility by a court of law.
HEALTH CLUB OR FITNESS CENTER
A business that provides facilities for aerobic exercises, such as running and jogging tracks, exercise equipment, game courts, gymnasium and/or swimming facilities.
HEDGEROWS
The row of trees and other vegetation along a property line, typically associated with a farm.
HELIPORT
An area of land or water or a structural surface that is used for the landing and taking off of helicopters and any appurtenant areas that are used for helicopter buildings and other facilities as may be required by State and Federal regulations.
HIGH IMPACT SCREENING
A one hundred percent (100%) opaque screen between land uses that are dissimilar in character.
HIGHWAY
See "STREET".
HISTORIC PRESERVATION
The identification, evaluation, protection, rehabilitation and restoration of districts, sites, buildings, structures and artifacts significant in history, architecture, archaeology or culture.
HOME OCCUPATION
An activity conducted in a dwelling unit as an economic enterprise or for financial gain by members of the household residing therein that is clearly incidental and secondary to the use of the dwelling unit for residential purposes. The home occupation shall employ no more than one (1) employee on the premises other than the residents(s) of the home and is limited to one-third (1/3) of the gross floor area. Home occupations exclude tandem axle vehicle storage and any other form of outdoor storage.
HOMEOWNERS' ASSOCIATION
The community association, other than a condominium association, that is organized in a development in which individual owners share common interests and responsibilities for costs and upkeep of common open space or facilities.
HOSPITAL
An institution providing primary health service and medical and surgical care to persons suffering from illness, disease, injury, deformity and other abnormal physical or mental conditions. This shall include, as an integral part of the institution, related facilities, such as laboratories, outpatient facilities or training facilities.
HOTEL
A building or portion thereof offering lodging accommodations to the general public for compensation and that may provide additional services, such as restaurants, meeting rooms and recreational facilities.
IMPERVIOUS AREA
The surface that has been compacted or covered with a layer of material so that it is highly resistant to infiltration by water.
IMPERVIOUS COVERAGE
The total ground area covered by all buildings, roofed or covered spaces, paved surface areas, walkways and driveways, including in-ground and above ground swimming pool, and any other site improvements or structures contributing to runoff greater than would occur on the site in its natural state.
IMPROVEMENT
Any manmade item or alteration that becomes part of, is placed in or is affixed to land with the intention of being permanent.
IMPROVEMENT PLAN
The engineering drawings intended to be used in the construction of street, trail, water, sewer, drainage, drainage facilities, landscape facilities and appurtenances.
INDUSTRIAL USE
An economic activity involving construction, manufacturing, warehousing, wholesale trade and associated service uses as defined by this UDO.
INOPERATIVE VEHICLE
See "VEHICLE, INOPERATIVE".
INTEGRAL CURB (INTEGRAL SIDEWALK)
See "TYPE CG-1 CONCRETE CURBING".
INTERFERENCE
Disturbances in reception caused by intruding signals or electrical current.
JEFFERSON COUNTY OFFICIAL MASTER PLAN
The public document adopted by the County with the general purpose of guiding and accomplishing coordinated development of the County, which will, in accordance with existing and future needs, best promote the general welfare, as well as efficiency and economy in the process of development. As such, it is the intent of the Official Master Plan that its policies, strategies and recommendations be used as flexible guides to decisions regarding land use, transportation and streets, economic development and public facilities. Also referred to as "Official Master Plan".
JPEG FORMAT
The format of the standard algorithm for the compression of digital images.
JUNK YARD, WRECKING YARD, SALVAGE YARD OR SCRAP YARD
A place where waste, discarded or salvaged metals, inoperative vehicles and other materials are bought, sold, exchanged, stored or baled. For the purposes of this definition, any lot containing more than two (2) inoperative vehicles shall be considered a junk yard.
KENNEL
Any person, group of persons or corporations engaged in breeding, buying, selling, sheltering or boarding of six (6) or more domestic animals, for profit, or the premises where such breeding, buying, selling, sheltering or boarding takes place, shall be deemed to be the operator of a kennel.
LABORATORY
A building or portion thereof in which scientific, medical or dental research, investigation, testing or experimentation is conducted.
LAND CORNER RE-ESTABLISHMENT
The remonumentation of a lost corner using statutory procedures by a Missouri registered land surveyor.
LAND CORNER RESTORATION
The remonumentation of an existent or obliterated corner from survey records, physical evidence or testimony by a Missouri registered land surveyor.
LAND DISTURBANCE
Any activity involving the clearing, cutting, excavating, filling or grading of land or any other activity that alters land topography or vegetative cover. A land disturbance permit is required when one (1) acre or more of land is disturbed.
LAND DISTURBANCE PERMIT
The written permission issued by Jefferson County to allow the clearing, cutting, excavating, filling or grading of land or any other activity that alters land topography or vegetative cover. A land disturbance permit is required when one (1) acre or more of land is disturbed.
LANDOWNER
Any person having a legal title to the property or is an owner under contract.
LAUNDRY, DRY CLEANING OR GARMENT SERVICE
Establishments primarily engaged in the provision of laundering, dry cleaning, clothing alterations or dyeing services.
LAWFUL NON-CONFORMING USE
The area, building or use lawfully occupied by a building or land use at the time the UDO or amendments thereto take effect and which does not conform with the use regulations of the district in which it is located.
LICENSED PROFESSIONAL
See "DESIGN PROFESSIONAL".
LIQUOR STORE
An establishment or place of business that is primarily engaged in retail sale for off the premises consumption of alcoholic beverages. Typical uses include liquor stores, bottle shops or any licensed sales of liquor, beer or wine for off-site consumption.
LIVESTOCK
Animals used for the production of food or products such as, but not limited to, cattle, sheep, goats, hogs or poultry.
LOADING AREA
An area used for loading or unloading of goods from a vehicle in connection with the use of the site on which a loading space is located.
LOFT DWELLING
See "DWELLING".
LOT
A parcel of land occupied by or intended for a use allowed in this UDO, including one (1) main building together with its accessory buildings, open spaces and parking spaces required by this UDO and having its principal frontage upon a street or road as established by this UDO. The word "lot" shall include the word "plot", "tract" or "parcel". The derivations of lot shall maintain the following definitions:
1. 
LOT AREAThe area of a horizontal plane bounded by the front, rear and side lot lines.
2. 
LOT, CORNERA lot abutting two (2) or more streets at their intersection.
3. 
LOT DEPTHThe mean horizontal distance between the front and rear lot lines.
4. 
LOT, DOUBLE FRONTAGEA lot having frontage on two (2) non-intersecting streets, as distinguished from a corner lot. This definition shall include through lots.
5. 
LOT, INTERIORA lot other than a corner lot whose sides do not abut upon any street.
6. 
LOT LINEThe property boundary line of any lot. The derivations or modifications of lot line shall maintain the following definitions.
a. 
LOT LINE, FRONTThe lot line abutting a street or private drive. In the case of a corner lot, there shall be two (2) front lot lines. In the case of a double frontage lot, the front lot line shall be the lot line adjacent to the street that provides primary access to the lot or towards which the main building on the lot is oriented.
b. 
LOT LINE, REARAny lot line that is not a front lot line or a side lot line.
c. 
LOT LINE, SIDEAny lot line that intersects the front lot line. A side lot line shall include any linked line segments or arcs that have a bearing which is within forty-five degrees (45°) of a line drawn perpendicular to the front lot line. Corner lots shall have two (2) side lot lines.
7. 
LOT WIDTHThe horizontal distance between the side lot lines, on a line parallel or tangent to the front building line.
LOT OF RECORD
A lot with respect to which the plat or deed has been properly recorded, prior to the effective date of this UDO.
LOW IMPACT SCREENING
The screen between relatively similar land uses.
MAIN BUILDING
The primary or principal building on a lot or a building that houses a main use.
MAIN USE
The primary or predominant use of land, building or structure.
MAINTENANCE AGREEMENT
The agreement of facilities or work to ensure the correction of any failures of any improvements required pursuant to this order and regulation or to maintain the same.
MAJOR COLLECTOR
See "STREET".
MANUAL OF UNIFORM TRAFFIC CONTROL DEVICES (MUTCD)
The national publication from the U.S. Department of Transportation that outlines the proper usage of traffic control devices. It contains the national standards for the design, application and placement of signs, signals, pavement markings and other types of traffic control devices.
MANUFACTURED HOME
A structure that is governed by the Federal manufactured home construction and safety standards established pursuant to the National Manufactured Home Construction and Safety Standards Act, 42 U.S.C. Section 5403.
MANUFACTURED HOME PARK
Any lot or parcel under single ownership on which two (2) or more manufactured homes are to be located or intended to be located for purposes of residential occupancy.
MANUFACTURED HOME SALES
A premises on which manufactured homes are displayed for sale.
MANUFACTURING
An economic activity involving the mechanical or chemical transformation of materials or substances into new products, including the assembly of component parts, the manufacturing of products and the blending of materials, such as lubricating oils, plastics, resins or liquors.
MANUFACTURING, HEAVY
The extraction of natural resources or the transformation of raw materials through mechanical or chemical means into basic products for subsequent assembly, fabrication or use in the production of finished goods.
MANUFACTURING, LIGHT
A use engaged in the manufacture of finished products or parts, predominantly from previously prepared materials, including processing, fabrication, assembly, treatment and packaging of such products and incidental storage, sales and distribution of their products. The manufacture of industrial solvents and cleaners shall be included.
MARIJUANA
Cannabis indica, Cannabis sativa, and Cannabis ruderalis, hybrids of such species, and any other strains commonly understood within the scientific community to constitute marijuana, as well as resin extracted from the plant and marijuana-infused products. "Marijuana" or "marihuana" do not include industrial hemp containing a crop-wide average tetrahydrocannabinol concentration that does not exceed three-tenths (3.0) of one percent (1%) on a dg weight basis, or commodities or products manufactured from industrial hemp.

