A. 
A person commits the offense of possession of alcoholic beverages in public park if he/she shall knowingly possess or consume any intoxicating liquor (as defined in Chapter 311, RSMo.) in open view within the limits of any public park in the City of Bolivar.
B. 
Possession of alcoholic beverages in public park shall be an ordinance violation.
C. 
The penalties for the ordinance violation set forth herein are imposed in Section 100.220 of this Code.

A. 
A person commits the offense of fishing in park if he/she shall knowingly take any species of fish, by whatever means, from any water within any park of the City of Bolivar, whether flowing or impounded.
B. 
Exceptions.
1. 
The Park Committee or the Board of Aldermen may grant exceptions to this Section for persons under the age of fourteen (14) who are sponsored by an exempt organization as described in Internal Revenue Code Section 501.
2. 
The Park Committee shall only grant exceptions, in writing, setting forth regulations for fishing, including, but not limited to, the means to be used to take fish and the period of time such means will be allowed.
C. 
Fishing in park shall be an ordinance violation.
D. 
The penalties for the ordinance violation set forth herein are imposed in Section 100.220 of this Code.

It shall hereafter be unlawful to operate any motor vehicle which is required by laws of the State of Missouri to be licensed within the limits of Dunnegan Memorial Park except upon the paved roadways thereof.

It shall hereafter be unlawful for any person to injure, maim or kill any of the species of ducks, geese, peacocks or other fowl or birds within the limits of Dunnegan Memorial Park.

A. 
The grounds of the Girl Scout Park, a public park belonging to the City of Bolivar, Missouri, and all improvements and facilities therein are hereby declared to be open to the public during the hours 7:00 A.M. until sundown of each day.
B. 
It shall be unlawful for any person to park a motor vehicle within the grounds of said park except during the open hours or to leave a motor vehicle parked after the expiration of open hours or to trespass upon the grounds, improvements or facilities of said park by foot, motor vehicle, self-propelled vehicle or otherwise except during the open hours of the park as established herein.
C. 
Any person that parks or trespasses upon the grounds of the Girl Scout Park during the hours that it is closed to the public shall be deemed to have committed the offense of second degree trespass as defined by Section 225.370(B) of the Code of the City of Bolivar, punishable as provided by Section 100.220 of this Code.

