The owners, agents-in-charge, tenants or occupiers of all properties
in the Borough of Lansdale are hereby required to cause the sidewalks
and pavements bordering their respective properties to be kept clear
of ice or sleet at all times or to cause the ice or sleet upon the
sidewalks and pavements aforesaid to be sprinkled at all times with
sand or other similar substances or materials in such a manner that
the sidewalks and pavements shall be safe for pedestrian traffic.
The owners, agents-in-charge, tenants or occupiers of all properties
in the Borough of Lansdale shall clear or cause to be cleared a pathway
on the sidewalk on their respective properties in the event of snow.
Such pathways shall not be less than 30 inches in width and shall
be thoroughly cleared of snow and ice or covered with salt, sawdust
or similar materials.
No owner, agent-in-charge, tenant or occupier of the properties
aforesaid, in removing or causing to be removed snow from the sidewalks,
shall throw or cause to be thrown or blown snow into the cartway area
of the abutting street, but shall throw or cause to be thrown or blown
such snow into the area inside the sidewalk lane or between the sidewalk
and the curb or otherwise dispose of and remove said snow.
Any person who fails to comply with the provisions of this article
within 24 hours after snow or sleet has ceased to fall shall, upon
conviction in a summary proceeding brought before a Magisterial District
Judge under the Pennsylvania Rules of Criminal Procedure, be guilty
of a summary offense and shall be punishable by a fine of not more
than $1,000, plus court costs and reasonable attorneys' fees incurred
by the Borough in the enforcement proceedings. Upon judgment against
any person by summary conviction, or by proceedings by summons on
default of the payment of the fine or penalty imposed and the costs,
the defendant may be sentenced and committed to the Borough lockup
for a period not exceeding 10 days or to the county jail for a period
not exceeding 30 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this article that is violated shall also
constitute a separate offense.