MARIJUANA CULTIVATION FACILITY
A facility licensed by the State of Missouri to acquire, cultivate, process, store, transport, and sell marijuana to a marijuana dispensary facility, marijuana testing facility, or to a marijuana-infused products manufacturing facility.

MARIJUANA DISPENSARY FACILITY
A facility licensed by the State of Missouri to acquire, store, sell, transport, and deliver marijuana, marijuana-infused products, and drug paraphernalia used to administer marijuana as provided by the State of Missouri to a consumer, qualifying patient, a primary caregiver, another marijuana dispensary facility, a marijuana testing facility, or a marijuana-infused products manufacturing facility.

MARIJUANA FACILITY
Any marijuana cultivation facility, marijuana dispensary facility, marijuana testing facility, marijuana-infused products manufacturing facility, or marijuana transportation facility as defined by this Code.

MARIJUANA TESTING FACILITY
A facility licensed by the State of Missouri to acquire, test, certify, and transport marijuana.

MARIJUANA TRANSPORTATION FACILITY
A facility certified by the State of Missouri to transport marijuana to a consumer, qualifying patient, a primary caregiver, a marijuana cultivation facility, a marijuana-infused products manufacturing facility, a marijuana dispensary facility, a marijuana testing facility, or another marijuana-transportation facility.

MARIJUANA-INFUSED PRODUCTS
Products that are infused with marijuana or an extract thereof and are intended for use or consumption other than by smoking, including, but not limited to, edible products, ointments, tinctures and concentrates.

MARIJUANA-INFUSED PRODUCTS MANUFACTURING FACILITY
A facility licensed by the State of Missouri to acquire, store, manufacture, transport, and sell marijuana-infused products to a marijuana dispensary facility, a marijuana testing facility, or another marijuana-infused products manufacturing facility.

MASSAGE
Any method of pressure on or friction against or stroking, kneading, rubbing, tapping, pounding, vibrating or stimulating of the external soft parts of the body with the hands or with the aid of any mechanical or electrical apparatus or appliance, with or without such supplementary aids as rubbing alcohol, liniments, antiseptics, oils, powder, creams, lotions, ointments or other similar preparations commonly used in this practice. The term "massage" is synonymous with the term "therapeutic massage".
MASSAGE FACILITY
An establishment where any person performs massage or permits massage to be performed for compensation.
MASSAGE THERAPIST
A person who has completed all the requirements for a massage therapist license to practice massage therapy and who is in receipt of a business license from the County. A massage therapist may perform massage for compensation, but only at a licensed massage facility.

