It shall be unlawful for any person to falsely communicate the report of fire or other emergency to the Emergency Services Department.

The Emergency Services Department of the City shall be composed of such officers and personnel as shall be required for the public safety.

The Emergency Services Department shall be under the control of the Chief of the Emergency Services Department.

The Chief of the Emergency Services Department shall be appointed by the Mayor, subject to the approval of the City Council.

The Chief of the Emergency Services Department shall have the same Police powers at all fires as the Police Chief and may command such assistance from bystanders and inhabitants of the City for the suppression and extinguishing of fires as may be required; they shall have the power to order any Firefighter or any person away from the neighborhood of the fire.

The Emergency Services Department shall have the power to tear down or blow up any building or buildings, when in the judgment of the Chief it is actually necessary to prevent the spreading of the fire.
Other responses by the Fire Department to requests for assistance outside the City limits not covered by mutual aid agreements, for which partial or full reimbursement for such response is available and appropriate, at the discretion of the Chief.
The rates and charges for such costs shall be based upon reasonable estimates of the actual costs of providing such services, and a schedule of said rates and charges shall be kept on file with the City Clerk and the Fire Department. This schedule may be updated periodically, but not more frequently than once every twelve (12) months, with each revised schedule to be kept on file with the City Clerk and the Fire Department. Cost recovery for State or Federally declared disasters may be subject to FEMA/SEMA rate schedules. The initial schedule is on file in the office of the City Clerk.