A. 
There is hereby created a Parks and Recreation Advisory Committee to consist of seven (7) members, none of whom shall be elected officers of the City of Bolivar. In addition to the seven (7) regular members, the Mayor and the City Administrator shall be ex officio, non-voting members of the Committee.
B. 
The Parks and Recreation Advisory Committee shall be responsible for making recommendations to the Mayor, the Board of Aldermen and the City Administrator relating to the operations of the system of public parks and recreational programs offered or to be offered by the City. This may include, by way of example but not of limitation, recommendations as to the development of new parks or recreational programs, the elimination of existing parks and recreational programs, the improvement of existing parks and recreational programs, the addition or elimination of facilities within parks or recreational grounds or facilities, the improvement, maintenance and repairs of parks or recreational grounds or facilities, the addition or replacement of equipment, technology or tools to enhance the City's parks and recreational grounds and facilities and/or programs, and such additional matters as may be brought before the Committee at the request of the Board of Aldermen or by the Mayor or City Administrator.
C. 
Members to the Parks and Recreation Advisory Committee shall be appointed by the Mayor, with the advice and consent of a majority of the members of the Board of Aldermen voting on the Mayor's appointment.
D. 
Each Committee member shall serve a term of three (3) years, except the initial Committee shall be staggered so that two (2) persons will serve a term of one (1) year, two (2) persons will serve a term of two (2) years, and three (3) persons will serve a term of three (3) years. The term of office shall commence on May 1 of each year and shall continue until his or her successor is duly appointed and accepts such appointment, provided that the initial appointments shall be made as soon as practical after the adoption of this Section and such initial appointees shall service until May 1, 2011, May 1, 2012 and May 1, 2013 or until their successors are duly elected and accept such appointment. Except for appointments to the initial Committee, appointment shall be made at the regular April meeting of the Board of Aldermen. In the case of a death, removal or resignation of a board Committee, his/her successor shall be appointed to complete the unexpired term as soon after the position becomes vacant as is practical.
E. 
To be eligible to be a member of the Parks and Recreation Advisory Committee, a person must meet the following requirements and qualifications:
1. 
A member must reside in Polk County, and no fewer than two (2) members of the Committee shall be either residents of the City of Bolivar or own, have a substantial interest in, or be employed by a business, industrial firm, non-for-profit organization or political subdivision of the State of Missouri that has a regular place for the conduct of its business in the City of Bolivar, Missouri; and
2. 
A member must demonstrate a particular interest in and knowledge of parks and/or recreation as evidenced by his or her education, training or occupation or as evidenced by his or her active and regular use of the City's park system and/or active and regular participation in its recreational programs and activities (which, in addition to personal participation, may be evidenced by team sponsorships, coaching, attendance at recreational events or other evidence of a strong and active interest in the City's recreational programs).
F. 
Committee members may be removed, with or without cause, prior to the expiration of their term, upon the written recommendation of the Mayor with the approval of a majority of the Board of Aldermen voting on the question of removal or by a vote of two-thirds (2/3) of the entire Board of Aldermen without the Mayor's recommendation. Any Committee member who misses more than one-third (1/3) of the special and regular meetings of the Committee over a six-month period will be deemed to have resigned from the Committee, unless such absence is related to the serious illness or other personal or immediate family emergency over which the member has no control.
G. 
The Parks and Recreation Committee will organize itself at its first meeting following the initial and each annual appointment of members by the election of a Chairman, Vice Chairman, a Secretary, and such other officers as the Committee may determine. The officers of the Committee shall perform those functions normally performed by persons in the specified offices, and such other duties as the committee may assign from time to time. All officers except the Secretary shall be a voting member of the Committee. The Secretary may, but need not, be a voting member. If an officer who is also a voting member of the Committee shall die, resign or be removed as a voting member or if an officer shall resign his office but remain a member of the Committee, the Committee shall elect a successor at its first regular or special meeting after the vacancy shall occur.
H. 
The Committee may, by resolution, set a date, time and place for regular meetings, and no notice of a regular meeting need be given to the members. A special meeting of the Committee may be called by the Chairman, any two (2) voting members of the Committee, the Mayor or upon the written request of at least three (3) Aldermen of the City. Notice of a special meeting shall state the purpose or purposes for which the meeting is called and shall be mailed by ordinary mail at least three (3) days before the meeting or delivered at least twenty-four (24) hours prior to the date of the meeting to the Committee member's usual residence and left with the Committee members or a member of his household over the age of fifteen (15) years.
I. 
The Committee shall be subject to the terms and provisions of the Missouri Open Meetings Law and shall comply with such law in connection with all of its meetings.
J. 
The Secretary of the Committee shall keep, or cause to be kept, accurate minutes of the meetings of the Committee and shall furnish copies of the same to the City Clerk or Deputy City Clerk who shall be responsible, in turn, to cause the same to be furnished to the Mayor and the Board of Aldermen.

A. 
The City is hereby authorized to establish a Recreational Facility, Recreational Program and Sporting Program Cost and Fee Schedule for the purpose of establishing the costs and fees to be charged to the general public and associated with the following:
1. 
Access to, use of, or membership to the City's recreational facilities and/or Aquatic Center; and
2. 
Participation in the City's sporting programs; and
3. 
Participation in the City's recreational programs.
B. 
The City' s Recreational Facility, Recreational Program and Sporting Program Cost and Fee Schedule will initially be adopted by the City Administrator and may be modified from time to time at the discretion of the City Administrator. The said cost and fee schedule will be based upon the City's costs for materials, employment labor/salaries/benefits, equipment, and overhead and will be consistent with the market price for such fees and costs in the private sector for like services.
C. 
The City's Recreational Facility, Recreational Program and Sporting Program Cost and Fee Schedule will become effective immediately upon its adoption by the City Administrator and upon the filing of the same for public inspection with the City Clerk's office. The said cost and fee schedule will also be published on the City's website. Any subsequent amendments to the said cost and fee schedule will become effective thirty (30) days following adoption by the City Administrator, submission to the City Clerk's office for public inspection, and publication on the City' s website.
D. 
The City Administrator may also provide for and establish terms and conditions and billing schedules for membership programs and other recurring costs and fees related to the City's recreational facilities and programs, including provisions for delinquent payments and interest on delinquent amounts due, provided that any such interest may not exceed the rate of three-quarters of one percent (0.0075%)per month.
E. 
Notwithstanding the foregoing provisions of this Section, the Board of Aldermen may vote to direct the City Administrator to make any amendments or revisions desired by the Board of Aldermen to the Recreational Facility, Recreational Program and Sporting Program Cost and Fee Schedule. Any such revisions required by the Board of Aldermen will be implemented by the City Administrator through adoption of an amendment to the said cost and fee schedule and will become effective consistent with the foregoing provisions of this Section.