MATURE WOODLANDS
The old growth forests are relatively old and relatively undisturbed by humans.
MEDICAL OR DENTAL OFFICE
See "OFFICE".
MEDIUM IMPACT SCREENING
The seventy percent (70%) semi-opaque screen between land uses that are dissimilar in character.
MICROBREWERY
A business shall be considered a microbrewery if its primary activity is the brewing and selling of beer, with an annual production of ten thousand (10,000) barrels or less.

MICRODISTILLERY
A business shall be considered a microdistillery if its annual production does not exceed fifty thousand (50,000) proof gallons per year.

MICROWAVE
Electromagnetic radiation with frequencies higher than one thousand (1,000) MHz; highly directional signal used to transmit radio frequencies from point to point at a relatively low power level.
MINING
The removal of overburden and extraction of underlying minerals or the extraction of minerals from exposed natural deposits for a commercial or industrial purpose.

MINI-STORAGE

MINI-WAREHOUSE
A structure containing separate storage areas of varying sizes that are leased or rented on an individual basis.
MINOR COLLECTOR

MITIGATION
The methods used to alleviate or lessen the impact of development.
MIXED USE
The development of a neighborhood, tract of land, building or structure with a variety of complementary and integrated uses, such as, but not limited to, residential, office, manufacturing, retail, public and recreation, in a compact form.
MOBILE HOME
A transportable, factory-built structure designed to be used as a year-round residential dwelling, built after the enactment of the National Manufactured Home Construction and Safety Standards Act, 42 U.S.C. Section 5403, which became effective June 15, 1976.
MODULAR UNIT
A factory-fabricated transportable building unit designed to be used by itself or to be incorporated with similar units at a building site into a modular structure to be used for residential, commercial, educational or industrial purposes. Modular units do not include structures defined as manufactured or mobile homes or building units constructed with an integral chassis and attached wheels.
MOGRS
The Missouri Department of Natural Resources Division of Geology and Land Survey.
MOTEL
A building primarily offering transient lodging accommodations to the general public for compensation with access from each room to a readily accessible off-street parking area for use by the patrons of the building. This definition shall also include motor lodges.
MOTION PICTURE THEATER

MOTOR VEHICLE
See "VEHICLE, MOTOR".
MOTORCYCLE SALES OR SERVICE
The use of any building or premises for the display and sale of new or used motorcycles, scooters, all-terrain vehicles or mopeds and which may include any repair service conducted as an accessory use.
MULTI-FAMILY
Of, relating to or intended for use by several families.
MULTI-FAMILY DWELLING
See "DWELLING".
MUNICIPALITY
The County and any other City, Village or political subdivision of this State organized under the Constitution of the State of Missouri or under laws of the State of Missouri or by decision of a court of relevant jurisdiction determined to be a municipal corporation.
NAICS (NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM; MANUAL)
The standard code system to describe and classify business establishments based on the activities in which they are primarily engaged.
NATURAL BUFFER
The zone where native existing vegetation capable of filtering storm water is preserved or established and where construction paving or destructive chemical application are prohibited.
NATURAL PRESERVE
The areas intended to remain in a predominately natural or undeveloped state to provide resource protection and possible opportunities for passive recreation and environmental education for present and future generations.
NATURAL RESOURCES
The existing non-manmade elements relating to land, water, air, plant and animal life including, but not limited to, soils geology, topography, surface and subsurface waters, wetlands, vegetation and animal habitats.
NAVD DATUM
The North American Vertical Datum which is the vertical control datum established by the United States.
NEIGHBORHOOD
An area of a community with characteristics that distinguish it from other areas and that may include distinct ethnic or economic characteristics, housing types, schools or boundaries defined by physical barriers, such as major highways and railroads or natural features, such as water bodies or topography.
NEIGHBORING
Those lands located in the same geographical area and not separated by a primary street, railroad, separating water body or similar physical feature.
NGS
The National Geodetic Survey, a Federal agency that defines and manages a national coordinate system. This network, the National Spatial Reference System (NSRS), provides the foundation for transportation and communication; mapping and charting; and a multitude of scientific and engineering applications.
NON-ATTAINMENT AREA
The geographic area in which the level of air pollution is higher than the level allowed by nationally or State accepted standards for one (1) or more pollutants.
NON-CONFORMING LOT
A lot existing on the effective date of this UDO that does not meet the minimum area requirements of the zoning district in which the lot is located.
NON-CONFORMING SIGN
A sign that, on the effective date of this UDO, does not conform to any one (1) or more of the regulations set forth in this UDO.
NON-CONFORMING SITUATION
A situation that occurs when, on the effective date of this UDO, an existing lot, structure or improvement or the use of an existing lot, structure or improvement no longer conforms to one (1) or more of the regulations applicable to the zoning district in which the lot, structure or improvement is located.
NON-CONFORMING STRUCTURE
A building or other structure that existed prior to the adoption of the UDO or any amendment thereto, which does not presently conform to the UDO or its amendments.
NON-CONFORMING USE
The use, activity, lot, structure or development that existed prior to the adoption of the UDO or any amendment thereto, which does not presently conform to the UDO or its amendments.
NON-PLANNED DISTRICT
Those zoning districts that do not require a development plan approval prior to the issuance of a permit.
NPDES
The National Pollutant Discharge Elimination System (NPDES) permit program controls water pollution by regulating point sources that discharge pollutants into waters of the United States.
NURSERY
Land or structures used to raise flowers, shrubs, trees and other plant material for retail or wholesale sale.
NURSING HOME
See "CONVALESCENT, NURSING OR RETIREMENT HOME".
OCCUPANCY
1. 
The residing of an individual or individuals overnight in a dwelling unit or the storage or use of equipment, merchandise or machinery in any public, commercial or industrial building.

OFFICE
The use of any building or premises primarily for conducting the affairs of a business, profession, service, industry or government and generally furnished with desks, tables, files and communication equipment.

