The rules and regulations set out in this Chapter shall apply to all City recreational areas and facilities.

The following words, terms and phrases, when used in this Chapter, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:
The head of the department of parks and recreation or his/her designated representative.
All recreational areas and facilities, parks and park facilities owned or operated by the City.
Any person living within the City with an intention to live within the City limits permanently or for an indefinite period of time and which shall likewise include any foreign exchange student who is a member of a household located within the City limits. For the purpose of resident card eligibility, the term "resident" will also apply to the owner of any business located within the City and his/her immediate family or if more than one (1) person owns the business, then the individual who signs the business license application and his/her immediate family shall be deemed to be residents.

A.
James J. Eagan Civic Center, JFK Community center, and Sunset Nature Lodge shall close by 9:00 p.m., with the exception of a previous approved scheduled event and shall stay open no later than 12:00 a.m.
B.
Park hours are dawn until 8:00 p.m., or one-half (1/2) hour after the last scheduled ball game on lit fields.
C.
Tower Court Park is open dawn until 10:00 p.m.
D.
Persons are prohibited on park grounds at night after 8:00 p.m. continuing until one (1) hour before sunrise. These hours and regulations are in effect unless previous approval from the Director of Parks and Recreation is given through written request.

A resident identification card is required for all members of a family over five (5) years of age.

A.
All parks shall be open to the public but residents shall have first (1st) priority for the use of the facilities. However, non-residents may pay a fee, when applicable, which is different than the fees paid by residents and only residents may apply for a reservation of a designated outdoor recreation facility. A certificate of residency must be submitted to the Director when reserving a designated outdoor recreation facility. Certification is established with a display or number of the resident identification card.
B.
In addition to the benefits provided to the residents of the City as set forth above, all such benefits will be available to persons included in an annexation area for a period of six (6) weeks prior to the election on such annexation and for a period of six (6) months after the annexation election, provided that the annexation proposal is approved at the election. During the time prescribed herein, persons within the annexation area may apply either in writing, in person or by phone for use of the parks, provided that proof of residency in the annexation area can be established and such persons shall be assessed the resident fees for daily use of the recreation facilities and theatre of the City as set forth in Section 245.180.

Except as otherwise provided in this Chapter, any persons, teams, groups or organizations using the City's recreational facilities must have fifty percent (50%) or more who are residents of the City. No non-resident shall use a City resident card to gain admission to or use of City recreational facilities. No City resident shall give or lend a resident card to any person.

The park rangers of the City, in addition to the Police force, shall have the authority to issue summons charging the violation of any ordinances of the City or the rules and regulations as established by the Director of Parks and Recreation as the same apply to the use of City parks. Such summonses shall be returnable to the Municipal Court, a division of the County Circuit Court.

A.
All park reservations shall be subject to the following:
1.
No person or group of individuals will be allowed to make reservations for parks for the coming year until after the first (1st) workday of the year for which the reservation is requested and shall be subject to the following:
a.
Reserving park facilities. Park facilities, areas or equipment used for recreational activity may be used on a "first come — first served" basis by City of Florissant residents. Reservations shall be only by written authorization issued by the Director and shall be subject to such restrictions as set forth in the authorization. Reservation authorizations shall only apply to those activities, facilities, areas or equipment and the date and time specified on the authorization.
b.
Fee required for validity. A reservation shall not be considered valid unless the Department has received the payment for any specified fee, if any, for the activity, area, waterway, facility or equipment and no reservations shall be considered held until such fee has been received by the Department and a written authorization issued.
c.
Age limitation. Park facilities, areas or equipment may only be reserved by persons eighteen (18) years of age or older.
d.
One (1) week notice required. Reservations shall not be made for requests received less than one (1) week prior to requested reservation time unless authorized by the Director.
e.
Accountability. The person signing the contract for the reservation shall be held accountable for the condition of the authorized facility, equipment or area at the end of the use and the actions of those in their party and shall be the individual to sign any necessary forms at the end of such function.
f.
Cancelled reservations. The Director may cancel any reservation previously made and permitted when the use of the facility, area or equipment would endanger the public safety or the property of others due to the physical condition of the facility, equipment or area or adverse weather conditions at the time of the intended use; or the facility, area or equipment reserved would be necessary for the use of persons or entities authorized by the City. Any person who has made a reservation may cancel any reservation subject to any terms imposed by the Parks and Recreation Department at the time such reservation is made, which may include imposition of a reasonable administrative fee.
g.
Refunds. Any fees charged for reservations will be refunded to that person in the event the Director cancels such reservation for the purposes stated in this Section.
h.
Use of reserved areas prohibited. No person shall occupy any area or facility, or section thereof, that has been reserved and designated by the Director for the use by certain other persons.
i.
Deposits. Facility deposits may be withheld for violation of contract provisions.

