No property owner of any property in the Borough of Lansdale
shall plant, install or maintain any tree, bush, shrubbery, vegetation
or any other thing in such a way that it shall to any degree extend,
either at ground level or at any height above ground level, over or
into the sidewalk area in such a way that the same shall interfere
in any way with the full and unobstructed use of the whole width of
the sidewalk.
In the event that any intrusions into the sidewalk area are
found to exist and the property owner shall fail, after 10 days' written
notice by the Public Works Department, to remove or trim back the
same as necessary, the Public Works Department shall be authorized
to remove such intrusion, the cost of so doing to be liened against
the property involved in accordance with the provisions of the Borough
Code.
Any person who violates or permits a violation of this article
shall, upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000, plus court costs and reasonable attorneys' fees
incurred by the Borough in the enforcement proceedings. Upon judgment
against any person by summary conviction, or by proceedings by summons
on default of the payment of the fine or penalty imposed and the costs,
the defendant may be sentenced and committed to the Borough lockup
for a period not exceeding 10 days or to the county jail for a period
not exceeding 30 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this article that is violated shall also
constitute a separate offense.