The newspaper utilized by Jefferson County for placement and advertisement of public notices.
OFFICIAL MASTER PLAN
The Jefferson County Official Master Plan 2003, as may be amended from time to time.
OFF-STREET PARKING SPACE
An area that is not within the paved area of a street that is designated for the temporary parking of a motor vehicle, with direct or indirect access to a dedicated street or right-of-way.
ON-SITE SEWAGE TREATMENT SYSTEM
Any system handling or treatment facility receiving domestic sewage which discharges into a subsurface soil absorption system and discharges less than three thousand (3,000) gallons per day. Also referred to as "on-site wastewater disposal system", "on-site sewage system", "septic system" or "individual system".
OPEN SPACE
Any parcel of land or water essentially unimproved or otherwise devoid of structures and paved areas set aside, dedicated, designated or reserved for public or private use or enjoyment or for the use and enjoyment of owners and occupants of land adjoining or neighboring this open space.

COMMON OPEN SPACEUsable land area of a site that is available to all occupants of a development on a continuing and permanent basis and is not covered by buildings (except non-commercial recreational facility) or rights-of-way. Also referred to as "common ground".

OUTBOUNDARY

OUTBOUNDARY SURVEY
A drawing and descriptive narrative showing the distances and bearings of all exterior boundaries of a tract of land meeting Missouri Minimum Standards as defined in the Code of State Regulations by the Missouri Department of Natural Resources.
OUTBUILDINGS
The separate accessory buildings or structures not physically connected to the principal building.
OUTDOOR DISPLAY AREA
A portion of a property outside of any building where merchandise, goods or other items are placed in public view for the purpose of direct sale or lease to customers.
OUTDOOR STORAGE
The keeping of any goods or merchandise in an unroofed, open area in the same place for more than twenty-four (24) hours. Outdoor storage does not include vehicles, junk material or any construction equipment.
OUTER ROAD
See "FRONTAGE ROAD".
OUTPARCEL
A lot deeded separately from a larger tract for individual development, but generally sharing access with the larger tract.
OVERLAY ZONE
A geographical area that imposes additional requirements above those required by the zoning district(s) for that area.
OWNER
Any person or group of persons having legal and equitable title in the land sought to be subdivided or developed, pursuant to this UDO.
PACKAGE TREATMENT FACILITY
A space-efficient wastewater treatment plant that combines two (2) or more stages of treatment into one (1) stage.
PAD
The paved space, with utility connections, in a mobile home park for the parking of a mobile home.
PAINTBALL
The game in which players on one (1) team seek to eliminate those on an opposing team by marking them with a water-soluble dye shot in capsules from air guns.
PARAPET WALL
Any wall that extends above the roof line.
PARK
Open space with natural vegetation and landscaping intended for outdoor recreational use that may or may not include recreational facilities.
PATIO
A level, unenclosed surfaced area located at the finished grade that is adjacent to an attached building. Patio does not include a deck.
PAWNSHOP
A type of used merchandise store in which merchandise is offered as collateral for obtaining loans and wherein this merchandise is offered for sale in recompense for default of loan repayment.
PEDESTRIAN WAY
A right-of-way or easement dedicated or otherwise assigned to public use that cuts across a block to facilitate pedestrian access to adjacent streets and properties.
PENTHOUSE
The enclosed structure located on the roof of a building. (See Division 3 of this Article for illustration.)
PERFORMANCE GUARANTEE AGREEMENT
Any security that may be accepted by the County to ensure that the improvements required as part of an application for development will be satisfactorily completed.
PERFORMANCE STANDARD
A criterion to control noise, odor, smoke, toxic or noxious matter, vibration, fire and explosive hazards, heat, glare or other effects generated by or inherent in the uses of land or buildings. This UDO may also establish other criteria for various land uses.
PERFORMING ARTS THEATER
See "THEATER".
PERMITTED USE
Any use allowed in a zoning district and subject to the restrictions applicable to that zoning district.
PERSON
Any individual, partnership, corporation, trust, incorporated or unincorporated association, marital community, joint venture, governmental entity or other entity or group of persons however organized.
PERSONAL WIRELESS FACILITY OR SERVICE
An establishment or service providing wireless telecommunication services, as described by the Telecommunications Act of 1996, including:
1. 
Antennas and transmitting and receiving equipment for personal wireless services;
2. 
Commercial mobile radio services (including cellular, PCS, enhanced specialized mobile radio, specialized mobile radio and paging);
3. 
Unlicensed wireless services; and
4. 
Common carrier wireless exchange.
PERVIOUS PAVEMENT
The pavement that permits full or partial absorption of storm water into the underlying soil.
PHASING PLAN
The development plan undertaken in a logical time and geographical sequence.
PHOTOMETRIC PLANS
The engineered point-by-point illumination plan that shows expected security lighting levels in foot-candles of every ten (10) feet on center. A photometric plan is required to provide lighting levels for the entire site.
PILASTERS
The columns partially embedded in the walls and usually non-structural.
PLANNED DEVELOPMENT
The contiguous land area of a minimum size, as specified by district regulation, to be planned and developed using a common plan approved by the County as the master zoning plan for the land area and containing one (1) or more uses and appurtenant common area.
PLANNED DISTRICT
A zoning district provided in this UDO that requires the submittal and approval of a development plan before a subdivision can be reviewed or a permit issued.
PLANNING AND ZONING COMMISSION (P and Z)
The group of people appointed by the County Executive with approval of the County Council of Jefferson County, Missouri, that administers planning and land use regulations for the County, conducts public hearings, and provides recommendations on a wide array of land use and land use policy issues, with authority as specified by this UDO and State Statute. Also referred to as the “Planning Commission” in this UDO.