A.
Hours Of Use. Park trails shall be open only during the period of time beginning one-half (½) hour before official sunrise and ending one-half (½) hour after official sunset unless otherwise designated and posted by the Director.
B.
Motorized Vehicles Prohibited. No person shall operate any motorized vehicles on trails except for emergency vehicles, law enforcement vehicles, City vehicles or motorized wheelchairs or other conveyance devices to assist persons with disabilities.

Except for a person who receives a permit to operate as a park concessionaire, which may include the food from a motor vehicle, the parks shall not be available for activities of a commercial nature. No person shall conduct an activity that is in competition with local merchants or the persons who receive permits to operate as concessionaires in City parks.

A.
Where Authorized. A person shall not operate a remote radio-controlled aircraft, watercraft, ground running vehicles, rockets or any other similar device except in areas designated for such operation by the Director.
B.
Display Of Frequency And Channel. Any person operating a radio-controlled craft within a designated area shall prominently display on the transmitter at all times frequency flags and channel numbers.
C.
Operation — Special Restrictions. No person shall operate any radio-controlled equipment in such a manner as to endanger any member of the public, park resource or the property of others. The Director may impose special restrictions on the operation of radio-controlled equipment as necessitated for reasons of public safety and protection of park resources or the property of others.

The City and its employees shall not be liable for or assume any responsibility for valuables brought into the parks nor for the receipt and disbursement of any funds other than City funds.

The City, its agents, servants and employees acting in the scope of their employment is not responsible for lost or stolen property.

A.
Willfully mark, deface, disfigure, injure, tamper with, displace or remove any building, bridge, tables, benches, fireplaces, railings, paving or paving materials, water lines or other public utilities or parts or appurtenances thereof, signs, notices or place cards, whether temporary or permanent, monuments, stakes, posts or other boundary markers, or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal.
B.
Fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition. No person over the age of six (6) shall use restrooms and washrooms designated for the opposite sex.
C.
Damage, cut, carve, transplant or remove any tree or plant or injure the bark, or pick the flowers of any tree or plant; nor shall any person attach any rope, wire or other contrivance to any tree or plant. A person shall not dig in or otherwise disturb grass areas, or in any other way injure or impair the natural beauty or usefulness of any area unless approved by the Director.
D.
Hunt, molest, harm, frighten, kill, trap, chase, shoot or throw missiles or projectiles of any kind or nature at any animal, reptile or bird; nor shall any person remove or have in his possession the young of any wild animal, or the eggs or nest or young of any reptile or bird; nor shall he collect, remove or have in his possession, give away, sell or offer to sell, or buy or offer to buy, or accept as a gift any specimen, alive or dead, of any of the group of tree snails. Exception to the foregoing is made in that snakes known to be deadly poisonous, such as rattle snakes, (water) moccasins, and coral snakes or other deadly reptiles may be killed on sight.

A.
It shall be unlawful for any person, while in or about any City park, to:
1.
Fail to comply with all applicable provisions of the State and City motor vehicle traffic laws in regard to equipment and operation of vehicles, together with such regulations as are contained in these rules and any other provision of this Code and any other ordinance of the City.
2.
Fail to obey all traffic officers and park employees, such persons being authorized and instructed to direct traffic whenever needed in the parks in accordance with the provisions of such regulations as may be issued by the Director of Parks and Recreation.
3.
Fail to observe all traffic signs indicating speed, direction, caution, stopping or parking and all others posted for proper control and to safeguard life and property.
4.
Drive or ride a vehicle at a rate of speed exceeding ten (10) miles per hour, except upon such roads as the Director may designate, by posted signs for faster travel.
5.
Drive or park any vehicle on any park area except the paved park roads or parking areas, or such other areas as may on occasion be specifically designated as temporary parking areas by the Director.
6.
Drive or operate a vehicle in the opposite direction that what has been designated.
7.
Drive or ride a vehicle on a closed driveway past a barricade, or remove a barricade for the purpose of riding or driving a vehicle or any other purpose onto a closed driveway or other part of a park.