PLANT NURSERY, GREENHOUSE (COMMERCIAL)
Any business engaging in the commercial sale of bedding plants, trees, bushes, landscaping materials, garden tools, garden fertilizers, soil and other kindred products.
PLAT, FINAL
A complete and exact subdivision plat prepared for official recording, as required by State Statute and this UDO, to define property boundaries and proposed streets and other improvements.
PLAT, PRELIMINARY
A formal proposed plan for a subdivision prepared in accordance with the provisions of this UDO.
PLATTED
Lots, streets, common ground and any other real property that is included within a final plat, minor subdivision plat or boundary adjustment plat recorded with the Recorder of Deeds.
PLAY AREA
An improved and equipped area for the play of children. Also called "playground".
PLAYGROUND
The publicly owned area for recreational use primarily by children.
POLE GUYS
The wires and ground anchors that support in whole or in part a communication tower.
PORCH
A platform that may be screened, projecting from the wall of a building and with direct access to or from a building. Porch does not include a deck.
PRE-APPLICATION CONFERENCE
The meeting that is intended to provide potential applicants, landowners and those in the development community general information regarding zoning, site plan and preliminary plat information, development review process information and design review information prior to the formal submittal of the project.
PREFERRED GROWTH ALTERNATIVE
The future land plan of the Official Master Plan, adopted by Jefferson County, Missouri, that maps a strategy for future growth and preservation throughout the County by an established development priority of primary and secondary growth areas and reserve areas.
PRELIMINARY PLAT
See "PLAT, PRELIMINARY".
PREMISES
An area of land with its appurtenances and buildings that, because of its unity of use, is one (1) unit of real estate.
PRIMARY STREET
See "STREET" or Article VII, Functional Classification of Streets.
PRINCIPAL BUILDING (USE)
The building in which is conducted the principal use of the lot on which it is located.
PROFESSIONAL OFFICE
See "OFFICE".
PROFESSIONAL OR TRADE ASSOCIATION
A private organization that promotes the interests of business groups, such as the Chamber of Commerce; professions, such as the Bar Association; or members of a trade, such as a labor union.
PROHIBITED USE
A use that is not permitted in a zoning district by right, as an accessory use or with a conditional use permit.
PROPERTY OWNERS' ASSOCIATION
The group that governs a subdivision, condominium or planned community. The association may collect annual or monthly fees from all owners to pay for common area maintenance, address legal and safety issues and enforce the covenants, conditions and restrictions set by the developer.
PROTEST PETITION
The formal written application of disapproval or objection by a concerned person, group or organization requesting the County Council for a specific judicial action in accordance with this UDO.

PUBLIC ADMINISTRATION OFFICE
The office of a recognized Federal, State or local governmental agency for the conduct of that legislative, judicial, administrative or regulatory profession.
PUBLIC FACILITIES
Any facility including, but not limited to, buildings, property, recreation areas and roads which are leased or otherwise operated or funded by a governmental body or public entity.
PUBLIC HEARING
A meeting announced and advertised in advance that is open to the public and at which the public is given an opportunity to speak and participate.
PUBLIC IMPROVEMENTS
Street pavements, curb and gutters, sanitary and storm sewers, permanent street monuments, water mains and other related items that are owned by a political subdivision or public utility.
PUBLIC WORKS DIRECTOR
The Director of the Jefferson County Department of Public Works or, unless otherwise noted in this UDO, his/her designee.
RADIO TRANSMITTING AND RECEIVING ANTENNA

RECREATION FACILITY, COMMERCIAL
Commercial establishments or places of business primarily engaged in the provision of sports, entertainment or recreation for participants or spectators. Recreation as defined here does not include "adult entertainment".
RECREATION FACILITY, NON-COMMERCIAL
Private outdoor playgrounds and recreational facilities that are accessory uses to a subdivision, apartment development, church or other noncommercial principal use or public outdoor playgrounds and recreational facilities owned or operated by a political subdivision of the State.
RECREATION VEHICLE SALES, LEASE AND RENTAL
The sale, lease or rental of recreation vehicles, such as travel trailers, campers, boats and personal watercraft, including incidental storage, maintenance and servicing.
RECREATIONAL VEHICLE
A portable vehicular structure without a permanent foundation that can be towed, hauled or driven and is primarily designed as a temporary living accommodation for recreational, camping and travel use and includes, but is not limited to, travel trailers, truck campers, camping trailers, tent trailers, fifth-wheel trailers and self-propelled motor homes.
RECREATIONAL VEHICLE DEALER
An establishment or place of business primarily engaged in the sale of new or used recreational vehicles and which may include any repair service conducted as an accessory use.
RECYCLABLE MATERIAL

RECYCLING FACILITIES
An establishment, place of business or use of land for the collection of materials for the purpose of crushing, melting, rendering or reconstitution and reuse of the same materials. Recyclable materials include, but are not limited to, paper, newspaper, plastic, aluminum cans, metal, cardboard and magazines. Terms associated with recycling are defined as follows:
Facilities that accept recyclable materials:
1. 
RECYCLING COLLECTION FACILITYA facility for the deposit or drop-off of recyclable materials. A recycling collection facility is not a salvage yard. This type facility does not do processing except limited baling, batching and sorting of materials. It is designed to allow for a combination of bins, boxes, trailers, reverse vending machines and other containers for the collection of recyclable materials.
2. 
RECYCLING PROCESSING FACILITYA processing facility receives material from the public and/or other recycling facilities and uses power-driven machinery to prepare materials for efficient shipment by such means as flattening, sorting, compacting, baling, shredding, grinding and crushing.
3. 
REVERSE VENDING MACHINEMechanical devices that accept one (1) or more types of empty beverage containers and issue a cash refund or redeemable coupon.
4. 
RECYCLABLE MATERIAL"Feedstock" used for direct conversion to manufactured products. It includes, but is not limited to, cans, bottles, plastic and paper. Items composed of more than one (1) material, such as salvaged vehicular parts, are generally not considered a recyclable material.
RECYCLING PROCESSING FACILITY

REPAIR
The reconstruction or renewal of any part of an existing structure, improvement or fixture.
REPAIR SHOP, MISCELLANEOUS
A business establishment primarily engaged in specialized repair services, such as bicycle repair, leather goods repair, lock and gun repair, musical instrument repair, cleaning, furnace cleaning and taxidermists.
RESEARCH SERVICES
Establishments primarily engaged in research of an industrial or scientific nature, but excludes final product testing. Typical uses include electronics research laboratories, space research and development firms, medical laboratories or pharmaceutical research labs.
RESIDENCE
A dwelling unit.
RESIDENTIAL FLOOR AREA
The sum of the horizontal areas of each floor of a residential building, measuring from the interior faces of the exterior walls or from the centerline of the walls separating two (2) buildings. The floor area measurement is exclusive of areas of basements, unfinished attics, attached garages or space used for breezeways, enclosed and unenclosed porches and accessory structures.
RESOURCE EXTRACTION
A use involving the on-site excavation or extraction of surface or sub-surface mineral products or natural resources. Typical extractive uses are quarries, borrow pits, sand and gravel operations, oil and gas extraction and mining operations.
RESTAURANT, CARRY-OUT
A restaurant where food orders are either called in or are placed within the premises with the intention of the customer picking up or waiting for the order to be carried and consumed off the premises.
RESTAURANT, DELIVERY
A restaurant where food orders are called in and delivery of the order is made off-premise to the customer.
RESTAURANT, DRIVE-IN
A restaurant where food is ordered by the customer through a speaker box system or directly to an employee from a vehicle at individual stations outside the restaurant and where food is delivered by employees of the restaurant to the customer for consumption on the premises within their private vehicle or otherwise on-site.
RESTAURANT, DRIVE-THROUGH
A restaurant where food is ordered by the customer through a speaker box system and then delivered through a window to the customer with the intention that the food will be consumed off-premise.
RESTAURANT, DRIVE-UP
A restaurant where food is ordered by the customer through a window from a vehicle without the use of a speaker box system and where food delivery is provided from a window to the customer with the intention that the food will be consumed off-premise.
RESTAURANT, GENERAL
An establishment primarily engaged in preparation of full course meals served on premise, with complete kitchen facilities for preparation of the food sold and where alcoholic beverages may be sold in conjunction with meals or at a bar within the restaurant, provided that at least fifty percent (50%) or more of the gross income generated at the restaurant is related to food sales.
RESTAURANT, LIMITED
A use engaged in the preparation and retail sale of food and beverages, excluding alcoholic beverages. Typical uses include soda fountains, ice cream parlors and coffee shops. This term does not include restaurants that would be included under the definition of "fast food" or "drive-in".
RESTRICTIVE COVENANT

RETAINING WALL
The structure that is constructed between lands of different elevations to stabilize the surfaces, prevent erosion and/or protect structures.
REVERSE VENDING MACHINE
See "RECYCLING FACILITIES".
REZONING
Amendment of the zoning district classification applicable to one (1) or more specific parcels of property. Also called "zone change".
RIGHT-OF-WAY
The land opened, reserved or dedicated for a street, walk or other public purpose.
ROOF
The outside top covering of a building or structure.
ROOF, MANSARD
A roof having two (2) slopes on all four (4) sides, with the lower slope almost vertical and the upper slope almost horizontal or which, from the ground, has the appearance of this type roof.

SCREENING
The method of visually shielding or buffering one abutting or nearby structure or use from another by fencing, walls, berms or planted vegetation.
SECONDARY STREET

SECONDARY SUCCESSION PLANTS
The ecological term for a stage of a plant community on a site that has already supported a predecessor stage of plant life or has, through the process of succession, reached an equilibrium or steady state.
SELF-CARE/ASSISTED LIVING UNIT
Residences for the frail elderly that provide rooms, meals, personal care and supervision of self-administered medication.
SEMI-PUBLIC USE
A use owned or operated by a non-profit, religious or charitable institution for the purpose of providing educational, cultural, recreational, religious or social services to the general public.
SETBACK LINE OR BUILDING LINE
A line parallel to the respective lot line and internal to the lot that defines the required building setback as specified in the zoning district regulations of Article V.
The derivations of setback line shall maintain the following definitions:
1. 
Setback line, front shall be parallel to the front lot line and shall extend from side lot line to side lot line;
2. 
Setback line, rear shall be parallel to all rear lot lines and shall extend from side lot line to side lot line. If there is no rear lot line, a semi-circular rear setback line shall be drawn with a radius equal to the rear setback requirement and a center at the intersection of the side lines; and

SIGHT TRIANGLE
The triangular-shaped portion of land established at street intersections in which nothing shall be erected, placed, planted or allowed to grow in such a manner as to limit or obstruct a distance of clear vision for motorists entering or leaving the intersection. (See Division 3 of this Article.)
SIGN

SITE DEVELOPMENT PLAN
The development plan for a multi-family development, manufactured housing park or non-residential development that is currently residential or vacant in use and where no additional lots of record are being created.
SITE MAP
The required map of a development or preservation concept typically for a site development plan. See "CONCEPT PLAN".
SKETCH PLAN
The map of land proposed to become subdivided land and specified supporting materials, whose purpose is to allow the evaluation of the basic or conceptual feasibility and design characteristics of the development at an early stage in the planning process in accordance with the UDO.
SLUDGE
Any solid, semi-solid or liquid waste generated from a municipal, commercial, institutional or industrial wastewater treatment plant, water supply treatment plant or air pollution control facility or any other waste having similar characteristics and effects.
SOLID WASTE TRANSFER STATION
A facility where refuse and garbage (but no hazardous waste) is delivered for compaction or aggregation and is loaded on trucks for shipment to a remote landfill or other disposal facility.
SPECIAL EVENT
See Article XI, Special Events.
SPECIAL EVENT AGREEMENT
The agreement to compensate the County for loss or damage to public property the deposit of a surety or cash bond in an amount sufficient to guarantee the cleaning up of the site and the removal of any debris left as a result of the holding of a specific event.

STABLE, TRACK OR POLO FIELD
Any structure or area located on a lot designed, arranged or used for the care, exercise, running, feeding and storage of horses and other similar animals including, but not limited to, ponies, donkeys and mules.