Abusive language or obscene activity is not permitted in the parks.

A.
It shall be unlawful for any person, while in or about any City park, to operate or play any musical instrument, radio, mechanical record or tape player, loud speaker, public address system or sound amplifying equipment of any kind within the boundaries of any park in such a manner as to be plainly audible at a distance of fifty (50) feet from the building, structure or vehicle in which it is located without a written permit issued by the Director.
B.
In the event the operation or playing of any musical instrument, radio, mechanical record or tape player, loudspeaker, public address system or sound amplifying equipment shall unduly disturb other park occupants or persons living near the parks, the Director, Police, Park Ranger and any supervisory park employee shall have the authority to order the person responsible for such disturbances to reduce the level of sound to a sound level that will unduly disturb other park occupants or persons living near any park, regardless of any permit or sound levels.
C.
In the event the person responsible for disturbing the other park occupants or persons living near any park, by operating or playing any musical instrument, radio, mechanical record or tape player, loudspeaker, public address system or sound amplifying equipment of any description, refuses to reduce the sound level by as requested by the Director, Police, Park Ranger or supervisory park employee or attendant, such person shall be subject to arrest and/or ejection from the park, regardless of any permit.

Vehicles may be parked in designated areas only, except by authority of the Director.

Garbage, refuse and trash shall be deposited in trash receptacles.

A.
It shall be unlawful for any person, while in or about any City park, to hunt, trap or pursue wildlife at any time.
B.
No person (except off duty Police Officers) shall use, carry or possess firearms of any description, or air pistols, spring guns, bows and arrows, slings or any other forms of weapons potentially detrimental to wildlife and dangerous to human safety, or any instrument that can be loaded with fire blank cartridges, or any kind of trapping device.
C.
Shooting into park areas from beyond park boundaries is forbidden.
D.
The carrying, possession or use of firearms of any description, or air rifles, air pistols, spring guns, bows and arrows, slings or any other forms of weapons shall be permissible while such weapons are being carried to and from a designated area of use of the aforementioned weapons. All such weapons shall be carried in an unloaded state and in carrying cases or broken down.

No dumping shall be allowed in any park within the City or owned by the City unless authorized by the Director. In Sunset Park, no dumping shall be allowed by any individual, organization or City department unless such dumping shall be for purpose of erosion control or for a compost center so designated by the Park Director and any such fill shall constitute clean dirt only.

A maximum discount of 25% off of resident rates for admission fees for the golf course, pools, skating rink and recreational classes shall be awarded to any member of a Board or Commission, Police Reserve or Police Volunteer of the City of Florissant. | ||
These fees may not be reduced or waived except as follows: To facilitate a meeting or event for the City of Florissant or another government agency. Any 501c3 not-for-profit organization located in the City of Florissant may rent a facility for 50% of the normal rental rate up to 2 times per year with the exception of theatre rentals. Non-resident 25% discount 1 time per year. Fees can be adjusted based on the discretion of the Director of Parks and Recreation. | ||

A.
The use of bicycles, scooters, roller blades, roller skates and skateboards is lawful in parks unless otherwise prohibited by other ordinance or law.
B.
It shall be unlawful for any person, while in or about any City park, to use a bicycle, scooter, roller blades, roller skates or skateboard on other than a paved vehicular road or path designated for that purpose. A bicyclist shall be permitted to wheel or push a bicycle or scooter by hand over any grassy area or wooded trail or on any paved area reserved for pedestrian use.
C.
It shall be unlawful for any person, while in or about any City park, to leave a bicycle in a place other than a bicycle rack when such rack is provided and there is space available.