STATE PLANE COORDINATE SYSTEM
The method developed by the National Geodetic Survey for mapping each State within a grid system.
STOCKYARD
An establishment or place of business primarily used for the temporary keeping of livestock for slaughter, market, auction or shipping.
STORAGE
The placement, keeping or retention of vehicles, equipment, materials, goods or products for intermittent use or subsequent distribution or transfer.
STORM WATER MANAGEMENT
The control and management of storm water to minimize the detrimental effects of surface water runoff.
STORY
That part of a building between the surface of one floor and the surface of the floor next above or, if there be no floor above, that part of the building which is above the surface of the next highest floor thereof. A top story attic is a half story when the main line of the eaves is not above the middle of the interior height of that story. The first (1st) story is the highest story having its interior floor surface not more than four (4) feet above the curb level, established or mean street grade or average ground level.
STREAM
The body of water flowing in a natural surface channel. Flow may be continuous or only during wet periods.
STREET
An improved way for the conveyance of motor-driven, rubber-tired vehicles, such as automobiles and trucks. A street is sometimes referred to as "road", "roadway", "highway" or "thoroughfare". See Section 400.2520 for additional terms related to functional classes of streets.
STREET AND ROADWAY PLAN
The current plan adopted by the County showing the location of streets, roadways and highways and specifying the general alignment, functional classification, acceptance, widening, removal, extension, relocation, narrowing, vacation, abandonment, change of use, acquisition of land for sale or lease of streets and roadways within the jurisdiction of the County.[2]
STREETSCAPES
The design term referring to all the elements that constitute the physical make-up of a street and that, as a group, define its character, including building frontage; street paving; street furniture; landscaping, including trees and other plantings; awnings and marquees; signs; and lighting.
STRUCTURAL ALTERATION
Any change, other than incidental repairs, to any structure.
STRUCTURAL BUFFER
The fence, wall, berm or any combination thereof used to physically separate or screen a use or property from another so as to visually shield or block noise, lights or similar disruptions. Structural buffer does not include vegetative screening.
STRUCTURE
Anything constructed or erected, the use of which requires a permanent location on the ground or which is attached to something having a permanent location on the ground.
SUBDIVIDER
Any person, firm, partnership, association, corporation, estate, trust or any other group combination acting as a unit, dividing or proposing to divide land so as to constitute a subdivision or any person acting on behalf of the forgoing as indicated by written consent.
SUBDIVISION
The division of a lot, tract or parcel of land into more than two (2) lots, tracts or other divisions of land.
SUBDIVISIONS, MINOR
A division of land into no more than four (4) lots, less than four (4) acres in size, having access to a County or State maintained street or to a private drive or a division of land into lots four (4) or more acres in size having access as required under this UDO or a boundary adjustment plat or a division of parcels for utility purposes or a combination of two (2) or more parcels into one (1) lot and not in conflict with any provision of this UDO.
SWIMMING POOL
A structure, whether indoors or outdoors, above or below the surface of the ground or both, intended to contain water for swimming or wading, having an inside wall depth at any point of more than two (2) feet or a surface area exceeding two hundred fifty (250) square feet.

A use established for a fixed period of time with the intent to discontinue that use upon the expiration of the time period.
THEATER
A building or premises devoted to showing motion pictures or for live dramatic or musical performances. Terms associated with theater shall be defined as follows:

DRIVE-IN MOTION PICTURE THEATERAn open lot with its appurtenant facilities devoted primarily to the showing of motion pictures or other prerecorded productions to patrons primarily seated in automobiles.

MOTION PICTURE THEATERA building primarily used for the exhibition of movies or other prerecorded productions to the general public in an indoor setting.

TOW LOT
A storage lot for the keeping of towed vehicles on a temporary basis.
TOWER
A structure that is intended to send and/or receive radio and television communications. Terms associated with tower shall mean as follows:

ANTENNAAn arrangement of wires, metal rods or other materials used for the transmission and/or reception of electromagnetic waves. The derivations of, modifications of or words directly associated with antenna shall maintain the following definitions.
2. 
ANTENNA FOR NON-COMMERCIAL USEAny antenna external to a building, including any supporting structure such as a tower, which is not hand-carried while in use and is used for reception or electromagnetic signals, such as radio or television broadcasts or direct satellite television or for transmission of electromagnetic signals by a licensed amateur radio operator or by means of an Earth-orbiting satellite communications device.
3. 
ANTENNA SUPPORT STRUCTUREAny mast, pole, tripod, tower or similar structure used to support an antenna.
4. 
ANTENNA SYSTEMThe combination of an antenna and antenna support structure.

ANTENNA SYSTEM HEIGHTThe overall vertical length of the antenna system above grade. If the system is located on a building, the overall height shall include the height of the building.

TRACT
A single unit of real property under one (1) ownership that may be platted or unplatted.
TRAILER
A portable structure supported by wheels, jacks, horses, skids or blocks without permanent foundation that is towed or hauled by another vehicle used for temporary human occupancy, to carry materials, goods or objects or use as a temporary office.
TRANSIENT MERCHANT
A person who does not maintain a permanent place of business and sells any good or service for profit for himself or herself or their principal.
TRANSITION AREA
An area that lies, and may act as a buffer, between two (2) land uses of different intensity.
TRAVEL TRAILER CAMPS
A tract or parcel of land where temporary accommodations are provided for two (2) or more travel trailers open to the public either free or for a fee.
TREE CONSERVATION PLAN
The plan approved prior to issuance of a land disturbance permit, clearing permit, grading permit or building permit.
TREE MASSES
An area having more than ten thousand (10,000) square feet of tree canopy coverage. This area may be a single area or a grouping of smaller areas, provided the tree canopy covers seventy-five percent (75%) of the designated area.
TRUCK SALES, LEASE AND RENTALS
The sale, lease or rental of trucks, tractors, construction equipment, trailers, agricultural implements and similar heavy equipment, including incidental storage, maintenance and servicing. Typical uses include truck dealerships and construction equipment dealerships.
TWO-FAMILY DWELLING (DUPLEX)

TYPE CG-1 CONCRETE CURBING
The integral concrete sidewalk and curb with a vertical face.
UDO
The Unified Development Order of Jefferson County, Missouri.
UNDERGROUND SPACE (UNDERGROUND STORAGE)
The entire cavern resulting from the extraction of subsurface-located material in such a manner that the surface area of the property is not disturbed except in the vicinity of the entrances and easements servicing the development.
UNRELATED
Two (2) or more people not related by blood, marriage or adoption.
URBAN TYPE SERVICES
Utilities, such as water, gas, electricity and sewer, and public services, such as police, fire, schools, parks and recreation, provided to an urbanized or urbanizing area.
USE
The purpose or activity for which the land or building thereon is designed, arranged or intended or for which it is occupied or maintained.
USED MERCHANDISE STORE
The use of a building or premises primarily for the retail sale of used merchandise or secondhand goods, such as used clothes, antiques, secondhand books or rare manuscripts or items of architectural salvage, but not including used cars or other motorized vehicles or pawnshops.
USES PERMITTED AS OF RIGHT BUT WITH CONDITIONS
The use or occupancy of a structure or a use of land permitted only upon meeting the limitations and conditions specified in Article IX of this UDO. Also referred to as "use permitted with conditions" or "specified use permitted with conditions".
USES SUBJECT TO CONDITIONS
A use allowed in the particular zoning district upon a finding by the County Council that all of the special conditions delineated in the particular zoning district regulations are met in accordance with the provisions of this UDO.
U.S.G.S.
The United States Geological Survey; an agency in the U.S. Department of Interior.
UTILITY
Any agency that, under public franchise or ownership or under certificate of convenience and necessity, provides the public with electricity, gas, communication, water, sewage collection, rail transportation or other such service. This definition shall also include a closely regulated private enterprise with exclusive franchise for providing a public service.
UTILITY COMPANY
A private business providing electricity, natural gas, telephone, wireless communications or other services under the regulation of the Missouri Public Services Commission or license of the Federal Government.
VACATION
The official abandonment of public right-of-way, subdivision or easement by the County in accordance with State law.
VARIANCE
A modification of the application of certain regulations or provisions of this UDO by the Board in accordance with the procedure established by Article IV of this UDO.
VEHICLE, INOPERATIVE
Any wrecked, disabled or damaged vehicle. Any one (1) of the following conditions shall be deemed prima facie evidence that a vehicle is inoperable:
1.
Placement of the vehicle or parts thereof upon jacks, blocks, chains or other supports;
2.
Absence of one (1) or more parts of the vehicle necessary for the lawful operation of the vehicle upon the streets and highways;
3.
Storage of a vehicle with one (1) or more deflated tires.
The term "inoperative vehicle" does not apply to operable hobby or recreational vehicles.
VEHICLE, MOTOR
Any passenger vehicle, motorcycle, recreational vehicle, truck, trailer truck or semi-trailer that is propelled or drawn by mechanical power.
VESTED RIGHT
A right that cannot be changed or altered by changes in regulation.
VETERINARIAN
A veterinary hospital or clinic providing medical care and treatment for animals.
VISUAL CLEARANCE
No visual obstruction including structure, fence or other structure and no tree, shrub or other vegetation within a street intersection sight triangle.
WALL PACK LIGHT FIXTURES
The light fixtures that mount on the wall and shines light outward and sideways. These are the most commonly used security lights on commercial premises.
WAREHOUSING AND DISTRIBUTION
Establishments or places of business primarily engaged in wholesaling, storage, distribution and handling of materials and equipment other than live animals and plants.
WATERCOURSE
Any natural or artificial stream, river, creek, ditch, channel, canal, conduit, culvert, drain, waterway, gully, ravine, drainage way or wash in which water flows in a definite direction or course, either continuously or intermittently; has a definite channel, bed and banks; and includes any area adjacent thereto subject to inundation by reason of overflow or floodwater.
WATERSHED
An area of land that water runs across or under on its way to a stream or river that is located at the lowest point in the watershed.
WATERWAY
Any body of water, including a creek, canal, river, lake or bay, or any other body of water, natural or artificial, except a swimming pool or ornamental pool on a single lot.
WETLAND
Those areas that have a predominance of hydric soils and that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. This does not include the following surface waters of the State intentionally constructed from sites that are not wetlands: drainage ditches, grass-lined swales and landscape amenities.
WETLAND, MANUFACTURED
The wetland created from non-wetland sites through purposeful, legally authorized human action, such as irrigation and drainage ditches, grass-lined swales, canals, detention facilities, wastewater treatment facilities, farm ponds and landscape amenities.
WHOLESALE ESTABLISHMENT
A business establishment primarily engaged in selling merchandise to other than the general public.
WIRELESS TELECOMMUNICATION
The transmission through the air of information in the form of electromagnetic or optical signals including television, AM/FM radio, digital, microwave, cellular, telephone or similar forms of electronic or optical wireless communication.
WIRELESS TELECOMMUNICATION FACILITY
A facility including antennas and transmitting and receiving equipment for wireless telecommunication, including personal wireless services facilities.
YARD
An open space between a principal building or buildings and the nearest lot line. In measuring a yard for the purpose of determining the width of a side yard, the depth of a front yard or the depth of a rear yard, the least horizontal distance between a lot line and the building or any protrusions therefrom shall be used. The derivations of yard shall maintain the following definitions:
1. 
YARD, FRONTA yard across the full width of the lot extending from the front line of the main building to the front line of the lot.
2. 
YARD, REARA yard between the rear lot line and the rear of the main building and the side lot lines.
3. 
YARD, REQUIREDThe minimum open space between a lot line and the buildable area of a lot within which no structure, parking area or other obstruction shall be located except as provided by this Chapter.
4. 
YARD, REQUIRED FRONTThat yard established by the front setback requirement of this Chapter and the established front lot line.
5. 
YARD, REQUIRED REARThat yard established by the rear setback requirement of this Chapter and the established rear lot line.
6. 
YARD, REQUIRED SIDEThat yard established by the side setback requirement of this Chapter and the established side lot line.
7. 
YARD, SIDEA yard between the main building and the adjacent side line of the lot and extending entirely from the front yard to the rear yard thereof.
ZERO LOT LINE
A common lot line on which a wall of a structure may be constructed.
ZERO LOT LINE DEVELOPMENT
The arrangement of buildings on adjoining lots where the buildings touch a common lot line, thereby providing zero (0) yard on that side.
ZONING
The delineation of districts and the establishment of regulations governing the use, placement, spacing and size of land and buildings.
ZONING MAP
The Zoning Districts Map Jefferson County, Missouri, adopted May 8, 1991, as amended, and including all the notations, references and information shown thereon.
ZONING OFFICIAL
The administrative officer who administers the UDO.
